Hello subscribers, welcome to the November 14th edition of the
Music Biz Academy Digest!

IN CASE YOU MISSED IT....
BMG and EMI received some unwanted attention in the news last
week due to their rather interesting responses to customers on
the issue of copy protection technology used on retail CD
releases in Europe.

In BMG's case, their response stated matter-of-factly that if
your copy protected CD won't play in your CD player, it's because
their copy protection technology is reacting to a 'special new
technology' included with CD burners. The problem is, this
'special new technology' is also apparently used on stereos that
don't have CD burning capabilities. BMG's advice if you have
problems playing the CD? Use another CD player. To quote BMG,
'our copy protection is according to the Red Book Standart,'
(spelling theirs). In other words, it's not their problem.

While BMG's response simply minimized the issue, taking little,
if any, responsibility, EMI's response was quite different. EMI's
customer service rep came right out and, well, in a round-about
way called it's customer a pirate. To quote (this is translated
from German):

"The case you are reporting that even multiple players refuse to
function can, in our experience, only originate from the realm of
fairytales."

(Ouch!)

"...we fear that these facts don't interest you at all. Because
these measures mean the end of free music, something that must
cause you much grief..."

(So what are you saying?)

"If you plan to continue protesting about future audio media
releases with copy protection, forget it; copy protection is a
reality, and within a matter of months more or less all audio
media worldwide are copy protected....In order to make this
happen we will do anything within our power - whether you like it
or not."

Nice, huh?

I would like to say the reason the EMI representative responded
so curtly was because the customer was being argumentative,
irritating, unreasonable, or just plain aggravating. But, in
viewing the original exchange, I saw that was not the case.

were simply, and quite calmly, expressing their frustration.

In New York, lawmakers proposed a bill that could open the door
on free-agency contracts for recording artists. The bill would
limit recording contracts to seven years, and "establish time
limitations on the enforcement of contracts with the aim of
protecting the artist's freedom of expression from unreasonable
and unduly restrictive covenants." The RIAA dismissed the bill,
stating lawmakers should not do "anything to further harm an
industry that is experiencing difficult business times,
particularly if it means creating a new law to regulate contracts
between private parties."

RIAA OPPOSES NY ARTISTS' BILL

Everywhere we look, we see the music industry fighting tooth and
nail to protect copyrighted works, prevent piracy and stop
illegal distribution of copyrighted music. With all this going
on, it's fascinating to see President Bush sign H.R. 2215 into
law. This bill, which covers wide variety of unrelated issues,
also includes an amendment (S. 487) that allows educators to use
online music, movies and other copyrighted materials for
"mediated instructional activities," without permission from or
payment to copyright holders.

NEW COPYRIGHT LAW FREES EDUCATORS TO USE COPYRIGHTED WORKS

While not exactly newsworthy (but still interesting), a recent
poll conducted by Billboard revealed that 42% of respondees
stated they would be more willing to purchase a CD if it
included additional perks such as unreleased songs or concert
ticket offers. Is this really any surprise? The Christian music
industry, one of the few markets making a profit these days, does
this very thing. Buy a contemporary worship CD and with it you
will commonly receive free lyric sheets, guitar tablature, and
alternate, acoustic versions of songs in MP3 format - all
included on the disc. This is one area where the Christian music
industry is truly ahead of the secular market.

Deeply stung by chairman Hilary 'Reach Out' Rosen's ignominious
defeat at the recent Oxford University 'Free Music' debate, the
Recording Industry Association of America (RIAA) emailed Declan

One mad consumer relations team might be an isolated incident,
two begins to look like a trend. The dismissive response
Bertelsmann Music Group's copy protection team recently issued to
a consumer's query essentially boiled down to, 'all Cds will be
copy protected, it's not our problem that they won't play on some
devices, so tough.' But apparently, it's a competition. EMI
Germany is taking pretty much the same attitude, and its
humorously-tagged Consumer Relations team is calling the
customers pirates while it's about it.

MTV has never exactly been a model of decency. Years of "Beavis

Hell hath no fury like Joni Mitchell (news) on the subject of the
music industry. The veteran singer/songwriter, on the promotional
trail for a new album, says she is "ashamed" to be part of the
music business and may stop recording. "I just think it's a
cesspool," the 58-year-old folk-rock icon said in the latest
issue of Rolling Stone magazine. "I would never take another deal
in the record business, which means I may not record again, or I
have to figure out a way to sell over the Net or do something
else."

PRESSPLAY ADDS WARNER TO COMPLETE CATALOG

Sony Music Entertainment and Universal Music Group's Pressplay
music subscription venture on Wednesday said it had reached a
deal to provide content from Warner Music Group, giving the
online service music from all five major labels. "Today is a
momentous day. We've accomplished what we set out to do and,
while it took a little longer than we expected, we've managed to
get all five labels by year-end," said Michael Bebel, chief
executive officer of Pressplay.


EMI LICENSES MUSIC CATALOG

EMI announced Wednesday it has expanded its online music
distribution program to offer more CD burning options and song
downloads. In the past, EMI's online music selection, sold
through distributors such as MusicNet, pressplay and Listen.com's
Rhapsody service, was somewhat restricted in that the music only
could be listened to as long as the service subscription was
active or as streamed audio content tethered to the desktop.
Beginning Dec. 1, online music buyers will be able to burn songs
from EMI's catalog up to three times to blank CDs or transfer
them to a limited number of portable digital music players that
can play the files.


