It's Stealing
By Brian Burns
A few days ago we received word that Southwest Wholesale, THE major
distributor for Texas Music, had closed its doors, ceased operations, and
filed for bankruptcy. The primary reason was Southwest´s largest purchasing
account Wherehouse Music
recently filed bankruptcy. Southwest Wholesale and Wherehouse Music are only
the latest in a long string of recent music industry casualties. The reason,
plain and simple: people are not buying music anymore - they’re stealing it.
Technology has made music piracy so convenient and easy that the music
industry is literally collapsing around us. I have heard all of the
arguments, pro and con, about "music sharing" -- burning CDs, downloading and
swapping MP3s, etc.
It’s stealing. Period.
I rarely play a show lately where someone doesn’t come up to me and casually
say, "hey, I burned copies of your CDs for some friends of mine - now they’re
crazy about your stuff." It’s the equivalent of saying, "hey, I went clothes
shopping the other day and I stole a couple of cool t-shirts for my buddies
while I was out - they loved 'em!" And I’m tired of hearing it, and I’m
tired of hearing the ludicrous arguments in favor of it, and I'm going to
start charging folks, on the spot, for music they’ve stolen from me. It's
stealing, folks. There is no gray area: it’s stealing.
The most common arguments:
"But it helps expose new listeners to your music." (Yeah, I’m talkin' to
you, Tailgunner.) That’s like saying you should be willing to work for free
to expose new employers to your services. The writing, recording, and
releasing of a music CD represents a monumental effort, a tremendous
investment of time, work, and money. Once released, the first few thousand
copies must be given away to radio, press, talent buyers, etc. So in the
end, unless the artist can sell a hundred thousand copies, there’s not much
return on the investment. If the artist has created enough of a market for
their music that people start stealing it, then the stealing is only hurting
the artist at that point. Honestly, I am not interested in having people
exposed to my music who are not willing to shell out fifteen measly bucks to
enjoy what I have spent years of hard work to create.
"But it only hurts the big, greedy record companies." It hurts the entire
music industry from the big, greedy record companies on down to the
small-time independent artists like me. Just look at the closing of
Southwest Wholesale. Not only are hundreds of Texas artists left without a
distribution chain for their music, but they have LOST the product (and
revenue) that’s already out there. This not only represents a devastating
loss of revenue for these artists, it also means you won’t be seeing their
CDs on store racks anymore.
"It helps shake out the weaker indy artists from the real stuff we want to
hear." Unless the real stuff you want to hear is Shania, Eminem, or standard
fare from the current Nashville dung heap, that’s wrong. The artists who had
distribution through Southwest Wholesale can’t fall back on glitzy videos
portraying them as space hookers, multi-million dollar techno-tours, TV
commercials, or other non-musical revenue streams. They are singers and
songwriters, and their craft is their trade - music - songs - live
performances - and very importantly, CD sales.
"But you should be able to rely on live performances for your income." Okay.
But if there’s no longer any incentive for me to write or record songs, then
what current Top-40 material should I compose my show of? Do you prefer a
series of Garth Brooks medleys, or should I learn a few hours worth of
"Skynyrd"?
None of these arguments work, but I hear them and others constantly from
otherwise good, honest, reasonable hard-working folks. It is amazing how a
man will look you in the eye and tell you the sky is not blue - if a blue sky
is not part of his agenda.
IT´S STEALING.
Obviously, I feel very strongly about this issue. If you love Texas Music,
support it - don’t give your favorite artists´ work away to your friends. If
you’re going to steal, at least make it worth the effort: steal Cooder Graw´s
tour bus or something worthwhile. Handing a friend a burned copy of the
latest Davin James CD is like saying, "here, Leonard, I like you enough to
screw Davin James out of fifteen bucks, but not enough to spend fifteen bucks
on YOU." ;-) If you’ve come onto an illegal copy and you like the music,
go
out and buy a real copy: it’s only fifteen bucks! If you’ve burned a copy
for a friend, ask that friend if she likes the CD. If she does, bring her a
real copy and have her pay you for it.
And if you really want to get involved, report criminal web sites such as
www.txrebel.com
and
www.audiogalaxy.com
www.kazaa.com
to the FBI. Scream - loud as you can!

