Hello subscribers, welcome to the October 18th edition of the
Music Biz Academy Digest!

TAKE A DEEP BREATH...
WhoooWeeee.... It's been absolutely crazy nuts around here. As I
mentioned last week, I was invited to participate on a panel at
the New Nashville Music Conference (2NMC) last weekend. I had a
GREAT time, but as always, there's a price to be paid for leaving
the office - and that's coming back. Over 1300 emails were
waiting for me when I got home. I'm still sorting through them
all. My general rule of thumb is this - for every day I'm out, it
takes two to get back to the 'normal' pace of things, which is
only slightly less frantic.

Due to this fact, I'm going to forego my usual lengthy commentary
on the latest industry news. However, I will want to point out a
few interesting stories from the past two-three weeks.

Remember the HR 5469 Bill? The one introduced into the U.S. House
of Representatives that would postpone the payment due date for
new webcasting royalty rates by six months? Well, I don't know
the whole story yet, but apparently the bill went from one
paragraph to 28 pages, and contains much more now that was
originally intended. Frankly, this whole issue has gotten to the
point that it's hard to sort out truth from fiction. View the

Now, according to the most recent news I found in 'The Register'
(link below) this afternoon, the bill, which passed in the House
earlier this week, just died in the Senate. I am still trying to
confirm if this is fact. Based on my understanding of the new
version of the bill, which is an RIAA-negotiated settlement, this
may indeed be a good thing. But, which side you take on that
issue depends on who you listen to.

In a surprise move, MusicMatch Jukebox, one of the most widely
distributed third-party digital music players, dropped support
for the Macintosh version of its product and is focusing solely
on Windows. This is a really startling move in light of the
general perception (or at least, *my* general perception) that
the Mac has been regaining some of it's popularity.

labels. Well, no more. MusicNet and PressPlay are back in the
news, and are both very close to securing catalogs of music from
all five of the major music labels as well.

Finally, in what is HUGE, but relatively unreported news, Liquid
Audio sold it's digital rights management patents to Microsoft.
Think about the possibilities if Microsoft uses Liquid Audio's
technology to try and *standardize* the secure distribution of
music and media via the Internet. Liquid Audio's technology, or a
variation of it, would be built right into your future Windows
operating system. Ponder that for awhile. And Microsoft only paid
$7 million for the rights.

NAPSTER OR NOT, FILE SWAPS CONTINUE

KAZAA OUT OF U.S. ANTI-PIRACY GRASP?

The New York Times recently reported on the geographic factors at
issue with the entertainment industry's lawsuit aiming to shut
down Sharman Networks' Kazaa file-sharing service. While Sharman
is incorporated in the South Pacific island nation of Vanuatu,
its offices are in Australia and its servers are in Denmark,
making applying U.S. copyright laws a difficult matter. The
article goes on to point out that even if the entertainment
industry is victorious in its litigation, "enforcement of any
judgment may rely entirely on legal authorities in other nations,
and their cooperation is not assured."


YOUNG BAND, DERAILED DREAM

It was a moment few young musicians get to savor. Dry Cell had a
recording contract with Warner Brothers Records, which had spent
$325,000, by its account, on the group. The group's first single,
"Body Crumbles," was playing on radio stations across the
country, and its debut album, "Disconnected," was slated to hit
stores in August. But within 48 hours, the euphoria disappeared.

It's a given that popular music is in a rut. Radio listenership,
concert attendance and record sales are all down from boom-year
peaks. The teen-pop mania that knocked grunge rock aside has
itself stalled out, with no new phenomenon rising up to replace
it and re-energize music fans. Slumps such as these are nothing
new; punk and new wave helped pull the trade out of a creative
and commercial trough in the late 1970s. But there is a
noticeable difference between today's malaise and those of
decades past, in that unhappiness with the state of things has a
new and very large target: Clear Channel.


