Administration Targets Federal Employees, Removes Protections for Sexual Orientation

Recently, one of Scott Bloch's first acts as newly appointed Special Counsel to the White House was to instill fear in 'homosexual' employees of the federal government.  In an increasingly common curtailment of individual rights, the Bush Administration has removed decades-long protections from employment discrimination against those who serve our nation. 

Bloch's expressed rationale for removing protections for gays and lesbians is that "sexual orientation isn't protected from discrimination or hate crimes by current civil rights laws."  Presumably, crossdressers, transsexuals and intersex government employees are also at risk since gender-identity and expression have never been explicitly covered. 

Not satisfied with continuing "Don't Ask, Don't Tell" discrimination in the nation's armed forces, Mr. Bush and his Special Counsel have decided that GLBT federal civilian employees have no recourse if fired simply for their sexual orientation. 

The Office of Special Counsel (OSC) website includes 12 practices prohibited in accordance with the Civil Service Reform Act (CSRA) of 1978.  Among these prohibitions is discrimination based on personal conduct that is not adverse to the on-the-job performance of an employee, applicant, or others.  The OSC and the Office of Personnel Management (OPM) long interpreted this to include sexual orientation. 

In a statement issued March 31, House Minority Leader Nancy Pelosi (D-CA) issued a statement blasting Bloch. "The actions of Special Counsel Scott Bloch are not only needlessly divisive, they are simply wrong as a matter of law."  She added, "Mr. Bloch's willingness to tolerate discrimination on the basis of sexual orientation is contrary to federal law, which has long been held by the Office of Special Counsel during Administrations of both political parties."

In 1998, President Clinton codified this interpretation by amending Executive Order 11478 - Section 1 to state in part, "It is the policy of the Government of the United States to provide equal opportunity in Federal employment for all persons to prohibit discrimination in employment because of race, color, religion, sex, national origin, handicap, age, or sexual orientation through a continuing affirmative program in each executive department and agency." [Emphasis added.]

Not so, says the new Special Counsel, former Deputy Director of the Justice Department's Task Force for Faith-based and Community Initiatives.   In a recent interview with the Federal Times, a publication for federal managers, Bloch indicated that one's conduct as a homosexual is protected but that one's sexual orientation itself is not. 

"People confuse conduct and sexual orientation as the same thing, and I don't think they are," Bloch told the Times.  In interpreting the CSRA, "Someone may have jumped to the conclusion that conduct equals sexual orientation, but they are essentially very different. One is a class ... and one is behavior," he explained.

"In other words, Men having Sex with Men (MSM) cannot be discriminated against," commented Vanessa Edwards Foster, chair of the National Transgender Advocacy Coalition (NTAC), "but identifying as gay will get you fired.  How odd."

Bloch also inferred in the article that the recent interpretation could be up for further review at a later time.

"This is more bizarre than the military's discriminatory 'Don't Ask, Don't Tell' policy against gays and transgenders," said Robyn Walters, Secretary of the.  "Apparently gays and lesbian federal employees can't be fired for participating in homosexual acts or gay rights meetings, but they can be fired just for being homosexual. 

"Such ludicrous decisions result when 'compassionate conservatism' mixes with the influence of radical Christian political groups and their campaign contributions," added Walters

The recent official move by the OSC, as well as a deterioration of workplace decorum has many transsexual employees, both pre-transition and especially post-transitioned, on edge. According to a transgendered law enforcement officer who wished to remain unnamed, "they are afraid that this President is going to set the stage for witch hunts and they feel ripe for targeting, especially the Federal [employees]." 

There are transsexual employees who have transitioned or would like to transition on their jobs in numerous federal agencies, including the FBI and the Dept. of Justice. The source added, "We have several feds" in a loosely-based group of transgenders in law enforcement, "and they all express concern over this."

This newest blow to GLBT human rights reinforces NTAC resolve to press the GLBT community and federal, state and local legislators to enact transgender-inclusive employment nondiscrimination, both in government employment and federally as well.

