the positive incendiary flame that ignites a brave new challenge that,
ultimately, brings about an ascended existence such as you may have
never experienced otherwise. For we are, indeed, more than the sum

While several of you and I have only recently begun working
together on your projects, I have represented a great number
of you for several years.
And, as you are aware, I have shared information with a select
number of you regarding my terminal illness that was discovered
several years ago. Actually, with several of you, we have had
lengthy and in-depth conversations regarding it, life, and other
elements of this precious existence.
I am now providing this medical update to all current clients to
inform you that, during the past Thanksgiving holiday, as
opposed to what I thought would simply be a festive time of
celebration with my family I, unexpectedly, found myself
spending a portion of the time in the hospital, only to
ultimately to learn that my condition's stage has now
advanced significantly.
As such, I shall be relocating to Dallas, Texas shortly after the
first of the year in order to receive ongoing treatment for the
remainder of time left. Obviously, this is not the type of
"news" one ever desires to hear, particularly, during this time
of year.
Alternatively, I shall continue to diligently work with you on

"Why I May Be Moving To Mars...Seriously!"

Although this nightmarish scenario that I am about to describe
to you is highly and likely improbable, there is always that
ingrained element known as "margin of error" which could be
swayed in an undesired direction.
And, at this point, this scenario is possible due to the final
results still being as far away as a Texas prisoner is from
receiving a get well card from the local mortician after being
shot multiple times while trying to escape.
I'm speaking off-topic for the moment about the upcoming
landmark historical 2008 presidential election that, as of this
writing and its related post, is a mere 61 days away, to be
conducted on November 4th (that's THIS year for all the
Harvard and Yale graduates reading this).
So, here's the very scary scenario X millions of voters...
You missed the opportunity to vote on November 4th because...
1. You were at your day job and your boss would not allow you
to leave (a clear violation of your Civil Rights, for sure). If only
you could have gotten that house band gig every night at that
new ritzy upscale live music club called "Ying Yang."
Unfortunately, your music rivals, "The Tootie Frooties" band,
won that regular nightly gig that you were hoping for, and which
is paying them a record $1,400 per week. Not bad change at all
for a band with only three members, and two of whom you
taught to play guitar and bass back in the day.
2. You forgot to vote (that's strange, because with the entire
day being about the election, it is likely that the onset of
Alzheimer's is already upon you).
3. Your automobile would not start. One of the reasons is
because you can no longer find auto parts for a 1970 first-year
Gremlin. Also, you did not bother extensively searching for the
part needed because, at this point, you are sick and tired of
the neighborhood kids comparing the rear sides of your car that
has the horizontal and vertical stripes to the rudder and
vertical stabilizer on a jet airplane.
To add insult to injury, the last straw was when one of the kids
yelled that all your car needs is a set of wings and a flight plan.
4. Your wife wanted you to go Christmas shopping with her at
both the "Pay Less" store and the "Pay More" store (and, to
avoid an argument, you did). Of interest to note, is that she
only bought you a pair of socks (price: $1.89 including tax) as a
Christmas gift from the Pay Less store, with her reasons
primarily, being because you lost out on getting the gig that the
"Tootie Frooties" got, when you and she both know that your
band is much better.
In any event, unfortunately, one of the socks already had a
hole in the right toe that you didn't see before your wife
purchased the socks, and you couldn't return them because
you remember there was an "All Sales Final" sign over the socks
bin.
The shopping budget for your wife, however, came to an
unprecedented (and unwarranted) $789.32 (plus tax) at the
Pay More store, which is part of a national upscale chain akin
to Saks Fifth Avenue.
5. Your husband wanted you to go shopping with him (huh???)
6. Your wife forced you to shop so long with her that you
returned home late too tired to watch the election results on
CNN.
7. All Of The Above
So, on November 5, 2008, as you are getting dressed to go to
work, as do many people, you turn on the television to hear if
your new president is named John McInSane, of if Barack
Obama actually pulled it off and made history.
But, for some reason, the all but forgotten phrase, "chad,"
keeps being tossed around between the television anchors'
conversation. Oh, no! Not that again! A three-peat? More of
the same! That's McInSane!
To be sure, McInSane is in office, with a previously unheard of
"Annie Oakley" type, gun-totin', moose huntin', tobacco-chewing,
snuff-dippin'/spittin' Vice President named Sarah ImPalin'!
By the way...my apologies in advance to any Alaskan moose
reading this, because no citizen should have to live in fear for
his or her life like you guys (and girls) do daily.
What is it with these gun-toting vice presidents and vice
presidential candidates these days anyway? Because, in my
opinion, this is clearly a blatant example of getting more "buck
for your bang."
That last guy, er, what's his name...Dick (or is it Richard?)
Cheney, instead, took the "high road" by aiming his gunsight on
and shooting the stuffing out of a real live human...a reportedly
close 78-year-old friend named Harry Whittington while on a
hunting expedition a couple of years ago. Whittington, who
was an Austin attorney at the time, had given $1,000 to
President Bush's 2000 campaign and $2,000 to his 2004
re-election campaign, but I guess that wasn't quite enough
and he came up short...literally.
I often wonder if, as a result of this "accident," Vice President
Cheney was required afterward to attend either an anger
management course, a defensive shooting course so that the
incident would not be made a permanent part of his shooting
record with law enforcement agencies, or both.
At Mr. Whittington's misfortune, I, however, learned a valuable
lesson, which is if I ever donate to a presidential re-election
campaign, I should strongly consider giving, at least, double the
amounts, at a minimum of $6,000 in the interest of offsetting
any safety and security issues that may, possibly, be awaiting
me in the woods. On second thought, it's probably a good thing
that I don't hunt.
To add insult to injury, Vice Presidential candidate Sarah Palin
said back in June of this year that two incidents regarding the
United States is God's will.
1. The Iraq War - Palin says it was/is God's will.
2. Oil drilling in Palin's home state of Alaska. Yes, she has
actually gone on record to say that it is God's will that drilling
begin in Alaska.
Now, with this direct connection to God and His specific
thoughts, I'm thinking Mrs. Palin is being seriously shortchanged
financially by accepting the vice presidential position when she
can, obviously, hone in spiritually like this to the tune of millions
of dollars. I mean, why settle for less? Why settle for less,
indeed?
Of course, she will need to ensure nothing less than absolute
accuracy during her "hone-ins" lest she end up like that past
famous seer affectionately known as "Ms. Cleo." The strangest
thing about Ms. Cleo, though, is that in her own situation, she
never saw it coming.
But, as you can see, it is seriously time for my consideration of
relocation...not just to another geographical area, but to
another planet.
As such, I have selected Mars as my planet of choice, with the
only exception of not making my move being that B. O. lands
the top political U. S. political spot this November.
Further, in defense of my relocation consideration, I also hear
that Mars is great this time of year.