NAPSTER CREATOR PONDERS HIS LEGACY

Shawn Fanning, at 21 years old, has already created something of
significance, nurtured it and watched it die. His music-sharing
software program Napster caused panic in the recording industry
when it showed up on the Internet in 1999, only to be shut down

Fanning, who quit college as a freshman at Northeastern
University in Boston and who has no current plans to return to
school, says he’s not ready to jump back into the online music

Absent the penalty of perjury, Major Label lawyers testified to a
panel of senators in Los Angles that most artists are happy with
their recording contracts. The panel, held this past Tuesday, was
assembled to entertain arguments as to whether legislation might
be necessary to keep major record labels honest when reporting to
their artists the amount of money earned on their exclusive
record contracts. If enacted, this would be the beginning of
government regulation of the music business; a concept that,
ironically, artists are initiating.

evaporating, mud-choked, puddle. Every month, millions of songs
are effectively stolen and swapped online using file sharing
software with zero compensation going to the artists or record

internet. The record labels, in their effervescent stupidity,
will continue trying, without success, to regulate the internet
(impossible) rather than develop a workable business plan to sell

SCRATCH OFF THIS CD REPLACEMENT

DataPlay, which hoped its secure media format would replace the
compact disc, has shut down and is looking for a buyer.
DataPlay, which had raised $120 million from supporters including
photography giant Eastman Kodak and chipmaker Intel, needed $40
million to $50 million to complete the next phase of operations.
DataPlay's discs are about the size of a quarter, can hold up to
500MB of data--or 11 hours of music--and include security
features to prevent unauthorized copying of music.


MUSICMATCH DROPS THE MAC

MUSICNET AND PRESSPLAY CLOSING IN ON LABELS

MusicNet and Pressplay are close to rounding out their music
offerings with deals that would allow them to provide songs from
all five major labels. Pressplay announced Monday that it signed
a deal with BMG and said it is close to reaching an agreement

Universal, already has a deal with EMI Recorded Music. Meanwhile,
sources close to MusicNet said it's completed a deal with UMG and
is within days of striking an agreement with Sony.

industries are asking your school to pull the plug on you.
The Recording Industry Association of America, the Motion Picture
Association of America and other copyright-owners' groups sent a
letter Tuesday (October 8) to more than 2,300 colleges and
universities to inform them of the legal issues surrounding
on-campus file-sharing. The letter also asks for the colleges'
help in their fight against file-sharing and offers ways to stop
it.


MUSICMATCH UNSEATS CLEAR CHANNEL AS #1 NET RADIO NETWORK

radio network measured by MeasureCast, unseating Clear Channel
Worldwide for the second time. Clear Channel streamed 1,156,853

de1ivered 1,196,413 hours to an audience of 358,824. The first
time MUSICMATCH won the top network spot from Clear Channel was
during the week of August 19.


REGISTER OF COPYRIGHTS DENIES BROADCASTERS' MOTION FOR A STAY

The U.S. Copyright Office has rejected an application by a number
of broadcasters for a stay of its ruling that clarified that the
retransmission of an AM/FM broadcast signal over the Internet is
not exempt from paying webcaster royalties for streaming the
songs online. Broadcasters had sought the stay because they
believed it would relieve them from the requirement to pay
statutory royalties, which kick in on Oct. 20.


SATELLITE RADIOS HEAD FOR USED CAR LOTS

Satellite radios are gearing up for a big showing on the car lot
circuit. XM Satellite Radio unveiled plans Wednesday to supply
thousands of independent car dealerships, including used car
lots, with $400 satellite radio receivers to offer to their
customers. The receivers are made by Audiovox, according to XM
Satellite Radio spokesman Chance Patterson. "This gives us a new
selling opportunity through a huge network of independent auto
dealers, " Patterson said.


GLOBAL RECORDED MUSIC SALES DOWN 9.2%

World sales of recorded music fell by 9.2% in value and by 11.2%
in units in the first half of 2002. Sales of CD albums, the most
popular format worldwide, saw a 7% fall. Single sales also
dropped, by 17%, while cassettes continued a long-term decline,

MUSIC SWAPPING ON THE NET RISING

As broadband takes off, so does music swapping. The number of
users taking advantage of illegal file-sharing on the net is on
the rise, according to new figures from analyst firm Jupiter
Media. Music accounts for the lion's share of file swapping and
analysts warn that unless the industry offers real alternatives
soon, the legitimate digital music industry will be stillborn.


BOB DYLAN SUES MP3.COM

There'll be no Mr Tambourine Man for MP3.com if the outcome of a
lawsuit against the Vivendi Universal site finds in favour of Bob
Dylan and other music stars. Rock stars Bob Dylan, Billy Joel and
James Taylor have filed a lawsuit against Vivendi Universal's
MP3.com music Web site for allegedly distributing their songs
without authorisation, sources familiar with the suit say.
A spokesman for MP3.com declined to comment.


