-----------------------------------------------------------------

Hello everyone,

I hope you are doing well. I just got a very exciting email from
the Harry Fox Agency this morning - well, exciting to me at
least. Let me explain.

One of my biggest frustrations as an independent musician in
today's high-tech, digital world is the lack of a sensible way to
license cover songs for digital sales and distribution on the
Internet. Sure, I can go through the documental headache of
reporting each and every sale of a music download to each
individual publisher on a monthly basis. That's what the law
requires, but who has time for that? As it is, I can barely find
time mow my lawn.

I can hear some of you saying already, why don't you just report
on a quarterly basis or once a year? Well, because the publisher
has got to give you the OK to do that, and so far, the publishers
I've talked regarding my own cover songs won't. They want MONTHLY
statements.

I have been longing for a simple process to come into being that
would work just like the HFA's current method for getting a
mechanical license for the physical distribution of cover songs
on CDs. You just go over to SongFile.com, search for the song,
click a couple of buttons and all your licensing fees are paid
for. You're legally covered.

Oh, if only licensing cover songs for digital distribution could
be as easy!

And now comes the payoff, the little email I received from the
Harry Fox Agency this morning that just made my day. It all comes
down to two sentences...

"Regarding the online setup, we are in the process of upgrading
www.songfile.com to include the capability to issued DPD licenses
in limited quantity just as we do currently for regular
mechanicals. We hope to make that available in the next few
months..."

At last! I can breathe easy. It's coming.

Now, having spent many years in the software industry,
specifically in support and quality assurance, I know what "a few
months" really means, especially when it's proceeded by the
phrase "we hope." It means that I probably shouldn't expect
anything by the end of summer. But at least a system is in
development.

IN CASE YOU MISSED IT...

Aside from some cool technological advances, news from the music
industry over the last few months has been mostly uninteresting.
However, some recent stories did capture my attention, including
this article about the artist once again known as Prince...

IS PRINCE THE PROTOTYPE?
http://reviews.cnet.com/4520-6450_7-6027793-1.html?tag=nl.e501
When he died in 1991, genius Miles Davis was convinced that the
best hope for the future of music rested in the diminutive hands
of one man: Prince. Fourteen years later, Prince's music is still
going strong, and there's still no one else like him.

Ever wonder what you're going to do when people know longer want
to buy CDs at live performances preferring instead to buy
everything digitally? Just say "Beam it."

'BEAMING' MUSIC TO COMPUTERS, STEREOS, PDAS, & MORE.
http://tinyurl.com/5fdbj
MP3TUNES, A new San Diego-based music company, today introduced a
new music appliance called MP3beamer, which organizes an entire
music collection in one convenient location and then makes the
music accessible from almost any device or location. Once stored
to MP3beamer, the music is universally accessible from computers,
home stereos, PDAs, and portable devices including iTunes
software and iPod players via iTunes.

And here's another reason why I'm anxious to get my "cover tunes"
out there on digital music services...

ONLINE SONG SALES TOP 200 MILLION
http://business.scotsman.com/topics.cfm?tid=248&id=69822005
Online music stores broke into the mainstream in 2004, with more
than 200 million tracks sold in the United States and Europe, a
tenfold increase from the previous year, according to data
released Wednesday. The IFPI said research firm Jupiter expects
the $330 million online music market to double in 2005.

And another...

IPOD'S COMING TO YOUR CAR
http://i-newswire.com/pr12739.html
Apple announced it has teamed up with Mercedes-Benz USA, Volvo,
Nissan, Alfa Romeo and Ferrari to deliver iPod integration with
their car stereo systems in 2005. "Almost every car company in
the world is working to integrate iPod into their cars in 2005,"
said Philip Schiller, Apple's senior vice president of Worldwide
Product Marketing.

And this is obvious, for more reasons than one....

