Hello subscribers, welcome to the November 29th edition of the

IN CASE YOU MISSED IT....
The biggest news of recent days is the 'revitalization' of what
once was Napster, the Internet's one-time premier file-swapping
service. The court cleared the way for Roxio, a company that
makes CD and DVD burning software, to purchase what is left of
Napster for a mere $5 million dollars. The deal has given Roxio
all of Napster's intellectual property rights, including the
right to use it's trademark, name and technology. Best of all for
Roxio, they don't inherit any Napster's legal and financial
obligations resulting from lawsuits.

NAPSTER'S ASSETS GO FOR A SONG

The newswires have also been a-buzz with stories on file-swapping
service Kazaa. The The Recording Industry Association of America
(RIAA) has been wanting to sue Kazaa for it's part in encouraging
the file-swapping and downloading of copyrighted works online.
The trouble is, Kazaa isn't located on U.S. soil. It's parent
company is headquartered in Australia, and the business is
incorporated in the Pacific Island nation of Vanuatu. Recent
comments made by the court judge have led some to speculate the
court is leaning toward judging in favor of the RIAA, which would
allow them to sue. That would extend the court's jurisdiction
*beyond* U.S. borders and over foreign-based companies. What's
ironic about this is that a U.S. court just ruled that foreign
powers are not allowed to sue U.S. companies in a French case
against search directory Yahoo!

KAZAA LIKELY TO FACE US LAWSUIT

In an effort to stop file-trading at it's source, many Internet
service providers in the U.S. and Canada are considering putting
bandwidth limits on subscriber services. If people know they have
only a limited amount of bandwidth available, the thought goes,
they may be less likely to download as many files or to allow
people to upload songs and music from their computers.

In the meantime, record companies are beginning to benefit from
file download technology. Universal Music has announced that it
will make more than 43,000 songs available for download at retail
outlets such as Best Buy, Circuit City, Tower Records, and
MP3.com. These songs will be available for purchase for .99
cents per track or $9.99 for an entire album. This comes on the
heels of our report last month that PressPlay, a joint venture of
Sony and Universal Music, would become the first online music
subscription service to allow consumers to buy and burn songs
from all five major recording labels. Record companies are
*finally* catching up to customer demands.

NAPSTER'S ASSETS GO FOR A SONG

Napster will rise again -- sort of -- thanks to a software
company that makes CD-and DVD-burning software. The company,
Roxio, purchased the company's intellectual property for $5
million on Wednesday, rescuing it from bankruptcy court, where it
had languished since June. Roxio's plan is to create a
subscription music service that can be combined with its
software. "Roxio has received ... all of Napster's intellectual
property including but not limited to the name, trademarks,
domain name and their extensive technology portfolio," the
company said in a release.


KAZAA LIKELY TO FACE US LAWSUIT

A US federal judge has hinted that he is likely to allow US
record companies and movie studios to sue the Australia-based
parent company of Kazaa, a popular online file-swapping service.
Because Kazaa's parent company maintains headquarters in

argued it should not be subject to a lawsuit in the U.S. but, if
Judge Wilson's statements in court provide any hints, he is
leaning towards the Recording Industry Association of America

RIAA PROMPTS SEIZURE OF U.S. NAVY COMPUTERS

seized nearly 100 midshipmen's computers that allegedly contained
illegally downloaded music and movies. Sources close to the
investigation, said the raid occurred Thursday while students

Industry Association of America (RIAA), said that the Naval
Academy was among the colleges and universities around the
country that were sent two letters from entertainment industry
and educational associations asking them to address Internet
piracy and establish policies against it.

