Welcome, subscribers to the April 29th edition of the Music Biz
Academy Digest!

IN CASE YOU MISSED IT....
According to MeasureCast's latest figures, Internet radio
listening is up 99% since the beginning of this year and up a
staggering 563% since January of 2001. What we have here, is a
definite trend - people are becoming much more comfortable with
radio on the Internet and are taking advantage of it's benefits.

However, the RIAA, concerned that artists and copyright holders
are losing royalties from millions of radio streamings every
month, is lobbying the U.S. Copyright Arbitration Royalty Panel
(CARP) to put into place royalty rates that will effect all
webcasters. Webcasters such as Live 365.com and many others are
very concerned that these new royalties may signal the end of
their business. In effect, they say, under the new rates only
large corporate companies could afford to run an Internet radio
station. At the very least, small, independent webcasters would
have to close down.

Wednesday, May 1st has been declared a 'day of silence' by U.S.
webcasters to bring attention to their possible demise. They are
hoping that the Copyright Arbitration Panel, which rules on the
rates May 21st, will take their plight into consideration.

The RIAA's position is that the proposed rates will in no way
effect small radio stations. According to it's press release,
"...the RIAA and its member companies want ALL webcasters, large
and small, to succeed." and "These CARP rates alone will not
drive all webcasters out of business."

These developments have the potential to seriously impact the
radio market for independent musicians. It's extremely difficult
for independent artists to get any kind of significant airplay on
radio. As it stands, Internet radio provides a sort of equal
opportunity for all of us. Imagine if the corporate music
industry were able to control Internet radio the way it does the
airwaves.

While we do agree that all artists/copyright holders should be
paid appropriate royalties, musicians and webcasters should have
an equal voice in determining what that value should be. We hope
the arbitration panel will give a fair, objective ruling, keeping
in mind that for artists, it's not all about the money. It's
about the freedom to express ourselves through music, a freedom
that the Internet has given new voice to. Please, don't silence
it.

Terry Semel, chairman of Internet giant Yahoo and a former
Hollywood executive, on Tuesday blasted major media companies for

GATEWAY TESTS WATERS OF THE MUSIC BUSINESS

The Poway, Calif.-based PC manufacturer is examining a number of
strategies that could effectively turn the company into a player

RIAA WANTS TAX DOLLARS TO COMBAT PIRACY

additional federal funding to combat the ongoing wave of piracy,
saying that the number of arrests and convictions for copyright
crimes has skyrocketed over the course of a year. In a

funds for federal anti-piracy law enforcement efforts and is
pushing for a renewed agenda on protecting intellectual property.

MUSICIAN TO NAPSTER JUDGE: LET MY MUSIC GO

A 1960s-era recording artist says he can't get Sony to pay
royalties, so his psychedelic pop might as well be free. "The
record companies' representation that they are legitimate agents
for their artists is false," says Joseph Byrd. "The only payments

accountable; to the rest, a vast majority, they pay nothing.
Therefore, allowing them to collect fees in our behalf does not
serve the public interest."


SECOND GENERATION NAPSTERS DEFY RECORDING INDUSTRY

LISTEN.COM WARMS TO CD BURNING

digital music service be copied onto CDs, a step toward allowing
its subscribers to play music when they want, where they want.
The music service provider said that each month, subscribers to