And, You Think Your Band Is Broke???
What you are about to read, you may not believe, and
may feel that the story is made up. But, I swear that it
is entirely true.
And, the next time you are feeling sorry for you or your
band not having enough money, these truths about my
own first band back in 1976 may make you realize just
how financially solvent and rich you already are:

"THE LIGHTS OF SOUL"
Though we would experience dark days, we had the
audacity to name our band "The Lights Of Soul." We
were so poor that, at one point, we seriously considered
renaming it "The Welfare Band" (which was much more
appropriate) in hopes that our community would feel so
sorry for us that they would put dollar bills in our tip jar
instead of simply tossing us loose change. Actually, on
second thought, we never had a tip jar because we
couldn't afford that either. If memory serves, our "tip jar"
was a Lays potato chip bag propped up by two ice cream
popsicle sticks.
OUR MEMBERS & TOP-OF-THE-LINE EQUIPMENT
I began the band with a large number of players...
something like 20+ members (we were into Earth, Wind
& Fire at the time and wanted a big Funk sound). Have
you ever heard of former NFL Dallas Cowboy Eugene
Lockhart? Well, I grew up with him and he began playing
trombone in my band. I later kicked him and another
band member out for wrestling after they broke our
manager's couch.
Two brothers played in my first band...Larry Whitting
(bass) and Doug Whitting (keyboard). Larry played an
awful looking hollowbox bass, and even though I was not
yet a bass player (I was playing trumpet at the time in the
high school band), I had to show Larry every single note
to every song. Because, not only was he completely
clueless regarding music, he was also tone deaf (or, was
it tone death?). Actually, both phrases applied to Larry.
Well, after about 999 times of showing him songs, I
became so frustrated, I decided to relieve Larry of his
bass-playing duties, and I took up playing the bass
myself. As we could not afford a professional bass, my
manager ordered one out of the Sears & Roebuck catalog.
Those S&R catalogs were so large, I am told that some
people actually went hunting with them during deer
season.
To use this book as a weapon and save wear and tear
on your rifle and save ammunition at the same time, all
you needed to do was climb a tree with it, remain quiet,
and await an unfortunate deer to arrive under your tree
then, (((((BAM))))). You dropped it on his head and took
him out. And, best of all, no bloody mess to clean up
out of the truck cab either.
I believe the new bass guitar, possibly, broke our
manager's bank account that week with its hefty $49.95
price tag (plus tax). Talk about splurging!
Oh, yeah...after breaking a couple of strings one night, I
played the bass for several weeks with only two strings
on it because we could not afford to buy a whole set. As
you can imagine, my hands/arms were doing double time
and, afterward, my forearms were so swollen, they would
have made Popeye jealous.
If you are a bass player, have you ever tried playing 4
notes' worth of music on only 2 strings all night? No, I
didn't think so, because you are smarter than that.
But, the positive side of that experience, is that when
people watched me doing it, they thought that I had
suddenly become a very fast-playing bass player in
record time, even though they didn't follow me home to
see me soak my painful arms in a tub of Epsom Salt
afterward.
"Wow! Kenny, you can play REALLY fast now! How did
you learn to do that so quickly? Can you show me?"
Uh, let me think about that for a minute...NO!
In fact, I have major arthritic pain in both my wrists as a
result of this.
Now, about Larry's brother, Doug. Lordy, mercy. Doug's
keyboard couldn't even be called a real keyboard. It
looked like some accordion that had been refused access
to the piano family reunion picnic. It was so small, that
Doug would sit it on his knees in his attempts to play it.
It was so small that a single finger, almost always, and
unintentionally, played two notes simultaneously.
It sounded worse than those cheap 1980s Casios...yeah,
you know the ones...those little white ones that, in order
to hear them, you not only needed to plug them into a
PA system, but you also needed to mic the keyboard so
the audience could actually hear your fingers tapping the
keyboard and validate that you were actually playing it
and that you weren't pulling a "Milli Vanilli."
Well, with our image to think of, this soon became too
much, and I asked Doug to join Larry in the
unemployment line, and also because he could never
seem to get those extremely difficult three-note major
chords down correctly. And I was terrified that asking
him to venture into the areas of Dominant 7th chords,
or worse, 9th or 11th inversions would prove to be an
impossibility and finally send him over the edge. We
were now sans a piano, but for the better. Come to
think of it, I don't believe the little keyboard could even
make 7th chords.
Our drummer, Reginald Smith, is one of my closest
friends to this day (known him since Kindergarten). But
let me tell you about his drum kit, or more accurately,
his "partial" drum kit. Actually, Reg couldn't afford the
entire kit, so he just had drums (and, sometimes, sticks).
The drum set that Reg played had no ride or crash
cymbals. But worst of all, it had a kick pedal that only
functioned part of the time...that is, when the adjustment
screw wasn't popping out, flying halfway across the room,
and almost putting out one of the other band members'
eye.
In fact, the kick pedal became so bad for repair, that
Reg finally decided to toss it entirely. But, whenever we
