Trial For Murdered Teen Convicts Two, Hung Jury on Third Defendant

 

HAYWARD CA — The second trial for the murder of a transgendered teen, Gwen Araujo, concluded with two of the three defendants being convicted of second-degree murder.  Unfortunately, the jury deadlocked 9-3 on the third defendant’s conviction and was unable to render a verdict for Jason Cazares.

 

Deputy District Attorney Chris Lamiero tried all three defendants for first-degree murder with a hate crime enhancement, both of which the jury rejected.  The jury did agree that both Michael Magidson and Jose Merel were guilty of second-degree murder.  There was some measure of happiness and relief from the family and the transgender community that two of the three were convicted, but it was “less than a full carriage of justice,” according to Vanessa Edwards Foster, chair of the National Transgender Advocacy Coalition (NTAC). 

 

The jury did reject the "transgender panic" defense brought forth by Michael Magidson's lawyer, Michael Thorman.  They also refused to believe that Jose Merel only "skipped" a heavy pan off of Gwen Araujo's head, causing no serious harm.  However, they did buy into other diversionary testimony, such as their contention they feared for their lives due to Araujo allegedly threatening “retribution” from friends in a gang, which one family member termed “BS”.

 

Araujo was born a boy named Edward but identified and lived as female. The defendants, who knew her as Lida, met her and invited her to a party in the summer of 2002.  Attracted to the vivacious teen, Magidson and Merel had sexual experiences with her. 

 

The issue boiled over in the early hours of Oct. 4, 2002, in a confrontation at Merel's house that fueled suspicions about Araujo's gender.  After a six hour beating and strangulation, they buried her body in a shallow grave in a state park over 100 miles away.

 

The lack of hate crime enhancements disappointed many who followed the trial.  “This was surprising to many, because it was the discovery of being transgender that led to the killing that night,” said local activist Shelly Prevost, who’s filming a documentary on the Araujo murder and the trial.

 

Others were more pointed in their reaction to the hate crimes dismissal.  “How blatantly does one have to despise someone, how much overkill must be meted out in a violent act before someone is convicted of a hate crime?” asked Foster of NTAC.  “This again underscores the need for specific and explicit hate crimes protection language,” she added.  “We keep getting ‘finessed’ out of legislative language and ‘dismissed’ from obtaining convictions for bias-driven violence.  This is beyond frustrating!”

 

“To hear the hate crime enhancement being rejected was a hate crime in itself,” fumed Araujo’s aunt, Imelda Guerrero.  “It was a black-and-white, classic hate crime,” she added, noting the family “really do not understand why the jury rejected it, but do feel that it was unjust!”

 

The hung jury on Jason Cazares’ charges stunned many.  “It was surreal, I still can't believe it.  I feel numb,” said Imelda Guerrero upon hearing the lack of verdict on Cazares.  “I am furious but do not know what to do with it, or where to direct it.  What makes me the most furious,” Guerrero added, “is knowing that three jurors were not convinced beyond a reasonable doubt that Jason Cazares was guilty.”

 

Foster of NTAC opined that the lack of conviction on Cazares was a “testament to Tony Serra’s lawyering skills, not an exoneration based upon innocence.  There is no way that Jason Cazares is an innocent party in all of this.  Justice has not been served, and this family has to go through a third trial.”  Serra, the defense attorney for Cazares will not be able to represent his client for a third trial, having legal problems and incarceration of his own coming up at the end of the year.

 

However, even without the hate crimes and Cazares convictions there was optimism. “Nothing is going to bring Gwen back,” said Araujo’s mother Sylvia Guerrero in a press conference following the trial. “But this is at least a step toward closure.”

 

“We have made some progress, we have two murder convictions,” Imelda Guerrero said. “And that means that Gwen’s life meant something!  We have a lot of educating to do, and we will not let up!”  She added that, “we are going to continue in our efforts to do whatever we can to try to make sure that this happens to no other trans person anywhere in this world.

 

“For the trans community, keep the faith, your lives will not go on unnoticed, and you deserve to be treated with respect and dignity.”

