IN CASE YOU MISSED IT....
In terms of the latest news, here's the stuff you ought to know.
Most of this is ongoing...
Late last week, a bill (H.R. 5469) was introduced into the U.S.
House of Representatives that would postpone the payment due date
for new webcasting royalty rates by six months. The reason for
this bill is simple: if the new webcasting rates go into effect
on October 20th as planned, many Internet radio stations who
cannot afford the new fees will have to immediately shut down.
This would be a real shame, especially if it turns out that the
webcasting rates are later overturned or reduced. If that
happened, it would mean, in effect, that the stations were shut
down for nothing. H.R. 5469 allows small webcasters to remain in
business while the dispute continues through the appeals process.

On the other side of the legal fence, congress is considering
giving expanded legal protection to record labels so they may
'sabotage' peer to peer networks that allow users to trade music.
Tactics used against these networks would include the blocking of
file transfers and flooding networks with 'dummy' songs. Though
the RIAA has stated that they would not extend their reach onto
anyone's personal computer, it is difficult to believe they would
be able to avoid this temptation in every case. According to a
news.com report, "overzealous copyright enforcers have already
mistaken a photo entitled 'Portrait of Mrs. harrison williams
1943' for a song by former Beatle George Harrison, and demanded
that Internet provider UUNet terminate the account of a customer
who posted a book report on Harry Potter." And that happened
without these 'expanded legal protections' in place.
Adding to all this, both Kaaza and Morpheus (peer to peer
networks) have already released new versions of their software
which allow users to screen out 'dummy' files planted by the RIAA
or anyone else. So the RIAA's efforts have, in the end,
contributed to improving the technology used by the very people
they are trying to stop. When you're dealing with technology
issues, isn't this nearly always the case? Creating a new
technical problem simply results in an expanded, more
comprehensive technical solution.
In a final irony, while a slew of artists, including Britney,
Madonna, and Eminem, are teaming up with the RIAA making public
service announcements to address the issue of illegal file
sharing - other artists, including Don Henley, Clint Black, and
the Dixie Chicks, have been attending hearings set to investigate
whether record label accounting practices are fraudulent and
inherently designed to take advantage of artists.

So while, on one hand, artists are teaming up *with* the RIAA to
fight against 'theft by file-trading', on the other hand artists
are fighting *against* the RIAA for alleged 'theft by
underpayment.'

It's rampant. The new P2P systems, such as KaZaA and Morpheus,
have picked up where Napster left off, and blank CDs now outsell
prerecorded discs. The trend is clear: concern not for the law
but for economics. If you had a machine that could make a new
Lexus for $1,000, then why would you buy one from Toyota for
$50,000? Because you had a moral obligation? You'd wonder why
Toyota wouldn't use the same machine to make the car for $1,000.
Where is the morality in keeping the price jacked up? Likewise,
too many people are asking why they should buy a CD for $16 when
they can copy one for 35 cents.
INTERNET RADIO THE P2P WAY

First there was AM. Then FM. Now, the next evolution in radio
broadcast technology could very well be "P2P." What could be even
more controversial than Internet radio/audio broadcasting--which
has made headlines this year over the issue of royalty
payments--and P2P file sharing? Probably the merging together of
these banes of the music industry. Two P2P clients, PeerCast and
Streamer, are exactly that. Without the need to have your own
dedicated server, these programs let you stream audio files to
other users on a P2P network. Essentially, you can run your own
Internet radio station whenever you start up your computer and
get online.

Record companies see it as mutiny. Musicians call it an overdue
rebellion. Either way, the artists' rights movement has set the
stage for combat that could revolutionize the music industry.

celebrity because of the RIAA's practically medieval suppression
of file sharers, downloaders and other copyright miscreants. This
is not an obscure tussle between corporate lawyers but a very
public war between the net and the music biz - involving one of
the most powerful corporate lobbies in history, the brightest
geeks of their generation and up to 100 million people - the file
sharers themselves. Both sides see this as a battle for survival.

An era seems to be coming to an end right before our eyes. Just
two weeks ago it was confirmed by current parent Bertelsmann that
Napster would almost certainly never reincarnate in a paid-for
legal mode after nearly two years of court wrangling. In the
aftermath of Napster's suspension, several other illegal services
rose their ugly heads, including KaZaA, MusicCity, Grokster and
Aimster. This week, services are being targeted by the attorneys
of the Recording Industry Association of America (RIAA). It might
take a while, but we the RIAA's lawyers are pretty confident that
they could have this all wrapped up by Christmas with all the
mainstream illegal services shut down or suspended. The question
is what happens then?
CAN BON JOVI FOIL THE PIRATES?

Bon Jovi may have a new, Web-based scheme to discourage their
soon-to-be-released disc from being pirated. On the inside of the
packaging of Bon Jovi's Bounce is a 13-digit, randomly generated
serial number. By entering that code on the group's website, fans
enroll in a program that puts them "first in line" for concert
tickets and allows them to listen to unreleased tracks from the
band. "The idea is to make anyone who's file sharing or burning
feel like they're missing out by not buying a real copy of the
CD."
THE RISE OF P2P WORMS-AND HOW TO PROTECT YOURSELF

It's been exactly a year since the Nimda worm first took the
Internet community by surprise, and now that school's back in
session, new viruses are starting to appear. These new viruses
either use peer-to-peer (P2P) file-sharing networks, such as
Kazaa or Morpheus, as a means to infect innocent victims, or they
use P2P technology to construct worms that can communicate with
one another and may someday even be resistant to antivirus
measures.