ITUNES ASIDE, WEB IS CHANGING THE MUSIC INDUSTRY
http://tinyurl.com/6ml2c
In one measure of their success, chart-topping rockers The
Darkness have sold enough song downloads, T-shirts and thongs on
their official Web site to nearly finance their next recording.
British rock band Marillion has gone a step further. Since
striking off on its own in 2000, the band has used its site to
raise more than $913,200 (500,000 pounds) from fans to finance
its last two albums and support its first North American tour
since 1995. "The Internet is our savior. Without it, we wouldn't
be what we are today. It's really turned the business around,"
said Lucy Jordache, the band's marketing manager.

And always my favorite story...

CD BABY PASSES $13 MILLION IN INDIE CD SALES
http://www.musicbizacademy.com/cdbaby.htm
If anyone tries to tell you independent music is unimportant, has
no significance, and no market of any value - just them that CD
Baby has now sold over $13 MILLION in independent CDs. That's $13
million in CD sales from 1998 to present. In addition to retail
sales, CD Baby distributes the music of its artist members to
services such as iTunes, Rhapsody, BuyMusic, MSN Music and Sony
Connect at no additional charge.

HOW TO PROMOTE YOUR MUSIC SUCCESSFULLY ON THE INTERNET
http://www.promoteyourmusic.com
Learn the promotion methods one musician uses to bring in over
$5000 a month from the Internet! You can get radio play, grow a
fan base, create a distribution channel and manufacture and sell
CDs all online. Imagine how many CDs you’d sell if thousands of
people heard your music every single day? You could use the
Internet to sell 100, 200 or even more CDs every single month!
Yes, this is possible! The author has accomplished this and more,
and in this book, he details step-by-step how he finally said
good-bye to his day job and starting spending more time on his

SELLING YOUR MUSIC ONLINE: STARTING FROM ZERO
http://www.musicbizacademy.com/internet/gettingstarted.htm
The nice thing about selling your music on the Internet is that
you can get started with very little cash up front. If you
already have a computer and Internet access, you can get going
for as little as $50. Article by David Nevue.

PODCASTING: THE ART OF FEEDING THE BEAST
http://www.musicbizacademy.com/articles/mg_podcasting.htm
As we all know, the Internet is an uncertain world of endless
possibilities and peril. For this generation of artists and
music-industry execs, one paradox reigns supreme: Change has
become a constant. Just when you thought you had seen it all,
along comes something else to turn everything upside down again.
Enter the emerging art of "podcasting." Article by Mike Grebb.

SO YOU WANT TO QUIT YOUR DAY JOB?
http://www.musicbizacademy.com/articles/mara_dayjob.htm
You’re slaving away at your day job, playing your music at night
and on the weekends, and it seems you’ll never have enough time
to write, record and tour when 40 hours of your week are cashed
in for that steady paycheck. You can’t help but think, “If only I
could quit my job to work on my music full time, I’d be able to
make it.” Last year, I had a chance to do just that, and I
learned a few things during my exciting, though sometimes
heartbreaking year of freedom. Article by Mara.

USING PEER TO PEER TO LAUNCH A MUSIC CAREER
http://www.musicbizacademy.com/articles/gman_p2pcareer.htm
The "G-Man" offered all the music on his first album for free. In
fact, he went even farther than that: he contacted thousands of
DJs and remixers, established peer-to-peer filesharing
relationships with them, then offered to send them individual
tracks (bass, synth, vocals, drums, guitar, etc.) if they wanted
to mix new versions of his songs. The results have been
spectacular, involving reviews, remixes, club play, radio play, a
record deal, publishing and licensing agreements, and awards. How
did he do it? Read this article by Janis Amy.

P2P: BOON OR BOGEYMAN?
http://www.musicbizacademy.com/articles/mg_p2pboon.htm
Once upon a time, the band Ten Mile Tide was living a fun but
relatively low-key existence playing local clubs in the San
Francisco area. But by the summer of 2003, something happened.
Their fan base exploded, allowing band members to quit the day
jobs and go out on the road full time. Since then, the band has
sold nearly 6,000 song downloads over the Internet and some
10,000 CDs through all channels. They now each collect a good
salary from the band and just bought a tour bus. How did they do
it? Find out in this article by Mike Grebb.

