Larry Wright arranged that for his brother who originally sang it in their
quartet, The Sundowners.  He later sang it with Chicago News.

I read through the PowerPoint and found this at the bottom of one of the
slides:

Thus, unless the Department of Justice (the creator of the presentation) is
behind the times, the copyright has expired.

As I posted to the group last April and again in September, even if it has
been renewed though, the 1935 copyright registration for Happy Birthday
covers only the lyrics and even that is questionable. It has been
successfully argued that just changing the person's name is enough of a
departure from the copyrighted lyrics that singing the words with any name
is not a violation of the copyright -- if, indeed, there is one. Then
there's the whole issue of what might constitute a "violation" when singing
it. Although the copyright law doesn't state actual numbers, it is
apparently okay to sing it for a small gathering (such a family members) but
not for a large gathering (such as a restaurant's patrons) without paying
the royalty. And there's also the question of whether you can sing it
without paying a royalty if you are doing so for "non-commercial" purposes.

Just to muddy the waters, Peter Irvine, an attorney who specializes in
music-copyright law, writes at

In what, for me, was a rather exhaustive search, I found no court cases
pertaining specifically to copyright violations for the use of Happy
Birthday, let alone a settlement on the copyright holder's behalf. BTW --
Neither could Peter Irvine (whom I spoke with personally about this.)
Apparently the copyright holder's strategy is to go afer the "big"
situations (such as in a motion picture), threaten a law suit that would
bankrupt most "violators" and collect the royalties.

Perhaps someone with more time and interest might want to research this
further.

Hope this will satisfy all concerns.

Our group isn't able to go, so I have 16 tickets for sale on the ground floor,
next to the sound stage, rows 33 and 34, seats 1-8 in each row. One ticket is

One could always argue, that HBTY was indeed written well before the 1935
copyright date (proven since it was used on Broadway and movies before
then), and that the 1935 copyright was fraudulently obtained.  Next topic:
Do today's copyright terms meet with the constitutions description of

respective Writings and Discoveries"?

Perhaps you didn't notice that I cited that URL in my initial response to
Alexander, the group, Lorin, and you.

Here's what Peter Irvine, the music-copyright attorney whom I quoted wrote to me
after our phone conversation today:

where you are singing needs to have a blanket license from ASCAP.

  If you are singing the song within a circle of friends and family, it is likely
not a "public performance," and thus you are not infringing on the copyright. On
the other hand, if you are performing for a large group of strangers, it is a
public performance, and you need to either get a license, or have the
performance covered by an ASCAP blanket license. Many performance venues,
including some restaurants, will have an ASCAP blanket license, so you may be
covered.
  There are exceptions. Certain uses may qualify as "fair use," but that needs to
be examined on a case-by-case basis.
  It is possible that the copyright will expire in 2030.

  Finally, if some one wants to challenge the Happy Birthday copyright, and has
the funding to go up against a very large corporation, I'm interested.

Has an enterprising computer-programming expert created a user-friendly template
for a choral riser chart yet?  I envision this template working in conjunction
with an Excel database that would include these sortable column headings:

Last Name
First Name
Membership Status (Member, Expired, Pending)
Participation Status (Active, Inactive)
Attendance Status (Adequate, Inadequate)
Voice Part (Tenor, Lead, Baritone, bass, Director)
Agility Rating (Good, Average, Poor, Seated)
Height Group (Short, Average, Tall)
Vocal Ability Rating (Good, Average, Poor)
Timbre Rating (Bright, Average, Dark)
Facial Expression (Good, Average, Poor)
Row Number (1, 2, 3, 4, 5)
Position Number (1-20, From Left to Right)

The "plan view" image of the risers should be shown according to scale, with
color coded dots that include names and color-codes for voice parts.  A separate
page could include an option to input the dimensions of any stage to create a
plan view (to scale) of that as well.

The advantages of this product over the felt-board or magnetic board are:

1.  Several people could work together on riser chart maintenance from home.
2.  Updated riser charts could be shared with all singers electronically on a
weekly basis.
3.  Current riser chart could be printed and posted weekly.  

This software would not give any chorus a competitive advantage.  It would
simply save planning time and rehearsal time.  If this product already exists, I
would sure like to purchase the right to use it.  If it doesn't exist, any
choral riser manufacturer would have an opportunity to be a hero by paying the
right smart-guy/gal to create it as a copyrighted work with their company name
at the top for advertising purposes.  Who wants to make it happen?

Hi Bill --

As the crux of this as Peter Irvine explained it to me is that the copyright
holder (with hugely deep pockets) will come after those cases where they believe
the numbers are right, demand payment, threaten debilitating lawsuit, and
collect their money. I asked Peter if he'd take on the case pro bono but he
courteously declined the invitation.
