IN CASE YOU MISSED IT....
There's been a lot of action these last two weeks in the news,
the biggest news of note being the Librarian of Congress'
rejection of webcasting royalty rates proposed by the Copyright
Arbitration Royalty Panel. The proposal by the CARP would have
required Internet broadcasters to pay 0.14 cents for each song
streamed to each online listener, a rather hefty sum. This
rejection does NOT mean that rates will not be imposed, just that
the Librarian of Congress has rejected CARP's recommendations.
More news is expected on June 20th, when the Librarian and the
Register of Copyrights issues a final royalty determination.

SUDDENLY, SWEET HARMONY AT NAPSTER

The recording and music publishing industries extended their
legal pursuit of online music swapping firms Friday, suing
Audiogalaxy for copyright infringement. The Recording Industry
Association of America and the National Music Publishers
Association accused the Austin, Texas, firm of "willfully and
intentionally" encouraging and facilitating millions of users to
copy and distribute copyright work of artists, ranging from Dave
Mathews and Celine Dion to Alicia Keyes and the Beatles.


MP3 FOR SALE ONLINE IN INDUSTRY FIRST

In what may be a first for the recording industry, Maverick
Records and Vivendi Universal's online division are asking
listeners to pay just under a dollar for an unprotected MP3
version of a new single. The companies put the track, a dance
version of "Earth" by Meshell Ndegeocello, online Thursday on
sites run by Vivendi Universal Net USA, including MP3.com,
RollingStone.com, GetMusic.com and MP4.com. People can purchase
the file for 99 cents (70p) and then burn the song to a CD-ROM
disc or transfer it to a portable device.


MUSIC INDUSTRY SEEKS PAYOLA PROBE

The recording industry from artists to major labels joined
Thursday in a rare show of unity to demand tougher laws barring
what they called "payola"-like promotion of music played on the
radio. They also called for a sweeping government review of radio
industry consolidation. Deregulation of the radio business and
rampant practices that skirt 40-year-old anti-payola laws stifle
competition, drive up music promotional costs and make it harder
for new artists to gain attention, the artists and record labels
said in a joint statement addressed to the federal regulators and
Congress.


LISTEN.COM FLIPS ON CD BURNING

Music service provider Listen.com on Thursday released its
updated version of its digital music subscription service that
allows people to burn CDs and listen to a new Net radio service.
As expected, Rhapsody 1.5 lets subscribers with CD burners put
tunes onto CDs through its "Naxos Classical with Burning"
catalog. Subscribers, who would pay $9.95 per month, can burn up
to 10 tracks each month from the catalog, which contains more
than 2,200 titles and more than 10,000 musical works.

INTERNET RADIO GETS A STAY OF EXECUTION

Technology buffs have cracked music publishing giant Sony Music's
elaborate disc copy-protection technology with a decidedly
low-tech method: scribbling around the rim of a disk with a
felt-tip marker. "I wonder what type of copy protection will come
next?" one posting on alt.music.prince read. "Maybe they'll ban
markers." Sony did not immediately return calls seeking comment.


'POISON' CD TO CATCH COPYISTS

The writing could be on the wall for computer buffs who copy
music CDs for their friends. Sony Music has planted a "poisoned
pellet" of software in Celine Dion's latest CD, A New Day Has
Come, that is capable of crashing, and in cases permanently
freezing, the optical drives of personal computers into which the
discs are inserted. Michael Speck, of the Australian Record
Industry Association, confirmed yesterday that the anti-piracy
software trials were under way but said "spiked" CDs had not so
far been distributed in Australia, but it was inevitable. The
music companies were "simply protecting their property", he said.


JEWEL LAUNCHES "SOUL CITY CAFÉ" FOR EMERGING ARTISTS

"Soul City Café," a multi-faceted program designed to encourage
