Welcome, subscribers to the January 21st edition of the Music
Biz Academy Digest!

IN CASE YOU MISSED IT....
The New Napster is on it's way. The beta version has been rolled
out for the public consumption, and Napster is working very hard
to obtain licensing that will allow it to both satisfy the major
labels and it's users.

The new, fee-based service, which will cost between $5-$10 per
month, will still offer it's users the functionality they were
used to - finding and sharing music through the Napster
'community'. However, all the music offered through Napster will
be 'legal', made available through licensing from the music
labels. If you have a song you want to 'share' with the
community, the Napster system will check the song to ensure it's
licensed, and if so, will allow it to be shared with others.

USING NAPSTER TO MARKET YOUR MUSIC...
As a musician, the new Napster will offer a very cool opportunity
- to license your own music and get paid for it. An artist
providing their original music to the Napster community will be
able to enter into a license agreement with Napster and actually
get paid directly as the licensor. What that payment will be, has
not yet been announced.

To preview the new Napster, visit http://www.napster.com/preview/

When the new Napster goes live, we'll be watching the 'pay for
play' opportunities very closely and will keep you, our
subscribers, in the loop.

Thanks for your ongoing support...

CD BABY PASSES MILLION DOLLAR MARK IN MUSICIAN PAYOUTS
http://mi2n.com/press.php3?press_nb=31397
CD Baby, an online retailer of independently released CDs,
announced today that they have now paid over one million dollars
to musicians for CDs sold. CD Baby was started as a hobby in 1998
by musician Derek Sivers, looking for a better way to sell his
own CD online. His musician friends also joined up, and told
their friends. Soon, without any advertising, word-of-mouth
quietly made CD Baby the largest independent-only CD store, with
10,000 artists selling over 100,000 CDs a year.

THE SCRATCHY RECORD OF THE ONLINE MUSIC DEBATE
http://www.washingtonpost.com/wp-dyn/articles/A22972-2002Jan9.html
For a realm that was supposed to thrive at stunning speeds, the
world of online music sure seems stuck in a kiddie crawl. In
2002, just as in 2001, labels still fret that consumers will
pirate great gobs of downloadable music and put them out of
business. Retailers still worry that the labels will sell
directly to consumers, and put them out of business.

MUSIC INDUSTRY STILL IN FIRST GEAR ONLINE
http://news.cnet.com/news/0-1005-200-8395107.html?tag=ch_mh
Despite a year of headline-generating turmoil, musicians,
techies, media executives and lawmakers gathering for the second
Future of Music conference on Monday will find that much remains
unresolved on the digital-music landscape. Over the past year,
recording companies managed to force the shutdown of the free
online song-swapping service Napster and launch services of their
own. But they also saw new threats sprout up hydra-like in the
form of second-generation free services such as Kazaa and
Morpheus.

Online file swapping service KaZaA has temporarily suspended
downloads of its KaZaA Media Desktop client software in a move to
avoid a hefty fine, the company said on Thursday.
Dutch music licensing body Buma/Stemra decided to enforce a
ruling handed down by the Amsterdam district court on November
29, KaZaA said. In the ruling, KaZaA is ordered to make it
impossible for users to share copyright-protected material using
the KaZaA Media Desktop, or face a fine.

http://www.siliconvalley.com/docs/news/svfront/046458.htm
Jupiter Media Metrix Monday cut its five-year forecast for the
size of the online music market by 11.3 percent, citing weakness
in the economy and music sales and later-than-expected Web
service launches. In data due to be officially released Tuesday,
Jupiter, an Internet research firm, said it had reduced its 2006
estimate of the size of the Web-based music market to $5.5
billion from its original forecast of $6.2 billion, announced in
July.

service has been long-awaited, but Thursday's launch will offer

MUSIC INDUSTRY RETHINKING CD COPY PROTECTION
http://www.newscientist.com/news/news.jsp?id=ns99991758
The music industry is having to rethink its drive towards
copy-protecting music CDs, following people-power protests and
probing questions from US politicians. BMG in Europe had launched
two of its chart CDs, Natalie Imbruglia's White Lilies Island and
Five's Greatest Hits, with copy protection technology but have
now switched production to "clean" unprotected CDs, following
consumer complaints.

The head of Internet music service Napster asked the U.S.
government on Monday to force recording companies to share their
catalogs with independent digital music sites. Napster Chief
Executive Konrad Hilbers told musicians, lawyers and
music-industry officials at a music conference that Congress
should consider establishing a mandatory per-song rate that Web
sites such as Napster could pay recording companies if they
cannot forge deals on their own.

http://www.foxnews.com/story/0,2933,42329,00.html
Burning and downloading songs may soon be an activity of the
past, as copy-protected CDs begin to hit the market. Last month,
More Fast and Furious: Songs From and Inspired by the Motion
Picture, became the first copy-protected release by a major label
in the United States. And Friday, Virginia Congressman Rick
Boucher sent a detailed letter to the Recording Industry of
America and The International Federation of the Phonographic
Industry voicing his concern over copy-protected CDs.

LISTEN.COM TAPS BIG LABELS FOR MUSIC SERVICE
http://news.cnet.com/news/0-1005-200-8399766.html?tag=lh
Listen.com has signed music distribution deals with two major
record labels, giving it a long-awaited power boost in the race
to create the perfect online jukebox. The San Francisco-based
company said it has signed deals with Bertelsmann's BMG
Entertainment and EMI Recorded Music, which together represent
just under a third of U.S. music sales. Like many other online
companies, Listen.com has been seeking distribution rights from
the five major labels for more than a year as it refocused its
business on digital music subscriptions.