were on a good roll, he would, believe it or not folks, kick
the drum with his toe. I believe I even recall him doing a
fast double kick once when the spirit moved him to do
so in what would have normally been a double roll with a
real drum set. A positive side effect, however, was his
ability to quickly build his thigh and calf muscles, even
if there was the occasional "charlie horse" as a downside.
Our first gig was, literally, in a cow pasture, complete
with cows (only in Texas). To add insult to injury, we
were encased in chicken wire in case the audience got
ticked off at our playing for whatever reason, and decided
to kindly and collectively toss their beer bottles our way
so as not to litter the pasture. After all, you can't have
valuable cattle stepping on glass, can you?
However, the chicken wire encasement did not deter a
drunk toothless, snuff-dipping woman from reaching
through the wire, grabbing Cedric Reagans, our lead
singer, by his shirt collar when he got too close to the
fencing, then attempting to force her tongue down his
throat as he sang a rendition of Barry White's "Can't Get
Enough Of Your Love, Babe." Ooooh...just the sordid
memory of the scene still chills by bones 32 year later.
Our "PA System" (yeah, right). We also could not
afford a real PA system, let alone it being from a
professional quality line. So, we had what I still
consider an ingenious idea to this day. We decided to
take the drawers out of a bedroom dresser, then mount
a 15-inch speaker to its stationary brace.
Our manager then ran an electrical wire back to one of
the guitar amps. Lastly, we took a black cloth and
covered the entire dresser so that it appeared that we
were on the rise financially and could now afford some
serious new equipment. Our manager is the only human
being that I have ever seen hook up a sparkling electrical
wire without the hint of flinch.
Once when our manager was late for rehearsal, to get
rehearsal started, a couple of our foolish members
bravely tried to hook the naked electrical wires up as
they had seen our manager do, but were knocked across
the room by heavy voltage. No one ever tried that again.
As for our homemade PA system, no one was ever the
wiser, and several people said our sound improved. ;-(
Our lead singer would, on occasion, also forget the lyrics
to the songs. He would then look around at us for either
moral support, guidance, or telepathy (I never figured out
which he was seeking). In any event, we offered neither
and were of no consolation in his sudden plight.
During these wonderful special occasions, I would take
the liberty and opportunity of seeking out shelter via a
convenient part of the curtain to hide behind if we were
fortunate enough to be gracing a stage until Cedric's
Alzheimer's cleared up and he had returned to normal
and recalled the lyrics. If we were not onstage, as any
smart and fast-thinking ostrich does, I would simply
drop my head, stare at the floor, and pretend I was on a
battlefield in a distant part of Okinawa.
I cannot, in all honesty, talk about the other members
without revealing to you a personal foul-up of my own.
One of our gigs was playing for a high school FFA
(Future Farmers of America) meeting. Well, in my
excitement and haste, I forgot to tune my bass, and
when we started playing, it was obvious (to me) that
my bass was tuned a whole step high.
In denial, and not able to face my mistake of having not
tuned it beforehand, and being the only member in the
band who actually read music (and was well respected
for such), I staunchly informed the band that never in all
my life had I heard an entire band be out of tune, even
the drummer, on a song and that they really needed to
strongly consider getting some serious musical training
before it was too late.
The incredible thing is, they believed my lie, and to this
day I cannot bring myself to tell them the fault was
entirely my own. Actually, I dare not tell them now, as
people today are so short-tempered and quick to become
irate and upset without just cause.
Our manager, although good-hearted and well-meaning,
was almost as poor as we were. Johnny had a Chevy
that we used to take some of the band members home.
Actually, what the car was, was a smoking death-trap
that, fortunately, never killed any of us, although it very
much tried doing so. We did, however, suffer severe
whiplash on occasion, and here is how...
GOING HOME
As I said, after rehearsal we had to take some members
home, and the guitarist lived about 15 miles out in the
woods. There were 45-degree curves like nobody's
business, and the car's brakes were in such need of
repair that, when you engaged them, the car would jerk
at a 45-degree angle to the right.
Naturally, to prepare for and adjust to this experience
each time meant jerking the steering wheel back to the
left at a 90-degree angle as you simultaneously engaged
the brakes, just so the car would appear to remain
straight to any friendly, safety-minded, well-meaning
police officers hell-bent on issuing a moving violation
traffic citation.
Sometimes, however, we would forget that the car was
jerk-able and, hence, this is when we would experience
the nice soothing pain that only whiplash can bring.
After having dealt with this on more than a few occasions,
I was already well-trained by the time I entered the army
and drove a tank the first time. For maneuvering the
tank, compared to the 4-wheel mobile deathtrap, was a
cakewalk, and fellow soldiers marveled at how fast I
grasped the throttle concept, of which I have the
"Deathmobile" to thank for.
HOW YA FEELIN' NOW?
So, I'm betting that right about now, your financial
situation is starting to look a whole lot better to you,
isn't it?