"It is unacceptable to use an ideological or political agenda to subvert years of settled interpretation of federal personnel policies and statutes," Rep. Pelosi stated on the OSC change.  "Once again, this Administration has sought to divide the American people for political purposes."

But we, and almost all other nonprofit advocacy groups, are facing the unimaginable because of proposed rules being considered in April by the Federal Election Commission.

The FEC - an appointed body of three Democrats and three Republicans - is considering new rules that would muzzle virtually all nonprofit advocacy groups, right in the middle of this critical election year. These over-reaching, unjustified rules would severely limit, if not outright prohibit, People For and other nonprofits from engaging in advocacy activities that are vital to our democracy, such as registering voters in the months before a federal election or informing voters of federal officials' policy positions and the potential impact of those positions.

Transgenders, Families Gear Up to Lobby on Capitol Hill

Transgender activists from all over America will converge on Capitol Hill, April 29-30 to lobby Congress for transgender inclusion in, and passage of hate crimes and employment rights legislation. Lobby Days 2004 is sponsored by the National Transgender Advocacy Coalition (NTAC), the country's largest and most active organization advocating for the rights of transgender Americans at federal, state, and local levels.

Among those in attendance will be victims of anti-transgender hate crimes and family members of those who have been victims. Attendees include Sylvia and Imelda Guerrero, mother and aunt of murdered Newark, California teenager Gwen Araujo; Queen Washington, the mother of teenaged Stephanie Thomas who, along with her friend Ukea Davis, was cut down in a hail of gunfire at a stop-sign in Washington DC; and Ethan St. Pierre, host of the internet community radio show TransFM and nephew of Boston-area transwoman Debra Forte, who fell victim to a hate-inspired murder in 1995.

Before visiting Congressional offices on the 29th and 30th, NTAC will hold a plenary session at the University of Maryland's Annapolis Hall, in the southeast quadrant of the main campus. Just a short walk from the hotel, the plenary on Apri 28th will consist of a brief lobbyist training session and assignments for the following days. Participants will have the opportunity to meet and interact with many trans and trans-supportive activists and representatives from organizations working toward fully inclusive federal hate crimes and civil rights protections and to participate in other Lobby Days events and actions to be announced.

music and arts festival will be showing two films -- Don't Need You
(Kerri Koch, 2001) and D.I.Y. Or Die: How To Survive as an
Independent Artist (Michael W. Dean, 2002) -- on Thursday, April 22
and Friday, April 23rd at non-profit cultural center/coffeehouse
Ventana Del Soul (1834 East Oltorf). The show begins at 7:30pm on
both nights. Proceeds from the benefit will help fund Ladyfest Texas
2004, with a portion going to the Austin Humane Society as part of
Michael Dean's "Rock for Cats" program.

Directed by Kerri Koch, Don't Need You follows the movers and shakers
of the Riot Grrrl scene and the groundbreaking events of this
movement from its inception in 1990 to the creation of the first
Ladyfest in 2000.  The film includes archival footage of bands such

D.I.Y. Or Die: How To Survive as an Independent Artist is a
celebration of the underdog! This fast-paced, quirky film from
Michael Dean features interviews with artists who have embraced
the "do it yourself" philosophy: Lydia Lunch, Ian MacKaye (Fugazi), J
Mascis (Dinosaur Jr.), Jim Rose (Jim Rose Sideshow), J.G.Thirlwell

Hi yall,

I wanted to let you all know about an opportunity
for you and your groups to take action
against the Central America Free Trade Agreement,
otherwise known as CAFTA, which President Bush
has declared he intends to sign into law and on
which he has given the Congress 90 days to
formulate their opinions before they must vote up
or down on the agreement.  I think that we have a
very good chance of stopping this agreement from
being forced upon the struggling, impoverished
nations of Central America, but only if we get
organized and take action immediately.  Rep.
Doggett has expressed that he has serious
reservations about CAFTA but has not issued a
final, conclusive statement about which way he
intends to vote. We have a chance in Austin to
stop this agreement from happening if we can
convince Rep. Doggett to vote NO!