WARNER BROS THREATENS CANADIAN GROKSTER USER

MediaForce, a hired Warner Net security firm which uses its
mediaSentry to automatically scan p2p nets for "copyrighted
works," has targeted a Canadian Grokster user for alleged
copyright infringements. mediaSentry trawls the Net looking for
'illegal' file sharers and when it finds one, shows the p2p app
and sharers' IP addies. Address owners are then Whois-ed,
MediaForce contacts the ISP or block owner involved and the
downloader gets a 'Stop it or Else' notice. A very basic app, but
good enough for MediaForce.

An adapted version of HR 5469, which had originally called for a
six-month moratorium on the imposition of fees, passed the House
today, October 7, after the RIAA and small webcasters came to a
sensible agreement. Rather than impose the fee schedule
determined by the the U.S. Copyright Office, which would have
charged small web broadcasters between $125,000 and $500,000 a
year to stream, the RIAA will collect whichever is the greater of
a minimum annual payment of $2,000, eight percent of gross
revenues or five percent of expenses."

Music companies tried to persuade a judge Friday to let them
obtain the names of people suspected of trading music files
online without going to court first, a move that could dictate
how copyright holders deal with Internet piracy in the future.
U.S. District Judge John D. Bates, who heard the case, lamented
ambiguities in the Digital Millennium Copyright Act, which was
enacted to uphold copyright laws on the Internet while shielding
technology companies from direct liability.

Verizon Communications faced tough questions from a federal judge
on Friday as the telecommunications giant sought to resist being
drafted as the recording industry's copyright policeman.
Claiming that the privacy of its users and the viability of the
Internet itself were at stake, Verizon argued that it should not
have to kick off customers who use "peer to peer" services like
Kazaa and Morpheus to download songs for free, and should not be
required to monitor its users' activities.

The rise and fall of music download site Napster, which brought
the music industry to its knees and made a star of its young
founder Shawn Fanning, is to be turned into a film.
MTV has confirmed it plans to make the film, having acquired the
exclusive rights to the life story of Mr Fanning, who created
Napster on a laptop in his uncle's house when still a 19-year-old
student. Alex Winter, who starred in Bill and Ted's Excellent
Adventure with Keanu Reeves, has been signed up to direct the
film and MTV said Mr Fanning may play himself.

British and Irish music fans scrambled for a piece of the action
on Thursday as some of the music business' heavyweights opened up
their archives for free downloads in a bid to combat Internet
piracy. But "Digital Download Day" - part counterstrike, part
marketing ploy - proved almost too successful as the host
Internet site slowed to a near-standstill under the sheer weight
of surfers trying to claim their download "voucher." Devised by
OD2, a technology company co-founded by recording artist Peter
Gabriel, the "Day" is in fact a weeklong venture offering access
to 100,000 tracks from 6,000 artists including ColdPlay, Dido and
Elvis Presley.

In a fight to win back fans from the "grey zone" of online
song-swapping services, the music industry is borrowing a trick
from its nemeses: free music downloads. For one week beginning on
Thursday, music fans in Europe will be able to download, stream
or burn onto their hard drives a selection of tracks from 6 000
artists including ColdPlay, Dido and Elvis Presley. It is part of
a marketing ploy called "Digital Download Day" devised by British
firm OD2, a technology company specializing in digital music
distribution and co-founded by recording artist Peter Gabriel.

The world's five largest music companies and the three largest
music retailers will pay $143.1 million to settle a CD price
fixing case launched by New York and Florida two years ago.
In August 2000, most U.S. states joined in a lawsuit alleging
that an industry practice called "minimum advertised pricing''
(MAP) artificially inflated the price of CDs between 1995 and
2000, violating federal and state anti-trust laws. Under MAP, the
labels subsidized advertising for retailers that agreed not to
sell CDs below a certain price.


LIQUID AUDIO UNLOADS INTELLECTUAL PROPERTY ASSETS

the air, and on the verge of liquidation just last week, digital
music distribution player Liquid Audio Monday got a helping hand
from Microsoft . Microsoft played the white knight by buying up

$7 million.
