Welcome, subscribers to the December 10th edition of the Music

IT'S ALL THE RAGE....
Well, it's finally here. RealNetworks launched its
much-anticipated subscription service for online music, known as
RealOne Music. RealOne, pushed heavily by Real Networks
(http://www.real.com) and the major record labels, is the first
pay-for-listen music subscription service to hit the net. For a
price of $9.95 a month, the service lets you download and stream
up to 100 music tracks a month from the catalog of MusicNet, a
shared venture of three of the big music labels.

RealOne Music is already meeting with mixed reviews, receiving
flack on everything from non-functionality to poor technical
support for it's users.

So, the question being asked again and again is, will music fans
pay to listen to music online? In our view, so long as free
options remain available (MP3.com, Live365.com, MusicCity.com) it
seems unlikely that the pay-for-listen service will find a very
loyal user-base. If the record labels want listeners to pay for
music, they need to offer much more than a 100 song per month
selection.

Listen up music labels! If you want our music dollar, give us
something we can't live without - our own, instantly accessible,
searchable music library with vaults so deep we can never exhaust
it. We want unlimited access, the ability to categorize our own
music, create playlists, and to access new music without
restriction. You say Green Day has a new album out? Let us know
the moment it's available and let us preview the music right now.
Then give us an instant buy option to purchase, download and burn
our own CD if we choose. That's what we want. Oh, and we want the
tool to be fast, reliable and simple to use.

We don't ask for much, do we?

remained virtually unchanged at 64% for the last 12 months. This
translates into approximately 127 million adults aged 18 and
over, up from 121 million in the previous year. What is
remarkable about these results is that this is the first time
since the rapid growth of Internet use began in 1994 that we have
not seen sizeable increases in Internet penetration over a twelve
month period.

MTV FACES SECOND THREAT TO CROWN

MTV's long-standing dominance of music television came under
renewed threat today when EMAP agreed a deal with NTL for
carriage of all six of its music channels. The deal will give
Emap channels, including The Box, Smash Hits, Kiss TV and QTV,
access to a potential 1.3m digital households from early in the
new year. It follows a similar recent agreement with Telewest.
The growing popularity of Emap music channels is placing pressure
on the market share of MTV's own channels which have spent most
of their existence without any real competition.


FTC VIOLENCE REPORTS FAULTS MUSIC INDUSTRY

BILLBOARD LICENSES CHARTS TO PRESSPLAY

KAZAA ORDERED TO CEASE INFRINGING COPYRIGHT

Music sharing system KaZaA has been given two weeks by a Dutch
court to cease infringing recording artists' copyrights.
If the company fails to comply with the order, it faces a penalty
of 100,000 guilders ($40,317) a day, the Judge warned.

Dutch wing of the International Federation of the Phonographic
Industry against the Netherlands-based file-sharing operation.

filed a federal suit against some makers of file-swapping

label to issue CD replacements for angry consumers--another

players. The disc will be replaced by retailers or by the label

VIVENDI PUTS EGGS INTO ONLINE BASKET

giant Universal Music Group, has said it will combine its Web
properties under one unit in an effort to get its traditional
media units to work more closely with its Web businesses.

the company's Paris-based Internet division. The company's

Music-swapping service Aimster is following its nearly-namesake
Napster into the courts with old adversary of P2P fans the RIAA
leading the list of plaintiffs. The Recording Industry
Association of America is once again complaining about copyright
infringement and joins the Motion Picture Association of America
and various film studios in filing suits against the file-sharing
service that allowed users to swap music and movies via instant
messaging services. However, the biggest bone of contention so
far seems to be how to conduct the trial and where to hold it.


DIGITAL MUSIC PLAYERS TO BLAST OFF BY 2005

Digital music players have gained a solid foothold in the
marketplace and promise to become much more popular in the coming
years, according to a new Cahners In-Stat report.
The research firm is projecting shipments of 9 million of the
units by 2005, up from 2.4 million last year and the more than 3
