Hello subscribers, and welcome to the June edition of the
Music Biz Academy Digest! Thank goodness summer is finally here.
IN CASE YOU MISSED IT...
It really is amazing to stand back and watch how 'file sharing'
technology, and all the controversial issues surrounding it, is
transforming the music industry. It's not unlike watching a great
experiment in chemistry come to boil: we see the chemical
reactions occurring, we watch the sparks fly with glee, but we
don't know exactly WHAT monstrous creature - or beautiful
creation - might come of the concoction.
We all know the negative impact of file sharing on the Internet.
We're being told via the press all the time. Some are saying the
music industry as we know it won't exist in a mere decade. Just
this week, John C. Dvorak, contributing editor for PC Magazine,
stated "...the game is over. The music industry, as it now
exists, cannot continue."
Is that really such a bad thing? Let's take a look at the
positive...
If you are an independent artist, you should celebrate the many
changes occurring in the industry. The reality that you can be a
successful artist without selling your soul for a record deal is
becoming more the 'norm' and less the 'exception' all the time.
Opportunities abound on the Internet. Through Internet radio,
Kazaa Desktop, MP3.com and dozens of other online venues, your
music can heard by literally *thousands* of people every day, and
that translates to CD sales. I just received an email from a
producer who told me that using the methods he learned from my
book (http://www.promoteyourmusic.com), he sold over 3,000 CDs
from his web site (http://www.sabbatum.com). Thanks to the
Internet, and in some ways 'file sharing', you don't need a major
label record deal to find an audience for your music anymore.
I tell you this to emphasize my point: If you are an independent
artist, I believe the music industry is changing in your favor.
In last month's column, I outlined how iTunes, in very short
order, has created a platform for digital music distribution that
everyone, including the RIAA, is getting behind. This past week
there was another interesting development: Apple, the maker of
iTunes, began to reach out to independent artists. Derek Sivers
of CDBaby.com met with Apple at their request to discuss ways to
include independent artists in the iTunes store. For details on

meeting:
1) Independent artists will get the same deal as major label
artists.
2) Independent artists will get the same treatment as major label
artists.
3) iTunes will not charge independent artists anything to have
their music included in the store.
4) iTunes will pay participating artists every month for sales of
their music.
As it appears now, CDBaby.com will be the sole representative for
unsigned artists, so if iTunes is something you want to be a part

That's something you should be doing anyway.

Here are a few other stories from recent days that have caught my
interest:
Roxio, who purchased the remains of Napster, acquired the
PressPlay music service in May. The acquisition included not
only PressPlay's existing distribution structure, but all 300,000
tunes in its catalog as well as the license agreements already in
place with all five major record labels. Roxio, who hired Napster
founder Shawn Fanning as an adviser earlier this year, plans to
revive Napster as a rejuvenated - and legal - digital
distribution system for music.

How popular is file-sharing? So popular that by the end of May,
Kazaa Media Desktop became the top downloaded software *ever* on
the Internet with over 230 million downloads. Kazaa receives an
average of 366,000 downloads *per day*, compared to an average of
only 50,000 downloads per day for ICQ, which previously held the
title of 'most downloaded software.'

The RIAA filed suit against 19-year-old Jesse Jordon, a student
at Rensselaer Polytechnic Institute in Troy, N.Y., for designing
a campus search tool called ChewPlastic.com. Jesse designed the
system to function as a convenient search utility for the campus
network. But guess what? Kids on campus used the tool to search
for more than just PowerPoint presentations and physics notes -
they used it to download music from the campus network. The RIAA
sued Jesse, stating that in creating a tool that enabled
'widespread music thievery', Jesse himself is, basically, a
thief. Jesse handed over his $12,000 life savings to settle with
the RIAA.

And finally, one of the most widely distributed stories this
month involved the FCC's new media rules. The 'relaxed' FCC rules
allow a single media company to own enough television stations to
reach as much as 45 percent of the U.S. television market. Thus,
a single media entity could own both television stations and
newspapers in most every major market.
The new FCC rules have set off a firestorm of debate, and for
good reason. Do you really want one company controlling most or
all of your news? There's a huge effort in Congress to block the
new rules, so they may never come to fruition.

THE RIAA'S DILEMMA

The RIAA's battle against the P2P networks seems to be bogged
down. Networks such as eDonkey, FastTrack, Piolet, and others are
stronger than ever, as the lashes the P2P community received from
the blows of the RIAA have strengthened their resistance to
attack. Now, while the RIAA contemplates what to do with the
recently gained identities of alleged copyright infringers, they
are faced with the crisis of how to convince a major portion of
the population that what they are doing is wrong.