NTAC Prepares For Its Third Lobbying Foray

 

Transgender activists from all over America will make their way to Capitol Hill, May 19-20, 2005 for the National Transgender Advocacy Coalition’s (NTAC) third biannual Lobby Days. The primary objective is to push Congress for passage of inclusive hate crimes prevention and employment equality legislation.  As with last year, NTAC will be taking to Capitol Hill along with GenderPAC, and immediately before the Transgender Veterans March to the Memorial Wall sponsored by the Transgendered American Veterans’ Association (TAVA).

 

NTAC Lobby Days 2005 also comes on the eve of the debut of “Citizen Lobbyist.”  The documentary, shot last year by filmmaker Timothy Watts, followed NTAC lobbyists preparing for lobbying, and making visits with lawmakers in Congress.  The film will make its public debut on May 21 at the Inside Out Gay & Lesbian Film Festival in Toronto.

 

Ethan St. Pierre, vice chair of NTAC’s Lobbying Committee has received commitment by the filmmaker to an advance copy of the film to be sneak-previewed during this year’s lobbying event. 

 

Before visiting Congressional offices, NTAC will hold a plenary session on May 18 at the Marvin Center of George Washington University. 

 

“Citizen Lobbyists from across the country will once again visit members of Congress to argue for transgender inclusion in federal legislation,” said NTAC Lobbying Committee Chair, Marisa Richmond.  “The focus is the Employment Non Discrimination Act (ENDA) and the Local Law Enforcement Enhancement Act (LLEEA),” Richmond reported, adding, “the Transgender community continues to face tremendous job discrimination regardless of race, class, or ability, and federal legislation to end this practice is overdue. 

 

It is essential to have demonstrably significant numbers of concerned community activists and supporters working together to educate their elected representatives on these vital issues.  The need has never been greater.

 

Richmond pointed out that “Transgender persons are often the victims of some of the most brutal hate crimes in the nation.  We feel that it is time the federal government stepped up to help end it.”

 

Your participation can make a difference, for yourself, your family, and your community. Join other transgender, intersex and gender activists, as well as family, friends, and supporters in pushing for a truly equal America for all citizens. Inaction will not solve the problem of our disparities.  Continued action is the path to equality.

Ararat, Sunday, April 24th from 2:00pm to 6:00pm.

Many of you know about Terri and her ongoing battle with ovarian
cancer.  She's had another surgery over the new year and is on
another round of chemo.  This is getting just a little ridiculous and
expensive, so we're hoping y'all will come help out and have fun.

Softball Austin, Central Texas new GLBT league, is recruiting new players for the upcoming Spring season.
All skill levels are needed, regardless of whether youve played softball all your life or youve never picked up a glove.
All you need is the desire to play ball!

Softball Austin is hosting a recruitment drive on Field #5, Sunday, March 13, at 3 p.m. at the Krieg Softball Complex, located at 517 S. Pleasant Valley Road.

You can either join a team or form your own. The player registration fee is $20. Team registration is $350 and most teams have sponsors that cover the fee.  The season will last 8-10 weeks.

Softball Austin plays on Sunday afternoons between 1-4 p.m. The season begins April 3.

things and we want you to show them off at Ladyfest. We are

Film and Video- Deadline April 18th Please submit on VHS or DVD

Spoken Word- Deadline March 26th Please send 2 writing samples and

a new website to bookmark to keep themselves updated on the latest
indie music and progressive political issues:
www.girlstownproductions.com.  The website contains  album & live
show reviews, an event calendar, an advice column, weblogs,
political news, and features on bands and nonprofit
organizations that focus on the Austin community and beyond.  The
first "issue" will feature reviews of new albums by Ms. Led, Smoosh,
and Manda & The Marbles among others, and exclusive interviews with
new-wavers and Sub Pop recording artists Frausdots and Executive
Director of NARAL Pro-Choice Texas Kae McLaughlin.

www.girlstownproductions.com is the brainchild of Anna Giuliani and
Kimberly Francis, DIY gals, feminists and long-time music lovers.
Their decision to create a site that combines music and activism
grew out of their past involvement with art, music and film festival
Ladyfest Texas. The name for the site was inspired by one of
Francis' favorite movies, Girlstown (dir. Jim McKay, 1996).  It also
seemed to fit with the Ladyfest-based philosophy of presenting an
alternative to the typical "boystown" of indie rock and punk rock.

