Hello subscribers, and welcome to the January 13th edition of the
Music Biz Academy Digest! I hope you had a wonderful, wonderful
holiday season! Here we are already into 2003. Doesn't it just
seem like last year we were sitting around waiting to see if Y2K
was going to end civilization as we knew it? Can you believe it's
been three years?

IN CASE YOU MISSED IT....
Here are some of the more interesting developments in the music
industry during the last two to three weeks:
First, due to recent advances in Internet and digital technology,
the FCC (Federal Communications Commission) has been
brainstorming ways to implement better protections on digital
data, among other things. They are considering, for example,
whether or not to require manufacturers to incorporate copy
protection technology into digital TVs.
The decisions the FCC makes now may effect how, and to what
degree your music is heard and broadcast in the future. For more

THE LAST DJ? FINDING A VOICE ON MEDIA OWNERSHIP

You all probably know by now (it would be hard to miss with all
the press on the subject) that in 2002, CD sales continued to
decline worldwide. Yes, the generation that made Britney Spears a
household name is tiring of her. CD sales from 2002 show that
kids just aren't buying sugar-coated pop like they used to. Only
three albums sold more than 4 millions copies in 2002, as
compared to eight in 2000. For the second year in a row, blank,
recordable CDs outsold prerecorded albums. For an interesting

To make things worse for the industry, classic rock 'n' roll
albums are moving into the public domain in Europe. In Europe,
you see, copyright protection only lasts for 50 years. That's the
case even if the record was made in the U.S. The result is that
recordings released by artists in the early 1950's - like Elvis,
for example - can now legally be re-released by any label in
Europe.

On other legal fronts, Sen. Russ Feingold (D-Wisc.) announced
that he is moving forward with legislation to investigate alleged
anti-competitive behavior by radio and concert giants, including

And, in a *really* interesting twist, the judge preceding over
the recording industries case against Kazaa for music copyright
infringement has given the go-ahead for the suit. The defendant,
Sharman Networks, who owns Kazaa, thought themselves exempt from
U.S. law since they are a foreign company. Not so, said the
judge, who stated the that since most Kazaa users are in the
U.S., the lawsuit can go forward.
Kazaa, in case you don't know, is the world's most popular
file-sharing network. Over 163 million people have downloaded the
software, primarily to trade music over the Internet. At any
given time more than 3 million people are running the program.
That's twice the number Napster could boast in its prime.

Finally, though the RIAA has received its share of negative
press, there's been even more than usual lately. The UK's Net
Industry nominated the RIAA for the 2002 'Internet Villain Award'
for "supporting 'right to hack' proposals and other unworkable
solutions to curb copyright abuse." The RIAA will find out on
February 20th whether they actually won. I wonder if they will
put that in their trophy case?

over the RIAA press release page and announced it wished to be
"an Oscar Meyer Weiner." The second time, just this week, the
site was defaced to include a list of 'recommended' file-sharing
tools, including Kazaa.

is increasingly reconciled to the fact that the current

The Recording Industry Association of America may not want people
to share digital files, but the organization certainly seems to
be in favor of open access to its website. On Monday, the RIAA
site was hacked for the sixth time in six months. This time, the
defacement resulted in bogus press releases on the front door,
touting the joys of cheese and interspecies romantic
relationships. Some security experts said in no uncertain terms
that the latest defacements indicate the RIAA is clueless about
technology. "It's obvious that they don't get the Web, and they
don't get technology, or they'd understand how to protect their
own website," said Wall Street systems administrator Anthony
Negil.
CD INDUSTRY LACKS FORMULA FOR SUCCESS

Did you get a CD in your Christmas stocking this year? The
recording industry sure hopes so. But even if you purchased some
of the 624.2 million CDs sold in the United States as of Dec. 22,
record labels and retailers are not happy with you. Not happy at
all. Holiday numbers notwithstanding, the industry saw album
sales drop at least 9 percent in 2002 - following a 2.5 percent
drop the year before. These are the first years in which sales
drops have been recorded since Soundscan began tracking in 1991.

