The news shaking up the industry this week is the retalitory
noise being made by prominant post-Napster file swapping
services. MusicCity Networks, the folks behind Morpheus (apparent
heir to the file-swapping throne), is taking on the big record
labels, saying to them, essentially, 'Go ahead, make my day."
MusicCity has the backing of some big time lawyers, as well. The
Electronic Frontier Foundation (EFF), which has a strong interest
in digital rights and properties, has agreed to defend MusicCity
against any copyright infringement charges that come from the
recording industry.

CEO of Morpheus, Steven Griffin likens himself to 'William
Wallace'... you know, the 13th century scottish hero whose story
was told in the film Braveheart. Griffin knows the record
companies are coming after him, and frankly, he's ready to do
battle.

TVT, MP3.COM SETTLE DIFFERENCES, END COPYRIGHT SUIT

TVT Records, the New York-based independent record label whose
artists include Snoop Dogg and XTC, has settled its copyright
infringement lawsuit against MP3.com. The settlement was reached
Nov. 7, but the companies made no official statement about the
accord at the time. Company spokesman Jason Consoli said terms of
the deal are not being disclosed, and that there are no plans to
reveal them in the future. "We're not really releasing a
statement, but I can say on our end that we're happy with the
settlement," Consoli said. "It was very amicable."


ROCK STARS LINE UP BEHIND NAPSTER

A group of recording artists led by Don Henley on Tuesday said
they recently filed a brief in a San Francisco federal court that
may give song-swap service Napster a shot in the arm in its
ongoing copyright-infringement battle with the recording
industry. The artists contended in their brief filed Nov. 7 that
the big recording labels may not indefinitely own some of the
sound recording copyrights they are suing over in the landmark
suit against Napster, said Jay Rosenthal, a lawyer for the
Recording Artists Coalition.


PIRATE-PROOF POP GOES PUBLIC

Music makers are stepping up attempts to stamp out piracy with
the public release of CDs that cannot be played on computers.
Natalie Imbruglia's latest album is the first to go on general
release with a copy-protection system built in. Commentators say
that soon many more CDs employ similar anti-pirate technologies.
Before now, such systems have been added in a piecemeal fashion
to a limited number of releases in different countries.

MusicCity, a popular file-swapping company confronting a lawsuit
from the Hollywood and record industry that could blaze new,
influential legal ground. The Electronic Frontier Foundation
(EFF), which has represented hackers, cryptographers and computer
scientists in its push for digital rights, agreed to defend
MusicCity against copyright infringement charges by movie studios
and record labels. It's helping build a high-powered team of
lawyers to show that this case is different than Napster.

with European digital platform Vitaminic SpA that will give
Napster a further 250,000 audio tracks for its new registration
model. The multi-year deal, the largest signed by Napster to

with the music industry by opening up music from more than 80,000
artists and 1,275 European and worldwide labels.