"Music is a natural conduit for activism.  It draws people together
and is an ideal forum for personal and political expression,"
explains Giuliani. "Plus, you get to rock and drink beer!"  Francis
adds, "We wanted to continue to work towards some of the goals we
set out to accomplish with Ladyfest, such as supporting a community
of artists and musicians that don't always get the press that they
deserve.  We hope Girlstown will be a central location where people
can read about independent music, progressive politics, and how to
get involved with what's happening in Austin."

The Launch Party for Girlstown Productions will take place on
Thursday, March 10th from 7-10pm at Church of The Friendly Ghost.
Local Austin pop wunderkinds What Made Milwaukee Famous will play

Giuliani has written for the St. Louis Riverfront Times, Austin-

i just wanted to let you know that a Ladyfest will take place in
Monterrey, N.L., Mxico on february 12 & 13.
There's gonna be local bands from Monterrey and were stlil not sure
if there's gonna be other bands from mexico, we invited a band from
Austin SIGNAL LOST, but they are not confirmed yet. Invitation is
open for bands, photographers, performers, artists in general. At
this time we know there will be a crafts bazaar and a workshop on
sexuality.And info tables from M.U.S.A.S., among others.

2004: A Retrospective
 
Borrowing from the famous Charles Dickens Tale of Two Cities opening, It was the best of times; it was the worst of times."  It was the year two thousand and four.
 
We might not be living the Tale of Two Cities history of the French Revolution and its excesses of righteous iniquity.  Madame LeFarge may not be knitting while Madame La Guillotine beheads those whose politics are suspect, but we may not be far from it.
 
Not all was bad in 2004:  
The number of jurisdictions with transgender-inclusive nondiscrimination laws grew from 68 to 74.  Lexington, KY renewed its inclusive ordinance at years end despite vigorous opposition based on the concerns of some citizens that the seven-year old ordinance would lead to moral decay.  Transgender-inclusive legislation now protects 25% of the nations residents.
 
The Human Rights Campaign decided to support only a transgender-inclusive Employment Nondiscrimination Act (ENDA) in the next session of Congress. 
 
Britain enacted a gender recognition law that recognizes transsexuals in their new genders, including the right to marry.  This effectively put an end to the infamous Corbett vs. Corbett case law used in the USA to deny recognition of transsexual marriage. 
 
Seven transgendered delegates were elected to the Democratic National Convention.  Through meetings with Democratic National Committee staff, participation within the GLBT Caucus, Convention events, and visibility within their state delegations, these seven placed a human face on the transgender community. 
 
A major US insurance company, Aetna, announced that companies could include sex reassignment surgery as a covered benefit in the health insurance policies offered their workers.  No reports yet of which companies may have signed up for this coverage. 
 
An IRS Appeals Officer ruled that gender reassignment surgery is medically necessary and an integral part of a professionally prescribed course of treatment for a diagnosed condition, thereby allowing tax deduction for GRS.  Predictably, the Traditional Values Coalition has urged IRS Commissioner Mark Everson to reverse the ruling stating that, "The IRS should not allow itself to become a pawn in the hands of the homosexual/transgender movement."
 
The Sixth Circuit Federal Court of Appeals ruled that Title VII of the 1964 Civil Rights Act covers transgender people, lesbians and gays.
On the other hand, not all was good in 2004:
ENDA went nowhere in Congress with or without transgender inclusion. 
 
Despite Senate passage and favorable House Motion to Instruct, a Congressional Conference Committee killed the Hate Crimes amendment. 
 
A Florida Appeals Court ruled that transsexuals cannot marry in their new gender.  The ruling reversed the well supported lower court ruling that Michael Kantaris is male and that his marriage had been legal. 
 