LIQUID AUDIO ENDS MERGER PLAN

Those trying to shut down Liquid Audio scored another win in
their battle Monday. Bowing to shareholders, the company said
it's ending a proposed merger agreement with Alliance
Entertainment. The companies said they mutually agreed to end the
merger plan after a large number of Liquid Audio shareholders
opposed the proposal. Dissident shareholders have been fighting
to shut down Liquid Audio and liquidate its assets for some time.


THE SONG'S OVER FOR CDNOW: LAST EMPLOYEES SET TO GO

CDNow, we'll see thee later. The online music retailer that was
born in the Philadelphia suburbs in 1994 is set to vanish from
the local landscape. CDNow's parent company, BeMusic Inc., a unit
of the German media giant Bertelsmann AG, has notified the
Pennsylvania Department of Labor and Industry that it will lay
off the last 33 workers at the cavernous CDNow facility in Fort
Washington on Dec. 27. BeMusic spokeswoman Melinda Meals said,
however, that there is no plan to shut down the popular CDNow.com
Web site, which still gets millions of visits per month from
music and video shoppers.


POLL: CD PERKS ENCOURAGE BUYERS

private Web site, unreleased music, and ticket offers make buyers
more willing to purchase the album, according to a recent
Billboard.com poll. 42% of 5,000 voters said such extras prove

offset the price of CDs.

ago Bertelsmann Music Group bravely gave in and promised to
replace a clutch of Natalie Imbruglia CDs which were protected by

all its music products.

The U.S. Copyright Office announced on Tuesday that President
Bush on Saturday signed into law the 21st Century Department of
Justice Appropriations Authorization Act (H.R. 2215), which
includes the Technology, Education, and Copyright Harmonization
(TEACH) Act. The amendment allows professors to use online music,
movies and other copyrighted materials for "mediated
instructional activities," without permission from or payment to
copyright holders. It also re-establishes this particular "fair
use" of a copyrighted work -- still preserved for non-digital
copyrights -- that was made illegal under 1998's Digital
Millennium Copyright Act.


NAPSTER GETS FINAL APPROVAL FOR LOAN

Napster Friday won final approval of a $250,000 loan that the
debtor company will use to cover expenses while it negotiates a
sale of substantially all of its assets in a proposed $5 million
deal. Napster, the bankrupt Internet music provider, projects
$200,000 in costs through Nov. 22 and $50,000 through Dec. 24,
according to a budget submitted to the court. Without the loan,
the company would have to liquidate its assets.


ONLINE MUSIC SALES PLUMMET

Online sales of recorded music have plummeted 25 percent through
the third quarter, dropping even faster than the overall U.S.
music market, according to a survey to be released today.
The survey appears to lend support to the contention by record
labels that free, online music-swapping networks such as Kazaa
and Morpheus are undercutting music sales. In the first half of
the year, online sales of music fell to $424 million, a drop of
20 percent from the same period last year, according to data
collected by ComScore Networks, which electronically monitors
consumer habits.


RIAA SEES NO FUTURE FOR N.Y. ARTISTS' BILL

The Recording Industry Association of America (RIAA) expressed
doubt yesterday (Oct. 31) that artists' rights legislation
introduced Monday in the New York State Assembly will garner the
support it needs to pass into law. The proposed Artistic Freedom
Act, which is being supported by the American Federation of
Television and Radio Artists, the American Federation of
Musicians, and the Artist Empowerment Coalition (AEC), would
limit to three years the length of recording contracts for
artists without qualified legal counsel and seven years for those
with representation.


LISTEN.COM SECURES CD BURNING LICENSE FROM BMG

Listen.com today announced a new agreement with BMG, the
worldwide music division of Bertelsmann, AG, that will enable
Rhapsody subscribers in the United States to purchase and burn
tens of thousands of tracks from BMG's extensive digital catalog
of titles. This license builds on Listen.com's existing
relationship with BMG, which earlier this year announced an
agreement to offer its recordings through Rhapsody.
BMG joins Warner Music and Universal in providing Listen.com
subscribers with burning capability.


'ARTISTIC FREEDOM ACT' PROPOSED IN N.Y.

New York lawmakers have proposed a bill that could open the door
on free-agency contracts for recording artists. The Artistic
Freedom Act was introduced Monday by New York State Assembly
Speaker Sheldon Silver, a Democrat, with the backing of powerful
unions such as the American Federation of Television and Radio
Artists and the AFL-CIO. New York State Assembly members Roger L.
Green, Joe Morelle and Catherine Nolan, all Democrats, also
signed on to the bill, which would limit recording contracts to
seven years.


INDUSTRY CLAIMS ONLINE PIRACY VICTORY OVER MADSTER

The US recording industry has claimed a victory in one round of
its legal assault against online piracy after a federal judge
granted a preliminary injunction against file-swapping service
Aimster, which recently changed its name to Madster. The
Recording Industry Association of America (RIAA) said judge
Marvin Aspen of the US District Court for the Northern District
of Illinois on Wednesday night ordered Madster to implement
filtering technologies so that it does not infringe on
copyrighted works over its network.


EMI TRACKS SONGS USING 'AUDIO FINGERPRINTING'

EMI Recorded Music on Tuesday agreed to use audio fingerprinting
technology from Audible Magic to identify and track licensed and
unlicensed online usage of its song catalog. Audible Magic's
technology aims to get around the problem of matching digital
copies of songs that do not use a universal naming convention or
format. Audio fingerprinting captures characteristics of a song
that can be compared to files found on peer-to-peer networks and
elsewhere regardless of the file name or type. The companies said
they expect to begin implementing an audio fingerprint system by
the end of the year.