Recent revelations predict that the music industry is going to
resort to dirty tricks to halt music piracy. These include but
are not limited to (do I sound like a license agreement?)
planting Trojan horses, disabling individual computers, causing
Internet slowdowns through hacking, sending out bogus files
posing as real files, and going into your PC to erase files. You
can read about this in a recent exposé in The New York Times as
well as on many Web sites. Madonna has already taken action by
sending a recording to MP3 sites purporting to be her new song
but actually containing a mean message. Hackers immediately
targeted her site. And with the RIAA gauntlet tossed to the
ground, the wrath of hackerdom will certainly be focused on music
industry Web sites and servers until they beg for mercy.
RIAA GOING THE WAY OF THE DODO?

The RIAA continues to turn up the legal pressure on just about
everybody to combat falling CD sales, blaming the explosion of
downloaded music for plunging revenues, but another, more
plausible explanation lies in industry data. While downloading
music may contribute to the trend of falling CD sales, the
failure of the RIAA business model in the face of a changing
market bears most of the responsibility. The days of big industry
monopolizing the market, giving us a few 'chosen' bands to select
from, charging higher and higher prices for only 'CD quality'
music are numbered. Evolution continues, maybe the RIAA model
will go the way of the Dodo.
WHY THE FCC IS WRONG ON MEDIA OWNERSHIP

On Monday, the Federal Communications Commission is expected to
dramatically ease current limits on media ownership. The move is
supported by FCC Chairman Michael Powell, a majority of FCC
commissioners, and the handful of megacorporations--Disney, AOL
Time Warner, Clear Channel Communications, and Viacom, among
them--that already dominate what we see on TV, hear on the radio,
and read in print and online. Who's against it? Dozens of
groups--from Common Cause and the Consumers Union to the Family
Research Council and the National Rifle Association--representing
tens of millions of members and spanning the political spectrum.
Because, in a democracy, the media isn't just another business.
Instead, it's what we turn to for the ideas and information that
make it possible for us to perform our duties as citizens, such
as voting and being involved in community issues.

For the record business, there's bad news, worse news and even
worse news still. The bad news is that sales of CDs are in a
freefall, representing a $250 million loss over the last two
years. This is where the even worse news comes in. The industry
as it is now — the one that started in the 1890s when the first
commercial recordings hit the market — may simply not be around
in a decade or even less. As music downloading continues to soar
— KaZaA's online file-sharing service leapt by a staggering 1,500
per cent between the summers of '01 and '02 — layoffs are
widespread across the recording industry. Entire divisions — such
as Sony's classical division in Canada — are being pared back.
Such high-priced stars as Mariah Carey are getting dumped. And
the vicious backbiting has begun.

RIAA TAKES TEENS LIFE SAVINGS

On April 3, 19-year-old Jesse Jordan received a call that changed
his life. The freshman at Rensselaer Polytechnic Institute in
Troy, N.Y., learned he was being sued by one of the most powerful
trade groups in the United States, the RIAA. Jordan, an
information technology major, created ChewPlastic.com, the second
most popular search directory on the RPI campus. "You go to the
site, you type in a search term, and it finds files on the
network," Jordan said. Jordan compares his site to Google, the

A research team has unveiled a new system to turbocharge the
Internet, claiming to be able to achieve speeds so high an entire
movie can be downloaded in mere seconds. According to the journal
New Scientist, the breakthrough was achieved by a team from the
California Institute of Technology (Caltech). The team is already
talking to Microsoft and Disney to look into using the system to
deliver high-quality video over the Web. The new system, coined
Fast TCP, can boost download speeds dramatically while using the
existing Internet infrastructure.
VERIZON TO HAND NAMES OVER TO RIAA

Verizon said Wednesday that it will turn over to a recording
industry trade group the names of four anonymous subscribers
accused of illegal file swapping after an appellate panel denied
the company's request for a delay. In a victory for copyright
holders, a panel of the U.S. Court of Appeals for the District of
Columbia refused to intervene in the case and protect the
subscribers' identities while the case moves forward. However,
final victory for the recording industry is still a ways off,
with a pending appeal scheduled for a hearing in September that
could vindicate Verizon.
NONCOMMERCIAL WEBCASTERS REACH ROYALTY RATE DEAL

The recording industry and operators of educational and
noncommercial Web sites have settled on royalty rates for
broadcasting music over the Internet, circumventing a looming
arbitration battle. The deal covers six years, 1998 to 2004, and
sets the range of annual minimum fees webcasters must pay to
broadcast copyright music over the Internet. Depending on the
year, how many broadcast channels a webcaster transmits on and
the type of Web site, the noncommercial webcasters will have to
pay from $200 to $500 annually.
RECORD LABELS SUE MORPHEUS MAKER