An Unfortunate Situation, But A Reality

Prior to writing this article, I was already aware
that I am likely to lose a few subscribers
because of it. Because, most people's ego will
not allow them to withstand the truth. Yet, I
feel compelled to voice the statements
contained herein.
After a fulltime career as a musician and
recording artist, I have served the past eighteen
years as an international radio/video promoter
and media publicist, working with a myriad of
musician clients.
For the past eight years, I have published the
"B# Newsletter" that contains a number of
articles to help musicians, which have also been
published by other online and print publications
worldwide.
Yet, I am aware that more than a deserved
share of the content of my articles has fallen on
blind eyes, and in several areas below that I wish
to address.
More than a few musicians struggle daily in
wondering if they will ever attain success in
popularity as well as financially. And, the older
musicians become without the same degree of
corresponding success, the more fear tends to
set in that they may not reach their ideal level
of desired success.
As musicians age, and success is not forthcoming,
a certain acceptance sets in, although only in
part. Because, contained in the other part is a
slight disappointment, even bitterness at not
having achieved the desired goal. Almost
invariably, artists can directly point to several
poor choices that they may have made which
they failed to correct in a timely manner.
A lot has changed in the past eighteen years
that I have served as a promoter and publicist,
yet, and in contrast, a lot has not. As a veteran
marketer, not only in the Music industry, but
other industries as well, some areas come with
unchangeable common denominators.
Cover Photographs
You have probably heard the old worn-out axiom
that says, "A picture is worth a thousand words."
This is a fact. In several articles through the
years, I have addressed the issue of today's
artists doing what I refer to as "photo sessions."
By this phrase, I am referring to their lack of
creativity in putting their CD cover into matching
action with their CD title.
I'm not sure why this has changed from the time
that I was growing up in the 1970s when,
practically, most recording artists, regardless of
their genre, would create exciting and visually
arresting album covers.
For people born after 1990, album covers were
the grandfather of CD covers...without the glass
case. And, in dance nightclubs, if you look
closely, you may find deejays still using them.
Perhaps, the will to become artistically creative
in this area was lost in the reduction in size from
the album to the CD. I will say, however, that
this should not be so, because the CD cover is
still ample enough in size to create an attractive
action scene...some "story" within a photograph
that matches and synchs with your CD title.
Unfortunately, and again, most artists today
appear as mere props for the photography,
almost in apologetic form for making the
appearance. An example is a band's members
who are simply sitting on a park bench looking
at the camera, with a CD title that is as far from
the cover as the earth is from the sun.
And, since most acts, solo or groups, have
similar "inactive" covers today, I believe this
contributes to why music fans and music buyers
are not as excited about music as in the past,
because the cover doesn't get them excited
enough and whet their appetite to want to
learn more about the artist if they have never
heard the artist's music.
As an example of creativity, I invite you to
review album covers from the 1970 era for
creative ideas. One example was the R&B
group, The Ohio Players, that released an
album titled, "Fire." The album depicted a
partially naked woman wearing a fire hat and
a hose, with simmering smoke underneath.
As such, how many males, ranging from
teenage boys to old men dreaming of Viagra
before its time do you imagine still own this
album cover? Actually, this is rather tame by
today's standards, but it was a 5-alarmer back
then.