The United States Citizenship and Immigration Services (CIS) issued immigration law policy stating that CIS shall not recognize the marriage, or intended marriage, between two individuals where one or both of the parties claim to have changed their sex.  Jiffy Javellana, Philippine husband of Donita Ganzon, has filed suit in Federal Court to overturn the CIS decision to refuse his application for permanent residency and to revoke his work permit.  The CIS considers that Donita, a postop transsexual of 24 years, is still a man and that the marriage is, therefore, invalid.  CIS officials invoked the 1996 Defense of Marriage Act, which defined marriage as between a man and a woman but without a scientific definition of man and woman.
 
The Religious Right has been emboldened by George Bushs slim margin of victory and claims a mandate to reshape the morals of America to reflect Old Testament views.  The bad news is that intolerance and bigotry have found their way into a number of state constitutions and new efforts are promised to deny rights to GLBT families.  The good news is that grassroots efforts on behalf of the GLBT community by fair-minded people have already increased at state and local levels.  
 
A school district in Texas canceled its decades-old tradition of a day in which boys could dress like girls and vice versa.  A few parents protested on the basis that that one day a year could cause boys to become cross-dressers and then gay.  Hysteria reigns.
 
The pace of transgender murders continued unabated with 21 reported murders in 2004, the latest a transgender prostitute murdered in Hollywood by an off-duty Marine MP on December 27th.  Following a high speed chase, the Marine was killed by police officers when he pointed a pistol at them. 
 
The trial of the admitted killers off Gwen Araujo, 17 year old transsexual who was brutally murdered in 2003, ended in a mistrial when the jury couldnt reach agreement between murder and manslaughter.  The prosecution will retry the men next spring.
What was made eminently clear in 2004 is that much remains to be done to reach the NTAC goal of establishing and maintaining the right of all transgendered, intersexed, and gender-variant people to live and work without fear of violence or discrimination.  This need must translate to increased cooperation among all civil right organizations, cooperation that NTAC pledges to support.
 
Also made clear is the need for work by transgender people at the grassroots in offices, churches, stores, restaurants, state legislatures, local government as well as at the national level to attain the moral result of equality for all.
 
What will you do to help reach our goal of transgender equality?  Whether through Lobby Days in May, through contributions, through local ordinance development, letters to the editor, water cooler talk, or coming out to family and friends, NTAC needs you to help win the challenges of 2005.
 
What will we write in December 2005?  Your efforts can help make it a better retrospective.

Last Friday, the State Board of Education (SBOE) approved new health
textbooks for public school students.

Due in large part to action by supporters like you, a chart detailing
some contraceptive methods, failure rates and their ability to
protect against sexually transmitted diseases (STDs) was included in
three of the teachers editions of the books.  Unfortunately, the
publishers did not add this potentially life-saving information to
the student editions of the books.  Without direct access to this
information, most Texas teens won't learn about anything other than
abstinence.  The new textbooks will be used in Texas schools for the
next ten years.

The high school textbooks were approved by a 13-1 vote.  The
lone "nay" vote was by State Board of Education member Mavis Knight
(D-Dallas).

During one of the final hearings, SBOE member Terri Leo (R-Spring)
insisted at the last minute that publishers make misleading and
outright erroneous revisions to textbook discussions about marriage,
relationships and homosexuality. Among the changes she demanded to
the textbooks:

Add to Teacher's Editions: "Opinions vary on why homosexuals,
lesbians, and bisexuals as a group are more prone to self-destructive
behaviors like depression, illegal drug use, and suicide."

Add to Teacher's Editions: "If you discuss homosexuality in class, be
aware that Texas law rejects homosexual 'marriage.' Students can
therefore maintain that homosexuality and heterosexuality are not
moral equivalents, without being charged with 'hate speech.'"
Ultimately, the publishers refused to make these last-minute
changes.  However, language defining marriage as "a lifelong union
between a husband and a wife" was added to some of the middle-school
health textbooks.