*NOT* earn $30,000 (or more) with your music alone last year,
let's jump right in and get you started with doing so this

THE LOST ART OF ARTIST DEVELOPMENT
http://www.musicbizacademy.com/articles/dp_artistdevelopment.htm
It's an all too familiar scenario. I open the mail to find a
professional looking, five color printed CD with lyrics and
clever artwork. It looks like product from a major label. I peel
off the shrink wrap and put it on. The same problems are there
over and over again; mediocre songwriting, inconsistent music
style, middle of the road musicianship and production. Article by
David Polemeni.

SELLING YOUR MUSIC ONLINE: A REALITY CHECK
http://www.musicbizacademy.com/internet/realitycheck.htm
I am often asked how much a person can really make selling music
online. I hear both extremes, both from artists who think they'll
use the Internet to make it rich, and others who don't believe
anyone can make any money selling music online. The truth is
somewhere in the middle. Article by David Nevue.

Guitar 9 Records is a hosting service/online store/monthly ezine
for independent artists/bands that feature the guitar as their
dominant instrument. If you're not already familiar with Guitar
9, we urge you (particularly if you're a guitarist with a CD to
market) to take a look at Guitar 9's fine site. Guitar 9 Records
has been around for years, and they have consistently stayed true
to their purpose - promoting independent guitar music on the
Internet (now over 1500 guitar artists). Some of the finest
undiscovered guitar players in the world can be found here, and

MUSIC-JOBS.COM
http://www.music-jobs.com/
As a job seeker in the music industry, you can post your resume
here or view the jobs board. There are quite a lot of job
listings here, and you can browse a list of them without becoming
a member. However, to view job details you need to subscribe to a
membership, which is either $10/month or $50 annually. As of this
writing, listed jobs include field marketing reps, music
teachers, PR marketing, sales, promotion reps, managers and
assistants. And that's just jobs posted in the last week.

MUSIC GORILLA
http://www.musicgorilla.com
Music Gorilla has put together a very interesting talent
screening concept. While it offers the same features as many of
the other music hosting services listed here, what sets them
apart is their relationship with music supervisors for film/tv
and representatives from record companies, including Geffen,
Jive, RCA, Lava, Reunion/Essential, DreamWorks, Miramax, Sony and
many others. Each record company representative is given their
own custom page from which they can review talent within the
genres of music they are looking for. Anyway, the point is that
if it is your desire to "be heard" by a music industry
professional, this is, perhaps, one way to do so. Music Gorilla
charges $24.95 a month for their service and they "guarantee"
your music to be heard or your money back.

RECORDING INDUSTRY ASSOCIATION OF AMERICA
http://www.riaa.com
The RIAA represents the trade organization whose member companies
create and/or manufacturer 90% of all sound recordings in the
United States. Why is this of use to you, the indie musician?
Because although a few independents view the RIAA as the 'enemy'
representing big money and big business, they do in fact provide
a wealth of information on what's happening in the industry. The
RIAA site is regularly updated with information on new
technologies, copyright law, freedom of speech, licensing,
royalties, market data and more. Hanging out at the RIAA site you
definitely get a different perspective - the business perspective
- and that's a perspective you ought to know.

STRETCH THE SKIES
http://www.stretchtheskies.com
STS makes an impressive effort to take all the needs of
independent artists and put those services under one roof.
Services provided include a free, searchable "handbook" of music
industry info, press kit evaluation and development, a management
plan, graphic and web design, an email management tool, recording
services, bar code creation, soundscan reporting and they'll even
help you get your music on digital services such as iTunes. It's
free to sign up for STS, but there are some costs for some
services that are quoted individually. Really worth a look.

U.S. COPYRIGHT OFFICE HOMEPAGE
