URGENT, STOP ANTI-DUMPING LAW AGAINST CHINA.

Dear Caring friend,

In January 2004, the US International Trade Commission( ITC)
rendered a preliminary determination that there is a reasonable
indication that less-than-fair-value imports from China are causing
material injury to the domestic furniture industry. The Department
of Commerce is expected to announce its preliminary findings
regarding the levels of dumping and the application of antidumping
duties on or before Thursday, June 17, 2004.

Therefore, the timing is so URGENT. Please Let's write a very
Urgent letter Now to stop such vicious, unfair punishment on China.

Subject: STOP USING ANTI-DUMPING LAW PUNISHING CHINA.

Dear Mr. President,

In light of an association of U.S. manufacturers of wooden bedroom
furniture and some Unions representing workers in the industry having
filed an antidumping petition with the U.S. International Trade Commission
last October, as concerned Voters and Consumers, we present our
Urgent Pleas here to our President, our Government and our Congress :

1: Please Stop using the Unjustified, Unfair, Anti-Dumping rule
against China. Such heavy punishment is Unfair, Unjustified,
Unwise and self-defeating .
The final result of the anti-Dumping law is that millions of American
Consumers either have to pay High prices to US manufacturers
Or it will NOT create the Jobs as many Congressmen claimed due
to the shifting of the manufacturing ground to other low cost Asian
countries. The potential result of this is to trigger Inflation in US.
Such move will further jeopardize America's Economy by reducing
US manufacturing profits and further laying off more people.

In anti-dumping cases against China, the Commerce Department
doesn't use the actual costs in China , because China is Unfairly
considered a "NON-Market" Economy. Usually, Indian prices are used.
India doesn't have much of a furniture industry, so investigators estimate
the price of a bedroom mirror by looking at the much higher cost of
Indian automotive mirrors or telescope mirrors. Does this sound Fair ?

A recent paper by Dan Ikenson, Policy Analyst, Center for Trade
Policy Studies at Cato Institute, calls this case "a tactical maneuver by
one group of domestic producers that seeks to exploit the gaping loopholes
of the anti-dumping law to get a leg up on its domestic competition.
Instead of preserving or returning domestic jobs (which is the public
justification for the petition), import restrictions will cause a shift in
sourcing from China to places like the Philippines, Indonesia, Brazil,
and Vietnam -places from which many of the petitioners have begun
or are poised to begin importing themselves..... Conclusion: This case
is a perfect example of how porous antidumping rules are abused for
commercial gain. The evidentiary burden for proving dumping is so
minimal that petitions can cite high quality and low production costs as
evidence of unfair trade. Further, they can cite their own decisions
to source from China as evidence of injury to themselves. The
existence of the Byrd Amendment, which compensates petitioners and
supporters of petitions, only tilts the equation further in favor of using
trade remedies to gain a commercial advantage. In the words of one
of the respondents in this case, the U.S. trade laws "are not intended
to protect U.S. producers from the folly of their own failed business
plans."

2: Please Grant "Market Economy" status to China.
Please Stop using "Non-Market Economy" status to suppress
and manipulate China's Economy.

China's transition from a "Planned Economy" to a "Market Economy"
began at the end of 1978. China has taken the enormous pain to lay off
hundreds of millions state workers in order to achieve such transition.
China won membership in the World Trade Organization (WTO)
in 2001. The WTO is an organization for countries of "Market Economy"
status, and WTO "membership" itself should prove that China is worthy
of "Market Economy" status. While more and more countries
recognized and have granted China "Market Economy" status, however,
the U.S. rejects to grant "Market Economy" status to China in order to
attempt to block China's exports and shield US local industries.

China has become a developing country with a Market Economy by
the end of 2001, according to experts. A report recently issued by the
Institute of American Studies under the Chinese Academy of Social
Sciences affirms China's progress in establishing a Market Economy.
According to the report, China has made tremendous changes in its
economic and trade systems after two decades of reform and opening-up.
In 1999, the prices of 95 per cent of retail consumer goods were no longer
subject to State control. The figure was 90 per cent in agricultural
produce and 85 per cent in production material sales. By the end
of 2001, only 15 items were subject to prices directly controlled by
the central government. "
The report concluded that the degree of Marketization in the Chinese
Economy is much higher than that of many WTO member countries.

The BOTTOM LINE OF "NON-MARKET ECONOMY" STATUS:
The Secretary of Commerce Evans said that "...until market forces
set economic decisions, including labour and currency rates, China
will remain a non-market economy." We completely Oppose
such Discriminating, Unfair and Conspiratorial view on China's
Economic status. The bottom line is that Washington is unwilling to
give up its Anti-Dumping dirty tactics, an important tool for it to
"Manipulate and Press" China's trade policy. The US government
unfairly and wrongly thinks keeping China from obtaining "Market
Economy" status is the key to protect domestic industrial interests.
Such abusive use of dumping rules against China has long deviated
from the WTO's principle of bolstering Free Trade.

In the first three months this year, 11 investigations about anti-dumping
against Chinese products were listed, registering an 83.8 per cent
year-on-year rise. And the trade volume involved in these cases
reached US $330 million, 15.6 times that from the same time last year.

Given China's non-market economy status, the anti-dumping
investigations against Chinese exports are being carried out on the
basis of product prices in a surrogate country, such as Singapore
in previous cases, where labour costs are far much higher than those
in China. That is so Ridiculous, Discriminating and Wrong.

In the past three years, US exports to China grew by 76 per cent,
while US imports from China rose by 52 per cent. The rise in exports
to China has outgrown the imports from China. And US exports to
the rest of the world decreased by 9 per cent over the same period.
It also proves that the "stable" exchange rate of the yuan has laid a
solid base for the smooth development of Sino-US Trade.

The US government and US media relentlessly claim the trade deficit
with China was more than $ 120 billion last year. However, the US
uses a different, Unfair calculation to "Enlarge" the Imports from China.
The real figure could be only around $ 50-60 billion trade deficit with
China in 2003. Furthermore, a "made in China" toy sold for $10
in US, China is making perhaps no more than 50 cents from it.
The rest goes to the numerous extremely wealthy American Multi-
National Companies who take huge advantage of Chinese workers
very low wages and mostly those wealthy American companies do
not even pay Chinese workers any basic "health" benefits at all.
It is very clear that "Who" are violating Chinese workers' rights.

Many economic experts said that if the US furniture industry and its
Union's plot and maneuver succeeds, American workers won't be
any better off, and millions of American CONSUMERS will pay the
final price. Now, please stop using Anti-Dumping rules against China's
furniture and all their other imports. It is so important to grant China
with "Market Economy" status so that to be Fair to China as well as
to strengthen the most important US-China Relationship. Thanks.