The recording industry has filed a new copyright infringement
suit against the makers of Morpheus, a move that comes only a
month after suffering a setback in its legal fight against the
file-sharing service. The new suit involves a Web radio service
never launched by Streamcast Networks. Record labels allege in
the suit that in preparing to launch the radio service,
Streamcast bought thousands of CDs with thousands of songs and
then transferred the music onto a digital database without the
permission of the copyright owners. Streamcast CEO Michael Weiss
called the lawsuit frivolous.
FCC EASES RULES ON MEDIA OWNERSHIP

The Federal Communications Commission on Monday voted 3-2 to
relax rules limiting ownership of TV stations, radio stations and
newspapers, saying that decades-old regulations are obsolete in
part because of the rise of the Internet and other new
technologies. Under the new rules, broadcast networks may own TV
stations that reach 45 percent of the national audience, an
increase of 10 percentage points, and in most cases a company may
now own both a newspaper and a radio station in the same area.
Media mergers still must be approved by the FCC and the Justice
Department.

broadcast ownership rules that are enforceable, based on
empirical evidence and reflective of the current media
marketplace. Today’s action represents the most comprehensive
review of media ownership regulation in the agency’s history,
spanning 20 months and encompassing a public record of more than
520,000 comments. The FCC stated that its new limits on broadcast
ownership are carefully balanced to protect diversity, localism,
and competition in the American media system. The FCC concluded
that these new broadcast ownership limits will foster a vibrant
marketplace of ideas, promote vigorous competition, and ensure
that broadcasters continue to serve the needs and interests of
their local communities.
ALTNET TO PAY KAZAA USERS FOR FILE-SWAPPING

Later this week, Kazaa parent Sharman Networks and marketing
network Altnet will jointly release a new bundle of file-swapping
software that will include a programme that will pay users to be
a part of it. The idea, says Altnet chief executive Kevin
Bermeister, is to harness the computing resources of the tens of
millions of Kazaa users to distribute authorised files such as
games, songs and movies. Giving people an incentive to host and
trade paid files could create a powerful medium for distributing
authorised content and could diminish file-trading networks' role
as hubs of online piracy, he said.

Woolworths has launched an online music preview service that
offers legitimate downloads of albums weeks before their release.
For a small premium, customers can purchase digital copies of
pre-release albums which will be replaced with a copy of the CD

International Federation of the Phonographic Industry (IFPI), is

Store. It also features viewpoints on the piracy debate from a
cross-section of artists, the media and the public, and answers

Less than two years after going live as a legal alternative to
the rogue file-sharing program Napster, the Pressplay digital
music service has been acquired by Roxio and will be relaunched
as Napster. Roxio, known mostly for CD and DVD recording
software, announced Monday it would shell out about $40 million
in cash and stock to acquire Pressplay's distribution
infrastructure and music licensing, which was previously a 50-50
joint venture between Universal Music and Sony Music
Entertainment. For Roxio, the acquisition proves the company is
serious about is stated plans to add legitimacy to the
controversial Napster brand.
DEAL MAY RAISE NAPSTER FROM ONLINE ASHES

Napster, the online music service that unleashed an era of music
piracy before filing for bankruptcy last year, may be about to
make a legitimate comeback. The Universal Music Group and Sony
Music Entertainment are close to a deal to sell Pressplay, their
joint online music service to Roxio, the company that bought
Napster's name and assets last November. Under the proposed deal,
Universal and Sony would take an equity stake in Roxio. Roxio,
would get access to more than 300,000 tracks from the music
libraries of the major labels, and the Pressplay distribution
system. Roxio, which hired Shawn Fanning, the founder of Napster,
as an adviser earlier this year, is expected to revamp the
service with some of Napster's technology and capitalize on the
extraordinary name-recognition the Napster brand still enjoys.

Apple has sold over two million songs from its new music
downloading service in just over two weeks since its debut.
"Response to the iTunes Music Store has been phenomenal. We've
clearly hit a chord with users," said Apple chief executive Steve
Jobs. "We're adding new songs every day, giving music lovers even
more reasons to legally download their favourite music." Apple
jumped into the controversial online music business on April 28
with the new venture that allows customers to download for 99c
per song, without subscription fees. The move makes Apple an
alternative to the free music-swapping services that the industry
has been trying to shut down and those operated by the major
labels, so far with little success.
