Welcome, subscribers to the March 4th edition of the Music Biz
Academy Digest!

IN CASE YOU MISSED IT....
The biggest news to report this issue concerns the ruling by the
US Copyright Arbitration Panel that Internet-only webcasters will
be required to pay royalties of $0.0014 per song listener for
radio transmissions over the Internet. That doesn't sound like
much, but if 1000 listeners listen to 20 songs each in one hours
time, that adds up to $28/hour. Webcaster Live365.com has stated
they will have to completely reevaluate their business model if
this remains the going rate, and many webcasters have openly
expressed this fee will put them out of business. The Digital
Media Association, who represents webcasters, intends to appeal
the decision.

NAPSTER WINS TWO LEGAL VICTORIES

A federal district court judge handed Napster a small victory
Friday, calling for record labels to detail their copyright
ownership of the songs the labels seek to have restricted. The
judge also questioned the record companies' online distribution
mechanisms. Instead of handing the major record labels a decisive
victory in the summary judgment, as expected, U.S. District Judge
Marilyn Hall Patel ruled that the record labels must prove
ownership of the songs in question -- an issue brought to the
fore last October by Napster.

The music industry has pointed the finger at illegal music
downloads and CD copying, or burning, for a 10% drop in sales of
compact discs in the US in 2001. A survey carried out by the

new music because they are downloading or copying music for free.


WEBCASTERS SAY PROPOSED ONLINE ROYALTIES COULD RUIN THEM

U.S. PROPOSES ONLINE MUSIC PAY