This same group released another album titled,
"Honey," that depicted a young lady eating a
spoon of honey from a sticky jar. Needless to
say, we cared not that the honey was actually
good for our health. I won't show this cover,
but either use your wildest imagination or
consult Google's "image" feature if you must see.
In another example, the R&B group, Brass
Construction's debut album backdrop was
a construction crane.

In short, I can remember how these 1970-
era album covers were major topics of
discussion when they were released. Ultimately,
the album covers were considered works of
art, and were opened and displayed on home
walls. In many instances, the album covers'
rear side expressed the album's front cover in
continuity.
Nightclubs
The mere idea today of nightclubs is enough to
make some musicians vomit. Live music today
has, in many instances, become the bane of the
independent musician's existence.
Pointedly, it began back in the late 1980s out in
Los Angeles with the insulting "pay to play"
situation that has now swept the United States.
Next, came further insult in that many nightclub
owners have now taken this a step further in
now requiring musicians who want to play their
venues either sell tickets to their shows or bring
their own guests! What?
Add to that, clubs have dramatically, and almost
eliminated their show promotion budgets, which
makes it a win-lose for the nightclub/musician,
respectively. I can only imagine that the only
reason performing musicians are still putting up
with this fiasco and not, at least, boycotting
nightclubs, is that they fear being banished from
the clubs in their area.
If they would, pardon the pun, band together,
and for only one week against clubs that make
their living on "live" music, they could put an
end to this mess. By not doing so, they,
otherwise, for lack of a more appropriate phrase,
remain "slaves" to the nightclubs.
MySpace
As some of you are aware, I lost my own
MySpace site a couple of months back.
Although MySpace never responded as to why,
I strongly suspect it was because I had become
an affiliate for a product that automated the
adding of friends. I still don't understand the
issue, since the software only sped up the
process, and did not capture any private
information.
In any event, that is "water under the bridge,"
so to speak. Yet, as I am in an informative
state, I wish to say that, since it is often
difficult to ascertain what is a violation of
MySpace's terms, particularly, issues not
covered in its formal terms, musicians are
potential victims in not having their own
websites or maintaining their personal sites, at
least, as "backups."
As a point, let's say you attained 40,000 friends
or fans on your MySpace site, then violated a
MySpace prime directive, of which as a result,
MySpace then killed your account. Let's also
say that you did not have your own personal
website.
How would you feel in losing those 40,000
friends/fans that may have taken you, at least,
a couple of years (or longer) to acquire? How
would you ever get them back? If you were to
then build your own website, how would you let
those same 40,000 friends/fans now know that
you have your own website? The answers are
that you would not and could not, and most (if
not all) of them would be gone forever.
On the other hand, if you had or maintained your
own website while you had your MySpace site,
and MySpace decided to close your doors, with
your having obviously maintained a link to your
personal site on your MySpace site, of which
your friends/fans would be aware, naturally, on
discovering your MySpace site was no longer
operational, they would visit your personal site,
and you would not "miss a beat," so to speak.
Fortunately, in the services that I provide, and
with having extensive time in the Music industry,
I was not solely reliant on the MySpace website
for my clients and losing the MySpace page did
not affect me.
In short, if you are a musician who is solely using
MySpace as your only site, and you are serious
about your music career and its ability to provide
you with ongoing recognition and income, you are
taking a serious risk with not having your own
website simultaneously. This is akin to rock
climbing...only without the benefit of a safety
harness.
Although I must admit that I have started to
see more artists get their own websites again (I
suspect it is due to their lack of trust, in part,
and some complaints by musicians of MySpace of
this very thing), it is simply amazing to me that
many artists do not seem to be thinking this
situation through and are allowing themselves to
be placed in a potentially major predicament.
Now, I've said all of that, to say this...
Many musicians, overall, have lost faith and
direction, not only in the Music industry itself,
but also in their pursuit of a professional music
career within a system that promised rewards
through its technological advancement and
accessibility, yet which has, in many cases,
become even more difficult to navigate through
its newfound and diversified technology.
And, a good deal of it, ironically, has to do with
there now being far too many ways to go, yet,
not enough time nor personal finance to travel
them all. Also, one bad trip can still spell both
disaster and demise, financially, for an
independent musician.

In my opinion, as with any business venture,
and as is the formation of bands (despite the
denial of some musicians) some ground rules
should be laid out and agreed upon/voted on by
all members in the group before proceeding
further. The most important aspect, obviously,
is the group's success, regardless of the gender
within.
There is no shortage of successful mixed gender
groups, and there is no reason to judge this new
act by an act in your past and assume that it
will not be successful.
Additionally, there are some incredibly talented
female artists, and would be unfortunate to allow
such an element that can be easily resolved by
addressing it now to, otherwise, sacrifice the
band's best success.
Also obvious, is that no one can dictate the
relationships of or between others. However, it
will go a long way to bring this potential
situation of concern to you out in the open and
discuss it upfront and beforehand, and have all
members agree upon a commonality.