SURPRISE BILL WOULD PUT WEBCAST ROYALTIES ON HOLD

In an unexpected development, Rep. F. James Sensenbrenner Jr.
(R-Wisc.) introduced legislation late yesterday (Sept. 27) that
would delay for six months Webcasters' payments of digital
royalties to record companies and artists. Webcasters are
supposed to begin paying the royalties on Oct. 20. Insiders say
Sensenbrenner, chairman of the House Judiciary Committee, wants
to suspend payments until pending court challenges to the new
rates are heard. Sources say the new bill might be taken to the
floor of the House as early as Tuesday.

Would you stop illegally downloading music files if Britney
Spears asked? How about Brian Wilson? Eminem? Or Stevie Wonder,
Shakira, Madonna, P.O.D., Marilyn Manson, 3 Doors Down? They've
all signed on to an ad campaign aimed at discouraging illegal
music file trading on the Internet. The full-page ads have run in
the New York Times and other U.S. newspapers. Spears will appear
in TV commercials saying that stealing music online is as bad as
stealing a CD from a store.
NAPSTER CLOSES IN ON BUYER

Napster, the former high-flying music-trading site, said Friday
that it has signed a nonbinding letter of intent to sell its
assets, although it declined to name the buyer. Rick Antonoff, an
attorney representing Napster's unsecured creditors committee,
said that after negotiating with a select group of qualified
bidders in recent days, it has signed an agreement with one
company, which he would not name, and that a deal could be
reached as soon as next week.

Frustrated by the continuing presence of free music on the
Internet, the recording industry asked for Congress' blessing on
Thursday to gum up the online networks they blame for slowing
their sales. Congress is considering expanded legal protection
for record labels who resort to sabotage in their ongoing battle
with "peer to peer" networks that allow users to freely trade
music, movies and other copyrighted material.
UNIVERSAL MUSIC HIT WITH ANTI-PIRACY SUIT

Vivendi Universal's music division, charging theft of its
anti-piracy technology, trade secrets and ideas. The action could
hold up the marketing campaign about to kick off in conjunction

"Bounce", which involves the use of special Personal
Identification Numbers, or PINs that DownloadCard has pioneered
in online promotions.
KAZAA TAUNTS RECORD LABELS WITH NEW ALLIANCE

Popular file-swapping system Kazaa has released a new version of
its core software and announced an important alliance.
The swapping network has signed a deal with European net service
provider Tiscali which will see both partners promote each other
to their respective audiences. The deal gives Kazaa much needed
legitimacy at a time when file-sharing systems are facing legal
and hacking threats from the music industry. The alliance could
also help Tiscali boost the number of customers signing up for
its broadband service.
STUDY: MEDIA GIANTS WRONG ABOUT ONLINE PIRACY

Media giants such as Time Warner and Walt Disney should be paying
less attention to pirates, and putting more effort into providing
compelling digital content, says a new report Media companies

businesses, according to a study released on Wednesday from KPMG.
ARTISTS FIGHT MUSIC FILE-SHARING

begin running today, they are joining with 86 other recording

claiming it threatens the livelihood of everyone from recording
artists and writers to sound engineers and record-store clerks.

pioneer. Liquid Audio, a well-regarded music technology company
whose recent troubles are more befitting of an episode of "Behind
the Music," will meet with its shareholders for the most
important vote in the company's six-year lifespan. At stake is a
planned merger, control over the board of directors, and the
future of the company over demands by some shareholders who want
to liquidate it to save its still-substantial cash reserves.
ARTISTS ON HAND FOR ROYALTIES ACCOUNTING HEARING

Lawmakers, artists, and record company executives will attend a
hearing in downtown Los Angeles today (Sept. 24) called by
California state senators Martha Escutia (D-Norwalk) and Kevin
Murray (D-Culver City), to investigate record label accounting
practices. Scheduled to testify on behalf of the artists are Don
Henley, Glenn Frey, and Joe Walsh of the Eagles, Clint Black, the
Dixie Chicks' Martie Maguire, and others. This marks the second
hearing to look into alleged underpayment of artist royalties by
record labels.
GARAGEBAND IS BACK!

Due to the overwhelming loyalty of its membership, Garageband
Records has officially re-opened its doors for business, the
company announced today. Garageband also announced that Ali
Partovi, a successful grass-roots entrepreneur whose last
venture, LinkExchange, was sold to Microsoft Corporation for $265
million, has joined as CEO. Mr. Partovi will spearhead the
company's strategic shift towards offering premium services to
its core community.
WEB RADIO ASKS FOR A STAY ON ROYALTY PAYMENTS

Radio broadcasters in the US have requested that the US Copyright
Office grant a 'limited stay' on webcast royalties. These same
broadcasters are currently at the Third Circuit Court of Appeals,
arguing the case that the Digital Millenium Copyright Act wording
does not mean that they should pay royalties for internet
broadcast sound recordings. The commerical broadcasters claim
that no royalties should be paid until the Third Circuit has
decided, for fear of some broadcasters suffering from irreparable
financial damage which may turn out to be needless in the end.
NAPSTER ASSETS DRAW MORE THAN A DOZEN BIDS

More than a dozen bidders have expressed interest in buying the
assets of bankrupt online music-swapping site Napster, an
investment banker handling the bidding process said on Monday.
Rick Chance, managing director at Trenwith Securities, the
investment banking unit of BDO Seidman LLP, said that the bids
will be analysed and the bank will provide a recommendation to
Napster's official creditors committee later this week. Bidding
will close for Napster's assets on September 17.
IFPI ANNOUNCES 'OPTIONAL' COPY CONTROL SYMBOL FOR CDS

IFPI today announced the introduction of a new, optional logo
that record companies may use to inform consumers that a CD
incorporates technology to control copying. The logo is available
for use by record companies internationally, and is being
announced in consultation with IFPI's national associations in 46
countries, and with music retailers worldwide. It could feature
either on the artwork of the CD or as a sticker, and may be
accompanied by additional information about the technology being
used.
