Welcome, subscribers to the September 17th edition of the Music
Biz Academy Digest!


IN CASE YOU MISSED IT....
Here's the stuff you ought to know:

These last two weeks have been such that we are really beginning
to see the effects of the RIAA's (Recording Industry Association
of America) war on music piracy. This war of headlines and
politics between all parties has has resulted in some decidedly
'nasty' side-effects.

First off, Napster, the original file-swapping gangsta' was
officially declared 'dead' last week when a federal judge blocked
the sale of the one time powerhouse to media giant Bertelsmann.
Headlines of Napster's demise dominated the news - 'R.I.P.:
Napster', 'Napster Used All Nine Lives', 'Napster Sounds Death
Knell' - the chant was heard from one end of Cyberspace to the
other. Then, this week, in an unexpected twist, one of the
Internet's leading purveyors of 'adult' material offered to
purchase the Napster trademark and web site address. According to
the Mail & Guardian Online, the company plans to use Napster's
file swapping system to distribute its huge library of material.
Yuck. I don't even want to talk about it. That's one deal I am
praying does not go through.

Moving on, MP3Board.com is being sued by the RIAA for linking to
web sites that offer both authorized and unauthorized MP3's for
download. That's right, the RIAA is going after a web site simply
for linking to other sites. Who is MP3Board.com, you ask? Funny,
I hadn't heard of them either, not until the publicity generated
by the RIAA lawsuit inspired me to go check out their web site
(oh, the irony). By the way, I do NOT recommend you visit the
MPBoard.com web site unless you enjoy trying to kill pop-up ads
that spin off even more pop-up ads. Bad web site. Bad, BAD WEB
SITE! (You're probably going to go there now, huh? Don't say I
didn't warn you.) Why is the RIAA bothering with these guys? Who
in their right mind would ever return to this web site a second
time? I clicked on one link on their web site (the random MP3
link) and was sent to pop-up oblivion, then my Antivirus software
popped up to warn me that a javascript running from one of those
windows was infected with a trojan virus. Oh, my, my! Stay away
folks! Thank goodness for Norton Internet Security!

More carnage! AudioGalaxy, sued in May 2002 by the RIAA, has
become a ghost of its former self. AudioGalaxy turned off most
of its download features last week leaving startled users
grasping at air. One frustrated user posted a very interesting
'What Now?' FAQ to the AudioGalaxy message board which stated
'YOU'RE TOO LATE. If you just came to the Audiogalaxy party --
sorry, it's over.' You can view the 'What Now?' FAQ at

And the battle rages on.... In its suit against file-swapping
services Kazaa, Morpheus and Grokster, the RIAA asked the federal
judge to skip the trial and make a summary judgment against the
companies. According to attorneys for publisher trade groups, all
three services have done their best to create 'candy stores of
infringement that allow a user to find the most popular music and
movies of our time without paying any of the rights holders.'
Lawyers representing Morpheus asked the judge to skip the trial
too, but on different grounds, saying that they should not be
responsible for how users misuse their network, and that the
file-trading system has too many legal uses to shut it down.

The tsunami continues. According to statistics released by BRS
Media, in the last year alone the number of radio webcasters
broadcasting online has dropped by 31%. The BRS figures state
that well over one thousand US stations have quit broadcasting
online as a direct result of 'the current copyright crisis.'
Strangely, the BRS press release does not specify what 'crisis'
they are referring to, but presumably they mean the new
webcasting royalty rates issued by Federal copyright regulators,
the first payment for which is due October 20th.

In another very interesting tidbit that came across the wire this
week, a report by networking company Sandvine, titled 'The
Effects of P2P on Service Provider Networks,' estimates that in
terms of bandwidth usage, file-sharing networks Kazaa and
Gnutella may account for between 40-60% of all Internet traffic.
Wow! No wonder my Internet connection is so slow!

And finally, you will be much relieved to hear that Lance Bass of
`N Sync won't be orbiting earth in the International Space
Station after all. Ah, shucks!

Sure, they download free songs via the Internet, a couple of
Midwestern university roommates say, but that doesn't make them
crooks. They are, nevertheless, seen as part of the MTV
demographic that music company executives blame for contributing
to the demise of their business. Students Lora Michaelides and
Lindsey McCollow, sophomores at Marquette University say the
executives have got it all wrong. "I buy more CDs now. I want to
keep the music business up," said Michaelides. She noted that
while she has probably downloaded as many as 13,000 songs in her
life, she also has lost count of how many CDs she owns.