broke up several months ago. All writers worked
and composed all songs together. Now, all
writers are in separate new bands and are using
several of the same songs for their new music
releases. Depending on the success of each

James, I'm not sure that I have ever
encountered this situation or heard of it, but
here is the best that I can do, in terms of a
response.
I believe that, as with the above situation, all
writers should consider creating some sort of
(written) agreement that allows all writers to
use the compositions in full. Because, if this (or
something similar) is not implemented, and I am
certainly not an attorney, but it is possible that
any of the other writers could have block use
of the material with his/her name attached to it.
Additionally, if one of the bands becomes very
successful while the other bands do not, a
writer in the less successful band(s) could also,
possibly, file suit that his/her name or
association was used without permission with
the successful band.
Now, in my opinion, this would be financially
senseless and abnormal, since the writer(s) in
the less successful band(s) would only stand to
gain financially since he/she is a writer, but with
jealousy/envy being what it is in human nature
and, particularly, within the music industry, far
stranger situations have occurred.
So, go with the agreement/contract scenario
with all writers beforehand. Because, you may
be very glad on several accounts in the future
that you did.

because wasted breath is something fools do, just
talking and interested in hearing their own bs. Now,
let's all go about our business,dismissing that nonsense,
and go ahead and discuss something worthwhile...

Journey/REO Speedwagon/Heart tour this summer to
see how they are holding up, but fear it is not well.

Grace Slick Is "Expert" On When Musicians Should Retire

If you are a musician over the age of 50,
and are still gracing stages to play your
music, particularly, if you are a celebrated
Rock star, former Rocker and lead singer
for Jefferson Airplane, Grace Slick, is of
the opinion that you look really stupid and
embarrassing.
This, from a woman who once leaped
offstage and proceeded to pick the nose
from a fan during a performance as well as
having exposed from stage that she was
panty-less during another performance.
In fact, Ms. Slick allegedly confessed in a
1998 VH1 documentary that "all rock 'n'
rollers over the age of 50 look stupid and
should retire."
Wow!
That statement is pretty hardline in its
nature, and it brought to my mind several
questions that, should I ever have the
opportunity, would ask Ms. Slick, such as:
* By whose or what authority does she
assess the age of 50 for rock star
retirement?
* With her having retired at age 48, why
didn't she do so at, say, age 45 or,
perhaps, age 40?
* What about the law of supply and
demand that says, if there is a product
or service (musicians in demand, despite
their ages), and a readily available
demand (fan base) for that product or
service, the twain should meet?
* To apply Ms. Slick's analogy to other
industries, should actors, doctors,
attorneys, and other professionals retire
at age 50 as well? If so, imagine the
incredible intellectual losses.
To be fair, and being 50 myself, I am,
personally, in agreement with Ms. Slick
(to a minimal degree) that certain acts
onstage are more acceptable by younger
artists and their fans but, again, that is
just my opinion.
And, since our industry specialization is
entertainment and, specifically, music,
again, it comes down to what the
market will bear and its law of "supply
and demand."
Right now, Ms. Slick has embarked on a
new career as a painter, and I am now
wondering if there is an age that
painters are expected to retire from their
profession as well.

Another Word To The Wise...
I am writing to let you know that my MySpace
site at http://www.myspace.com/jazzman795 is
now at the morgue being dressed for burial this
afternoon as I mourn its demise and ultimate
shutdown by the corporate sector of MySpace.
The only reason I can give, is that MySpace had
an issue with the "Friend Add" software notice
that I posted on yesterday.
So, although my intentions were well meant in
hoping to provide musicians with, yet, another
way to improve their results, obviously, it was
not a positive decision on my part nor well
accepted by MySpace.
So, in having said that, you may wish to NOT
take a "dis-advantage" of the software that I
mentioned.
I will be the first to admit, however, that it
is odd to me and I am dumbfounded as to how
many people, particularly independent musicians
and otherwise, are able to acquire such large
numbers of friends through the MySpace system
in what is, seemingly, record time *without*
the use of such automated software or similar
shutdowns.
If anyone has any helpful information for me
on how to significantly grow a MySpace
friends list *without* a shutdown, I am "all
ears," so to speak.
I am going to attempt to create another site
that will be an abbreviated culmination of the
previous one, as well as possibly erect another
music business site aside from MySpace.

Music Industry Q&A with Kenny Love (04-30-08)
"Kenny, what is your overall take on the state
of the Music industry and, particularly, major
labels and retail distributors?"