AMAZON.COM TO TAKE OVER 'BACK OFFICE' OF CDNOW

U.S. LIABILITY LOOMS OVER KAZAA

A Los Angeles federal judge heard arguments Monday as to whether
record companies and movie studios can sue the parent company of
Kazaa, the most popular online file-swapping service, in the
United States. Much of Kazaa's future, from a business and legal

BMG PLANS TO SIMPLIFY ROYALTY DEDUCTIONS

BMG announced an overhaul of its accounting practices for
royalties yesterday, a move that it said would assuage concerns
that performers are being shortchanged on their earnings.
But while some artists and their representatives applauded BMG

still needed to change other accounting methods and better
compensate performers for their work. BMG said that beginning
next year it would eliminate contract deductions it typically
takes off the retail price of a CD for items like packaging, new
technology and free goods for retailers. Instead, BMG will
calculate the royalty rate on the lower wholesale price.
The new method will not change the amount of the royalties.


UNIVERSAL MUSIC KICKS OFF DIGITAL DOWNLOAD PLAN

SMALL WEBCASTER ROYALTY RELIEF BILL PASSES IN SENATE, HOUSE

The Small Webcaster Settlement Act (SWSA), a revised bill that
would give small and noncommercial webcasters a break on the
royalties they have to pay artists and record labels to stream
music online, passed in the Senate and House late Thursday, and
now awaits President Bush's approval to become law. The language
of the bill does not actually set lower rates, but provides that
small webcasters and SoundExchange, the recording industry entity
that collects such royalties, may negotiate their own agreements
independent of the Librarian of Congress' determination of rates.
It also places a six-month stay on payment of any royalties by
small webcasters while an agreement can be negotiated.


XM RADIO CUTS 80 JOBS TO SAVE MONEY

Washington's XM Satellite Radio Inc. laid off 80 employees this
week, the company announced yesterday, as the critically
acclaimed but money-losing subscription-radio service attempts to
conserve its cash. The layoffs are designed to satisfy current
investors and lure new ones, said a source familiar with the
cuts. XM has been hailed by music and electronics critics as a
sort of HBO for radio that provides music not heard on AM or FM.
As a business, however, the company still has a long way to go
toward profitability, and it is struggling with enormous start-up
costs.


NEW LIGHT SHED ON UNBREAKABLE ENCRYPTION

Scientists at Northwestern University say they have harnessed the
properties of light to encrypt information into code that can be
cracked only one way: by breaking the physical laws of nature.
This high-speed quantum cryptography method allowed the
scientists to send encrypted data over a fiber-optic line at
250mbps (megabits per second), which the researchers said was
more than 1,000 times faster than what was achievable with
existing quantum technology. "What makes the system so secure is
that an eavesdropper can't tap into it without disturbing the
photons," said Paul Kwiat, a professor of physics at the
University of Illinois at Urbana-Champaign, and a leading
authority on quantum cryptography. "If an eavesdropper disturbs
the photons, then they're gone."


MUSIC GIANTS ARE GOING FOR THE BURN

A flurry of Internet music licensing deals this week gave a big
boost to the legal side of online music, with two major record
labels for the first time allowing consumers to permanently keep
music they pay to download. Warner Music Group announced separate
deals Thursday with MusicNet and Pressplay that would allow
consumers to buy, download and transfer songs from artists such
as Linkin Park and Matchbox 20 to compact discs and portable
devices like MP3 players. With the Warner agreement, Pressplay, a
joint venture of Sony and Universal Music, becomes the first
service to allow consumers to buy and “burn” songs from all five
major recording labels.


NAPSTER POISED FOR ANOTHER COMEBACK

Napster, the controversial online song-swapping service, is set
to rise from the grave yet again after US software company Roxio
revealed it was close to winning an auction for the bankrupt
company's assets. Roxio will pay $5.3m (£3.6m) for Napster's
brand name, technology and logo and will be free of all the
bankrupt company's liabilities, including unresolved copyright
claims, when it emerges from Chapter 11 protection early next
year. Roxio refused to comment on its plans for Napster but it is
expected to relaunch as a service that allows users to purchase
tracks and download them to CD, automatically sending payment to
rights holders.