MUSIC INDUSTRY SHOWS DESPERATION: CHEAPER CDS

Brace yourself to see something startling next time you go to a
record store. You might see some reasonably priced CDs. Most of
the major music companies are starting to offer retailers
limited-time rebates on some releases. As a result, many
consumers paid just $10 for new albums by young performers
including Ashanti and Vanessa Carlton, as well as veterans Sean
"P. Diddy" Combs and Bruce Springsteen. That's a big deal in an
industry that consistently raised CD prices since 1996.


TED NUGENT MAKES LANCE BASS AN OFFER

Ted Nugent has made a special offer to Lance Bass upon hearing
that the 'NSYNC member's proposed trip to the International Space
Station was cancelled by the Russian Space Agency after he was
unable to come up with the $20 million in time. For "only $1
million," the legendary guitarist and outspoken outdoorsman is
inviting Bass to his Michigan ranch to be trained in bow hunting
basics before joining him on a week-long hunt "where he'll be
taught a greater appreciation for nature and gravity as he hunts,
kills, cleans and cooks for himself," says Nugent.


NAPSTER GOES UNMOURNED TO THE GRAVE

iconic online song-swapping service Napster has failed to stir
much sympathy. "Really, who cares?" Sebastian, a student at the
Technical University of Darmstadt, Germany, told Reuters as he

liquidation as early as Thursday. "Everybody's moved on to other
file-sharing (services). The interest for Napster in the Internet
community just wasn't as high as everybody originally thought,"
said the 28-year old student of IT engineering.

on the Internet, released their latest statistics today at The
NAB Radio Show. As predicted, the numbers indicate that the
current copyright crisis is having a direct impact on the number

number of radio webcasters has declined by thirty one percent
(31%). Prompted by the current copyright issue, well over one
thousand US stations quit broadcasting online.


MEASURECAST: LESS STATIONS, MORE LISTENERS

PORN COMPANY BIDS FOR NAPSTER

material.

Communications in its legal spat with the recording industry over
revealing the identity of an alleged peer-to-peer pirate.
In court papers filed late Monday, the groups said that the
Recording Industry Association of America (RIAA) has not followed
the law in its efforts to learn more about a Kazaa user accused
of illicitly trading music files. Monday's move highlights the
latest battle lines that have been struck in the legal war over
peer-to-peer networks.


AUDIOGALAXY MOVES TO LEGAL DOWNLOADS

The file-swapping network has signed up with Listen.com to
provide a legal music download service, and streaming access to
albums. One-time file-swapping powerhouse Audiogalaxy, hobbled by

tapped Listen.com to offer a paid subscription service. The offer
launched quietly on Audiogalaxy's site last week.

judge blocked the $9 million sale of the onetime file-swapping
powerhouse to German media giant Bertelsmann. The surprise
decision isn't expected to have much effect on the tumultuous
online music world, but the ruling does appear to close the book
on a company that became a consumer favorite while being reviled
by much of the entertainment industry. Most of Napster's
remaining 42 employees have been laid off, and visitors to the
Napster home page found a stark message: "Napster was here."


LAWYERS GO FROM NAPSTER TO MADSTER

online file-swapping service Madster. The company has now become
the target of the legal might of music industry lawyers fresh
from their victory against Napster. More than two dozen record
and other media companies are involved in the litigation, which

FIRST "AIR-TO-WEB BROADCAST REPLICATION" TECHNOLOGY PATENTED

broadcast industry solutions, announced today it will work with
WRAL-FM radio in Raleigh, North Carolina, to pilot its patented
Air-to-Web Broadcast Replication (AWBR) technology, allowing the
radio station to transmit its content via the Internet while
replicating its over-the-air signal reach. The significance of
this new technology is it permits any radio station to broadcast
their local signal over the Internet without infringing upon
copyright laws by extending the signal beyond legal geographic
boundaries.


MP3BOARD.COM COPYRIGHT INFRINGEMENT CASE GETS JURY TRIAL

A federal judge has denied motions for summary judgment on both
sides of a copyright infringement case between record labels
represented by the Recording Industry Association of America
(RIAA) and MP3Board.com, a site that provides links to audio
files on public websites -- setting the stage for a jury trial to
begin within the next 30 days. The RIAA sued MP3Board.com for
copyright infringement, over its website that directs users to
other sites offering both authorized and unauthorized MP3 files
for download.


LABELS LOOSENING UP ON CD COPY LOCKS

Fearful of consumer backlash, major record labels in the United
States have slowed controversial plans for making CDs more
difficult to copy, even as tension over online music piracy
mounts. Last year, news that record companies were planning to
add technology to CDs that would block people from making copies
or MP3 files--and in many cases might even prevent playback on
computers--sparked considerable controversy online, and even
lawsuits. Now major record labels themselves have put the brakes
on the drive for copy protection, at least in the United States,
even as record stores lobby for the locks to be added as soon as
possible.