Ande, I would like to thank you for the work that you are doing and the
service you provide getting people together. My name is Mike Allen I am a
singer looking for songs. I emailed you the first time in Dec letting you
know that I was looking for original country songs for a project I'm doing.
The response from your listeners has been fantastic and I have received some
excellent material. I have four songs that have made a great start.
However, I am still looking for more country songs. I am trying to put
together songs that tell a story of the old west. Some people call them
cowboy songs. So If anyone out there has some cowboy story songs I would
love to hear them. I am hoping to have a demo CD done by the end of May so
that I can pitch it to a producer in June when I head to Nashville.

created by myself, and Robert Allred) are about to release a new 8 song cd
made up entirely of our own original NASCAR related songs. They've all been
recorded in Nashville at The Gator Hole, and County-Q. We have already
received airplay on several large market stations around the country, and
we're about to make a deal to be featured on a nationally syndicated NASCAR
radio show - The O'Reilly Auto Parts Racing Report featuring Mark Merrell and
Steve Parker. We are hoping to get our first shipment of cds by March 20th,

I was very excited when i read my IFS email today,
like many new song writers/lyricist i had written quiet a number of
of great songs and just sit on them,
i have written two patriotic songs and made demo of them which
sounded pretty good, i know in the feature they will become #1hit song
my biggest obstacle is that i only write lyrics and not music.
i write country, gospel, and pop music. i am looking for melody writers

Max Nofziger. Since Max is the ONLY Austin council person to EVER work
hard to recognize and nurture Austin music, it seems that Austin

As you may have heard by now, I am running for mayor. I want to thank
you for your support in the past, and I hope you will continue to
support me through this election. I want to be your mayor and serve you.
I have twenty-five years of experience as a public servant and activist
and nine years of City Council experience. My support of Austin music
began in 1974 when I moved here and recognized that Austin has a unique
asset in its live music scene.
I am proud of my record of supporting the Austin music industry. I was
the first local elected official to recognize the importance of the
music industry to Austin. During my tenure as a City Council member, I
accomplished the following:

Created a City Staff Liaison Position to the Music Industry

such establishments as the Austin Rehearsal Complex and Rock and Roll
Rental on South Congress.)
The music industry is vital to Austin. As mayor, I will work to make
Austin an affordable place to live again. I will also support the Austin
Music Network (AMN). My plan is to wean AMN from the City General Fund
and move it to a stable financial base. AMN has the potential to be a
global network through the marriage of technology and cable television.
Because of the potential of AMN, the world can discover Austin music.

The 15th Annual ASCAP Film Scoring Workshop 2003

ASCAP offers a “one-of-a-kind” experience to aspiring film and television
composers. Participants will have an opportunity to record their original
composition with an “A list” of Hollywood professionals, including a
40-piece orchestra consisting of Hollywood’s best session musicians on a
major studio film scoring stage, a legendary scoring mixer and professional
composers acting as coaches and mentors. In addition, there are “From the
Horse’s Mouth” sessions with studio executives, agents, attorneys and music
supervisors. The workshop is intended for composers who are pursuing film &
television music as a career. It is not for hobbyists nor is it for
professionals who are currently making a living as film and television
composers. The workshop will be held during a four-week period from the 2nd
week of July through the 1st week of August. Submissions will not be returned
and chosen participants will be notified in early May. There is NO fee or
charge to participate in the workshop; however, chosen participants will be
responsible for their own transportation, housing and all other living
expenses. The workshop is open to all composers regardless of their current
performing rights affiliation.Workshop requirements and how to apply:
Must submit a CD only, containing a maximum of 15 minutes of music which
demonstrates his/her ability to write for orchestra with a dramatic
sensitivity to picture. Participants may not use “ghost” writers or
orchestrators.
Submissions must also include a bio/resume/credits and information regarding
past education and/or experience. We will not review any videos, DAT's,
cassettes or other audio/visual materials; however, on occasion, further
materials such as a score may be requested.

Mr. Rasmussen,
First of all, let me say what a blessing you and your newsletter are to
my songwriting...I am a core member of the Mobile Songwriters under George
Rohm here in AL and he told me about your columns and Ive not been the same
since. I will be in Austin TX in mid-March and would love to meet you and
perhaps attend one of your meetings...I am a BMI writer signed to GodsChild
Records in Nashville and I travel full time singing and playing...I'll be 41
on Feb 21st and am living my dreams. Three years ago, I weighed 300+ pounds
and within 3 weeks my wife of 10 yrs walked out on me and my kids and then
the job that I had shut my Dept leaving my world upside down. Writing truly
picked me up, dusted me off and literally saved my life....Now, 105 pounds
smaller, I am travelling, singing and writing (started playing guitar at age
9, and I never thought life would be this good!) Thank you for all your
inspiring words and thoughtful insight to writing...it HAS made a difference
in my life. Just wanted to drop you a note of thanks, and I hope to meet you
soon!