CAFTA  (www.citizenstrade.org/caftaactionkit.php)
is a very dangerous agreement, especially for
women. This is very much a feminist's issue, if
for no other reason than women worldwide are far
more impacted by poverty than men.  CAFTA expands
the
provisions of NAFTA to five nations in Central
America plus the Dominican Republic, and if
passed it will be considered a green-light to
further expansion of these trade agreements under
the Free Trade of the Americas Agreement.  CAFTA
is dangerous for working people, especially
working women, here and in
Central America, as it contains no real
protection of labor rights and will encourage the
"race to the bottom" in wages as companies will
continue to move production from the US to
countries, such as El Salvador and Honduras,
where they can pay much lower wages and provide
no benefits. Most of the workers in these
"multinational" factories are women, who are
hired because they can be paid less and are
considered more "docile" and less likely to form
a union. It could also force Central
Americans, and even the US and Canadian,
governments to have to compete with private
corporations to provide basic public services,
thereby destroying health and educational
services upon which many of poor and working
women in our hemisphere depend.  Small farmers in
both the US
and Central America will be forced to compete
with cheap produce that will have to be allowed
into their markets under CAFTA.  This provision
was an especially harmful part of NAFTA and
resulted in hundreds of thousands of Mexican
farmers losing their livelihoods as a result of
being forced to compete with cheap, subsidized,
factory-farmed corn from the US.

Lastly, this agreement is an afront to human
dignity and worth because it not only completely
denies any protection for the poor and the
working people, but it prohibits government from
trying to protect the poor in their own
countries.  CAFTA is a gift to rich and powerful
corporations who cannot wait to increase their
profit margins by denying workers a fair wage and
farmers a fair price in Central America.  It
isn't fair, and it could result in millions of
people being driven into even greater poverty and
debt.  We have to stop it now!

That's where you come in:

I, and others who are organizing to stop CAFTA,
are willing and able to come to your groups, at a
meeting or at a group event, to
speak about this issue and and let you know what
you can do now to stop CAFTA.  Such
presentations are available in Spanish and in
English.  If you are educated about CAFTA
yourself, please let your group know about this
issue and encourage them to write to Rep.
Doggett. I can provide you with any materials you
need.

If that is not a possibility, I can also leave
flyers explaining CAFTA
along with letter-writing materials so people
could express their opposition to CAFTA to Rep.
Doggett.  I and others would pick these letters
up and deliver them, so your group members would
not
have to mail the letter themselves.  These
materials are also available in Spanish and
English.

Thank you for your time.  I hope we can work
together to take action to stop CAFTA!

The only guideline is that the performance address issues of sexual
violence, and for the most part stick to this topic.  The artist may
address this issue from many different perspectives.  In addition to a
survivor or secondary survivors perspective, other possible angles
include (but are not limited to) exploring the importance of community
activism, or what it means to feel safe in our community.

The performer will need to be available this Friday from 7 to 7:45 at
the latest.

Take Action Against CAFTA!

The Central America Free Trade Agreement (CAFTA)
is a very dangerous
agreement.  It expands the
provisions of NAFTA to five nations in Central
America plus the Dominican
Republic, and if passed it will be considered a
green-light to further
expansion of these trade agreements under the
Free Trade of the Americas
Agreement.  CAFTA is dangerous for working
people, here and in Central
America, as it contains no real protection of
labor rights and will
encourage the "race to the bottom" in wages as
companies will continue to
move production from the US to countries, such as
El Salvador and Honduras.
Small farmers in both the US and Central America
will be forced to compete
with cheap produce that will have to be allowed
into their markets under
CAFTA.  This provision was an especially harmful
part of NAFTA and resulted
in hundreds of thousands of Mexican farmers
losing their livelihoods as a
result of being forced to compete with cheap,
subsidized, factory farmed
corn from the US.

Rep. Lloyd Doggett has expressed that he has
serious reservations about
CAFTA but has not issued a
final, conclusive statement about which way he
intends to vote. We have a
chance in Austin to stop this agreement from
happening if we can convince
Rep. Doggett to vote NO!