KL: T, here's my take on the state of the Music
industry...
I was saying to a couple of new clients just this
morning on how there has never been a better
time to be an independent musician, with the
incredible power and decisional control that
artists have today.
Alternatively, it was only a few short years ago
that the reverse was true, with many artists
leaving the Music industry as a result of undue
pressure from within it as well as what seemed
like a ceiling on their level of success.
The only question remaining now, and a very
important one, is if most (if not all) artists will
learn to both harness and execute the power
that they have now been granted through
technology.
As for major labels, I truly wish that I could
invoke the standard response and say that they
started out way back in the day with good
intentions, then went bad.
However, knowing what I know about their
history and how, even as they were fledgling as
small independents before becoming major label
giants back in the 1950s and 1960s by using
their recording artists as musical "slaves," alas,
I can defend very little (if any) of their
mechanics and operations.
And, their ongoing theft of artists' royalties
shrouded long and well in their idea of
"recoupment," while simultaneously insulting the
intelligence of music buyers through their
price-gouged recorded product for years
(anyone remember the $25 10-song CD?) as
well as their presenting lukewarm and lackluster
projects, simply adds more proverbial kerosene
to the proverbial fire.
And, much of the same applies to distributors.
At one point, and for quite some time at that
point, it was easier for an independent musician
to fly a small-engine aircraft successfully to
Mars (and back) on a single tank of fuel solo
than to get a distribution deal.

For anyone wishing to argue the above point,
please allow me to graciously inform you that
Mars is approximately 35 million miles from Earth,
and a small engine aircraft, such as the Cessna
Citation X, only holds 1400 pounds of fuel, with
a top speed of 703 miles per hour.
Now, when one takes the time (I, obviously,
have too much time on my hands) to divide the
35 million mile distance by 703 miles per hour,
the answer equates to the trip taking just
about 49786.6 hours, which translates to
2074.4 days, ultimately, translating to a total
of 5.6 years to reach Mars.
In the interest of getting the most out of the
plane's single tank of fuel, is why I have chosen
to delay my own trip to Mars until summer, and
I strongly suggest your doing the same.

And, for those few Indie artists unfortunate
enough to get a distribution deal on their own,
meant waiting for months, and almost a year in
some instances, in order to receive any profits
from distributors for sales of their recordings.
And, even when distributors would pay Indie
artists, they would, almost always, hold a
certain amount of royalty payments in "reserve"
with the excuse being (and, perhaps, valid in
some instances) for any anticipated retail
returns.
And, in most cases today, I believe that
distributors may even be in far deeper trouble
financially than major labels.
So, have the chickens now come home to roost
for the major labels and the distributors?
Well, not only have their chickens come home to
roost, but they have now been sound asleep for
several hours. And, to that end, not even their
rooster shall crow again at dawn.

Nightclubs have gotten out of control, with their
pay-to-play situations that began out in LA a
few years ago.
Now, as you have mentioned in your letter, a
couple of new bad things are happening and,
mainly, that some clubs are now forcing
musicians to either sell tickets or bring in a
certain number of people to clubs that they are
trying to work a show with. How can bands
overcome this?"

KL: Ms. Hobbs:
Ironically, I have recently changed my letter
that I send to prospective promotion and
publicity clients to reflect and address this at
the onset in an attempt to "even the odds" for
musicians caught in these vile situations that
you mention.
In addition, I might suggest something that I am
almost certain will never take place. And, should
it, indeed transpire, please have a team of
emergency medical technicians on hand and
standing by to briskly transport me to the
nearest medical facility as a heart attack victim.
And, that "something" is for bands in locations
where this is occurring to get together and
boycott such clubs. This will, almost assuredly,
work well if the club hosts a respectable amount
of (or mostly) independent local "live" music.
The first step would be to get bands together,
address the problem(s), with all agreeing to
implement this (hopeful) solution.
The second step would be for representatives
from each band approaching such club owners
or its management, and presenting and
discussing this problem and solution(s) with the
owners/managers.
Should owners/managers seem unwilling to
entertain such changes and solutions presented,
the third step (sigh) would be to inform these
owners/managers that, as a result, an organized
boycott by local bands would be implemented on
a certain date, which would be carried out for a
certain time period.
Even better, would be to get fans of local bands
who frequent the clubs involved and included as
well. This would "hit" clubs where they live and
breathe...in their wallets two-fold through both
a loss of "live" entertainment as well as a
dramatic reduction of profits from club patrons.
An even nicer touch, would be to contact your
local media to inform them that a boycott/strike
is taking place by both musicians and club
customers, which would serve to bring quite a
bit of heat and negative publicity on the club(s)
in question.
All of this is likely to get owners/managers to
re-think their current methods and be open for
more discussion. Again, this is most likely to
have success with "showcase" nightclubs that,
primarily, rely on "live" music to attract and
maintain their clientele.
In your negotiation attempt(s) in your first
meeting with club owners/managers, you may
even mention your, possibly, going to the media
to present your case and inform them of the
combined musician/club customer boycott, which
may serve to get exactly what you want without
further ado.

The Truth About "Guaranteed" Radio Airplay
As a radio/video promoter and media publicist, I
am often asked by prospective clients if their
airplay will be guaranteed and, if so, how long it
will last.
Another common question is, how long it takes
before radio stations respond.
I have provided responses below that I recently
gave to clients and I, sincerely, hope that my
responses enlighten many artists who are
confused on the processes and related issues on
how radio airplay and press coverage can go
(or, not go).

