WELCOME....
Welcome to the September 17th edition of the Music Biz Academy
digest.

As large as the subscription base for this newsletter is, it's
likely many of you who receive this have had your lives
irreversibly changed by the terrorist attacks that took place
this last week. Many of you have lost friends or family, or, at
the very least, know someone who has. I think it safe to say that
we have all been changed, and we will never forget the events of
September 11th, 2001.

Even in this time of darkness, however, there is a light that
shines brightly - our love for country, and our support for those
now taking on the overwhelming task of putting things right. I
was telling a friend of mine just yesterday that in my short 35
years of life, I don't remember ever seeing our country rally
behind one cause with such a unified voice. The patriotism
displayed has been awesome, and inspiring, and takes us back, at
least in some small way, to the root of what this country is all
about - one nation under God, standing together for freedom,
justice and liberty.

I would also like to express my condolences to those lost from
the U.K., Japan, India and others. The World Trade Center was not
just the U.S. trade center, but a global marketplace where those
supporting democracy supported freedom in the U.S. and the world
their day to day lives.

My heart goes out to you all, including those at the Pentagon,
and those brave souls on United Airlines Flight 93. Let freedom
ring!


IN THE MUSIC WORLD...
In terms of the music business, most of the news circulating over
the last two weeks involved how the record companies are
attempting to combat piracy. You may recall that last issue we
reported that the big five record companies were already
releasing encrypted CDs into the marketplace to prevent CD
ripping. Well, already lawsuits are brewing, as an unnamed
Californian woman has sued country music record label Fahrenheit
Entertainment for allegedly misleading its customers by shipping
CDs protected with an anti-rip mechanism built in. This writer
predicts that anti-rip CDs are going to become an accepted part
of life, as file sharing of non-protected music is going to be
near impossible to stop without completely shutting down the
Internet. The record labels, if they want to prevent copying, are
going to have to focus on encrypting the source CD, rather than
on depending on copyright laws and protections already in place.

The U.S. music industry went into a state of near-total paralysis
yesterday (Sept. 11) following the deadly terrorist attacks on
the World Trade Center in New York and the Pentagon in
Washington, D.C. The second annual Latin Grammy Awards, scheduled
for last night at the Forum in Los Angeles after relocation from
Miami, led a list of nationwide cancellations last night. Latin
Academy senior VP Enrique Fernandez says all events surrounding
the awards have been postponed; no new dates have been set.


US RECORD LABEL SUED OVER ANTI-RIP CD TECHNOLOGY

An unnamed Californian woman has sued US country music record

THE RIAA CAN STOP NAPSTER, BUT NOT THE WORLD

In the past few weeks, a host of Napster alternatives have been
monopolizing the scene. A recent survey of the Top Ten programs
being sucked down at CNet's Download.com showed that a full six
of the ruling wares are Napster alternatives. And, check this,
they're not just similar to Napster; they're better than Napster.
The revolution is over. Bootlegging is now a part of life. Thank,
quite literally, the world. The reason: Many of these newfangled
peer-to-peer file trading programs are coming from outside the
U.S., putting them and their programmers outside the jurisdiction
of the Recording Industry Association of America.


NAPSTER ECLIPSED BY NEWCOMERS

Months after shutting down its file-trading service, Napster has
finally been displaced by four new applications that allow users
to trade music, movies and software, a new study concludes.
Four new file-sharing systems -- FastTrack, Audiogalaxy, iMesh
and Gnutella -- were used to download 3.05 billion files during
August, according to research firm Webnoize.
That's more copyrighted material than was ever shared using
Napster and bad news for the major record labels hoping to stop
the trading of digital music.


MUSIC STARS COMPLAIN OF STRINGENT CONTRACTS

LeAnn Rimes, the 19-year-old country music star, has been under
contract to Curb Records since she was 12. Today, she startled
the 150 people at a state Senate hearing here when she said that
she might be 35 years old before she finished delivering the 21
albums that she owes the record company.
Ms. Rimes and other singers, including Don Henley and Courtney
Love, sparred with music industry executives at the hearing,
called by the Select Committee on the Entertainment Industry. The
panel is examining part of the California labor code that gives
music companies the right to keep artists under contract or sue
them if they do not deliver a specified number of recordings.

Morpheus, available through the MusicCity Networks Inc. Web site,
has become the most popular file-sharing network of its kind. It
now boasts more than 550,000 simultaneous users -- a 15-fold
increase over the number of people it had on-line in May. That's
similar to what Napster had about a year ago, and it grows by the
day.


STEALTH WAR AGAINST CD PIRACY

More than one million CDs with anti-piracy devices have been
slipped onto racks in record shops across Europe.
The discs form part of an experiment by major labels to find out
how well their digital security systems work when trying to stop
tracks being copied onto blank CDs or swapped as computer files.
The five major labels have refused to reveal which artists' CDs
are involved.