That's where you come in:

Please take one minute to call your Rep. Doggett
and let him know that you
don’t support CAFTA, and want him to vote NO. 
Our voices will be enough to
defeat the agreement.  Below is a sample script
that you can read from as
you call – but feel free to make your call as
personal as possible.

First, call your Rep. Doggett’s Washington DC
office.  The number for is
202-225-4865.

Once you get through the conversation should go
something like this…

You: Hello, I live in your district and was
wondering if I could speak to
the person who works on international trade
agreements.

Receptionist: The receptionist will either
forward you to the staff person,
or tell you that there is not such a person, or
that they are not
available.  If you cannot talk to a staff member,
you can simply ask to
leave a message with the receptionist.

You: As a constituent looking towards the
election in the fall I wanted to
let Representative Doggett know that I feel very
strongly that he should
vote NO on CAFTA.  I am particularly concerned by
a couple of issues….

You can now use two or three of the points below
to make your case

· CAFTA does not include any meaningful
provisions to defend basic labor
rights. There is strong evidence that this will
encourage the increased
exploitation of workers in Central America.  The
lack of basic labor
standards is also undermining labor rights in the
United States, and jobs
to move overseas at an excessive rate.

· CAFTA will systematically undermine
environmental protections by failing
to set basic standards while allowing
corporations to challenge basic
public interest regulations

· With the US continuing to provide huge
subsidies to big agri-business,
this agreement threatens to destroy small farms
in Central America and here
in the U.S., just as happened under NAFTA,
bringing poverty and threatening
food security. The effect is 600 Mexican farmers
fleeing to America daily
adding to growing immigration concerns,
especially in states like Texas.

· Under CAFTA, virtually all services would be
opened up to private
competition, and corporations cannot be trusted
to effectively meet basic
rights to education, health care and clean water.
When it comes to public
services quality must come before cost, and CAFTA
will undermine that.

· Intellectual Property Rights rules under CAFTA
exceed agreed upon World
Trade Organization standards, and place profits
over peoples’ lives.  They
would prevent citizens in Central America from
accessing life saving
medicines to combat a growing AIDS crisis, as
well as future health crises.

All in all, CAFTA poses a serious threat to our
country and the people of
Central America and with Hispanics representing
32% of Texans, it is
important to take as stand against CAFTA.  Along
with others across your
district, I urge you to vote no to CAFTA.

On one of my email lists, there has been discussion of women going to
pharmacies and finding that the pharmacy refuses to carry birth
control/morning-after pills/RU-486. In response, one of the members
posted the following:


This whole argument pissed me off and got me thinking. We DO vote with
our wallets, but on this issue it can be difficult to know if we're
supporting businesses that are endangering women's rights to
reproductive freedom.

So... I have decided to put up a website that lists pharmacies with
pharmacists who won't fill the prescriptions, both for birth control
pills and for RU-486. I've registered a domain name, but I've got some
research and design to do first.

If you'd like to help, spread the word that I'm looking for
information on this. Anyone who knows of pharmacies that engage in
this practice can email me with that information. (Note that I WILL
call the pharmacy and doublecheck.)

If we vote with our pocketbooks, let's know where we're putting our
vote.

The place: Nice, 2 bedroom, bath and a half townhouse on the end of a
quiet cul de sac on the edge of West Lake. Very close to 360, but not
close enough that traffic noise is too bad. There is a patio,
fireplace, and dishwasher. I have a washer/dryer set that is installed
in the laundry room.

$350 per month plus 1/2 of the utilities (electricity, cable, and
garbage). No deposits needed. Month-to-month with no lease. Available
any time between May 15 and June 1.

No smoking inside. No pets. The lease only allows de-clawed cats, and
I'm allergic to cats.

Me: I'm 35, work for the state and am a grad student on the side. I
also do a lot of volunteer work in the evenings so I'm not going to be
around much on weeknights. I do, however, have a girlfriend who stays
over frequently on the weekends.

Very good question. The workshops committee has been very hard at work
getting the schedule worked out. We're waiting for a few confirmations
and titles before posting the official schedule, but we will be
offering up a very diverse selection of workshops. Watch this space
for announcements soon.