Jerry:
Please understand that, even though I have
what I feel to be a great track record with
getting radio airplay, video airplay, and print
media publicity for my clients for almost 20 years,
there is never and should never be a guarantee
of airplay or publicity implied by promoters or
publicists on any particular stations or print
media.
In fact, the ONLY way to "guarantee" airplay is
by paying for and running advertisements and
public service announcements on stations and in
newspapers, in reference to songs being aired or
reviewed.
However, in order to obtain and retain clients,
more than a few unscrupulous promoters and
publicists do make such ill will promises and
guarantees. And, unless they are running ads
or PSAs as I mentioned, this is an illegal act.
And, if they are discovered, they can be
indicted, fined, and/or sent to federal prison for
this crime, which is referred to in the Music
industry as "payola."
In fact, just a year or so ago, one of the largest
record labels was found guilty of doing just this
with one of the world's most famous singers, and
was fined millions of dollars.
In almost 20 years as a professional commercial
Music promoter, I have never resorted to,
participated in, nor endorsed this unlawful act.
And, no promoter can or should ever make such
a guarantee to a prospective client unless the
previously mentioned conditions of advertising
and public service announcements are what are
actually being conducted.
[---How "Guaranteed" Airplay/Publicity Works---]
I am going to pull the proverbial covers back now
and expose how this illegal process works...
Promoters and publicists who participate in
"payola" charge their clients astronomical fees
amounting to thousands of dollars per month.
However, with most musicians being unaware of
what constitutes fair rates for promotion and
publicity, they do not question the high rates of
the promoter or publicist, otherwise, believing
the rates are normal and fair.
Promoters and publicists who charge thousands
of dollars per month then take a portion of the
client's money and illegally "buy" airplay and
press coverage by paying radio station music
directors, programmers, deejays, influential arts
and entertainment magazines, and music
publications a certain amount of money per "spin"
for rotation and print media coverage in the
forms of artist interviews or music reviews.
These large fees are enough to cover the airplay
"buys" as well as put a decent amount of money
in the promoter's or publicist's pockets. And,
with enough clients at these high-end rates,
such a promoter or publicist can not only make a
good income, but with enough stations or press
being paid "under the table," so to speak for
airplay and press, the promoter becomes a
"savior" in the eyes of the unsuspecting client.
And, anyone who charges a far less rate (such
as ME!) is, occasionally, viewed with suspicion
by prospective clients, particularly, if the client
has researched several promoters or publicists
who have quoted similar high-end rates.
The sad fact is that the uninformed musician
being represented by the promoter or publicist
is completely unaware that he/she is, in fact,
"buying" airplay.
And, when the promoter also provides a report
verifying top stations are playing the client's
music, the client naturally believes the airplay
has been acquired as a result of his or her
popularity because the station personnel liked
the recording being presented, that music
listeners liked the recording and responded with
requests for more airplay, the magazine editor
or writer liked the music enough to feature or
review it, or all of the above.
The fact is, the client is, in part, being lied to
and tricked...not about the result, because the
report, airplay monitoring, and press coverage
readily serves as proof and verification that
media coverage was obtained.
But, the client is being lied to about the honest
interest (or lack, thereof) from radio station
personnel or print editors, along with the fact
that the client's own money "paid" for the airplay
or press coverage.
And, when the client's money runs out,
"coincidentally," so does the airplay or press
coverage. And, in this scenario, nothing could
be further from the truth, and this is a staunch
example of the phrase, "true lies."

make contact with stations, how long does it
take them to respond?"

Hi, Sara:
The honest answer to your question, is that
every project response is different. Truthfully, I
have seen radio station and print media editors
respond in as little as 30 minutes after my
initially contacting them. On the other hand, I
have seen media responses take, at least, a
week (if not longer) before any reaction was
forthcoming.
Many artists feel that, since promoters and
publicists have connections that they have
established through the years with the media,
that the promoter can guarantee that every
single media contact will connect with the
recording. But, this is not always so, because
other factors come into play as well, such as:
* Stations frequently change personnel, and
promoters must form new relationships with their
replacements
* Stations often change formats
* Regardless of the established long-term
relationship between promoters and media
personnel, the final decision lies with the media
contact, and is largely based on how that media
contact feels the recording fits their own current
criteria for their station or print media
* While promoters' media contacts may also like
the recording, the media contacts, almost
always, have supervisors who may not feel the
same way and, thus, may not approve the
recording for being added for airplay or press
coverage
Also, keep in mind that simply notifying radio
or video stations, or the print media of a
recording is only the first major step.
The second major step is following up and
tracking of the recording, which is what most
artists lack in either experience on how to do
so, or don't have the time to do with each
station or print media source, particularly, if the
artist is performing regularly and consistently.
And, the media also requires a "waiting period"
of, at least, 3-4 weeks after receiving press kits
before promoters or publicists are allowed to
follow-up with tracking to learn the status of
the recording.
As you can see, there is a lot more 'behind-the-
scene' decision-making and various levels to go
through in order to obtain the desired result of
airplay and/or media coverage.