KAZAA SUIT GETS JUDGE APPROVAL

A federal judge has given record companies and movie studios the
go-ahead to sue the parent company of Kazaa, a popular online
file-swapping service. U.S. District Judge Stephen V. Wilson
refused to dismiss a copyright infringement lawsuit against
Sharman Networks Ltd., which had argued that it could not be sued
in the United States because it is based in Australia and
incorporated in the South Pacific nation of Vanuatu. In a 46-page
ruling issued Friday, the judge said Sharman is subject to U.S.
copyright laws because it has substantial business dealings in
California and its actions are alleged to contribute to
commercial piracy within the United States.
RAIDS RECOVER ORIGINAL BEATLES TAPES

Police appear to have recovered about 500 original Beatles tapes,
including some never-released tracks, that were stolen in the
1970s, during raids that took place on January 10th on members of
a piracy racket in England and the Netherlands. British police
said the tapes were "priceless." Dutch police, who found the
tapes in the Netherlands, agreed, but said analysis of the
material was ongoing.
RIAA DEFACED -AGAIN!

Reader reports are flooding in that the RIAA.org has been defaced
- again. At time of writing, the site appears to be down, and
several readers have been kind enough to include screen grabs.
Underneath the greets, there is a list of RIAA 'recommended'
file-sharing tools, such as KaZaA and eDonkey. Downloads from
these sites are 'sponsored by www.riaa.org'. The RIAA site has
been hacked four times in recent months. Surely, they should have
figured out how to put a stop to this by now?
MUSIC LABELS LOSE BID TO DISMISS CD DEFECT SUIT

Sony Corp., Vivendi Universal SA's Universal Music and other
music labels lost a bid to dismiss a suit alleging the companies
conspired to sell defective compact discs that don't play on
personal computers. The record labels sought to dismiss the suit
under a California law intended to prevent the suppression of
free speech. The companies claim product labels and advertising,
including any alleged failure to warn, are protected by the First
Amendment.

ticket prices, shrinking playlists, and a "shakedown system" of
money demands to have new recordings even considered for airplay.
FEW CLAIMING CD SETTLEMENT MONEY

Suppose someone was handing out $20 bills and almost nobody
wanted one? That's roughly what's happening with a massive
price-fixing settlement involving states and compact disc
companies. The deal calls for payments of as much as $20 for
customers who bought CDs between 1995 and 2000. But so far, only
a few people have signed up, and officials fear the money will go
begging.
SALES SHOCKER FROM EMI

Music publisher EMI's CD sales in the world's most important
market, the United States, slumped by 28% last year according to
figures released last night. The company had warned of a fall but
it was much worse expected. EMI was the only one of the world's
big five music companies to lose significant market share.
Universal Music Group, a division of Vivendi Universal,
reinforced its position as the number one album producer,
increasing its share of the US market from 26.4% to 28.9%.
EMINEM ENDS YEAR ON TOP, BUT ALBUM SALES TUMBLE

Eminem's "The Eminem Show" was the top-selling U.S. album of 2002
with sales of 7.6 million copies, according to year-end figures
released by Nielsen SoundScan. The soundtrack to the rapper's
film "8 Mile" placed fifth on sales of 3.5 million units. Still,
total CD album sales were down 10.7% in 2002, marking the
sharpest sales decrease from the previous year in Nielsen
SoundScan's 11-year tracking history.

European copyright protection is expiring on a collector's trove
of 1950s jazz, opera and early rock 'n' roll albums, forcing
major American record companies to consider deals with bootleg
labels and demand new customs barriers. Already reeling from a
stagnant economy and widespread downloading of copyrighted music
from the Internet, the recording companies will now face a
perfectly legal influx of European recordings of popular works.

According to an official statement issued by the Recording
Industry Association of America today, "I wish I were an Oscar
Meyer Weiner … do you eat cheese?" Which is pretty bizarre even
by the standards set by the RIAA's recent communications.
Of course, this hasn't been issued by the RIAA at all. It's a
defacement, only a slightly more creative one than usual. In a
novel twist the hackers created a form allowing submissions to
feed directly into the RIAA's own press release page.
