Online Radio Is Saved; SoundExchange Will Not Enforce New Royalty
Rates on Sunday

At today's Congressional hearing about the new rates for online
radio that would essentially destroy it (as readers of this blog
already know), SoundExchange, which was scheduled to receive the new
royalty payments on Monday morning (since the enforcement date falls
on a Sunday), made a startling statement.

The SoundExchange executive promised -- in front of Congress -- that
SoundExchange will not enforce the new royalty rates. Webcasters
will stay online, as new rates are hammered out.

I just spoke with Pandora founder Tim Westergren, who expressed
relief that Pandora wouldn't have to shut down on Sunday in response
to the new rates. He said, "It was getting pretty close. I always
had underlying optimism that sanity was going to prevail, but I was
beginning to wonder."

He said everyone who called their Congress person about this should
feel that they had an effect on the process:

"This is a direct result of lobbying pressure, so if anyone thinks
their call didn't matter, it did. That's why this is happening."
The flyer DiMA distributed to Congress today probably helped a bit
too, but overall, it appears Congress intervened due to pressure from
web radio listeners.

Funnily enough, Westergren told me this mere hours after a
representative of SoundExchange said
that the new rates are "etched in stone." Twice. Evidently not.

Westergren had more to say, lending insight into a process that was
largely opaque to non-participants. Apparently, the per-channel
minimum fees mandated by the Copyright Royalty Board were never taken
very seriously by those involved. They've now been taken off the
table completely, saving Pandora, Live365, and other multicasters
from their most imminent threat.

"No one thought those per station fees were remotely rational. It
only makes sense that they're being taken off the table."

As for the Copyright Royalty Board? They're entirely cut out of the
process, having set the rates and then refused a rehearing. Going
forward without the royalties being collected, SoundExchange and
webcasters will negotiate a new royalty rate with Congress looking
over their shoulder -- "and last but not least, the public looking
over Congress's shoulder." Alternatively, Congress now has time to
consider the Internet Radio Equality Act, which would set webcaster
royalties at 7.5 percent of revenue and allow them to continue
operating pretty much as they have been.

Either way, this is a big win for webcasters and their listeners.

SURF'S UP for five former members of the legendary beach music group The
Embers when they reunite as Legends of Beach tonight for a sold-out
semi-private party at the Hilton Norfolk Airport hotel.

The event is the annual Beach Bash sponsored by the Tidewater Auto Auction.

Legends of Beach includes original Embers member Jackie Gore, who penned the
beach music anthem "I Love Beach Music" in 1979, bassist Jerold Davis,
Johnny Barker on keyboards, saxophonist Mark Black and trumpet player Rusty
Smith.

  "In the beach music community, this is like The Beatles getting back
together," said Randy Watson of Chesapeake, a friend of the group and the
guiding force behind the re-formation.

Watson says he sold a capacity-level 300 tickets in a matter of hours for
the Bash.

"I could have sold 500 easily. I had to turn people away."

The beach music style, made popular in the Carolinas during the 1950s and
60s, combines several genres, including rhythm and blues, soul music and
disco. It is closely linked to the shag dance style, or the Carolina shag.

The Embers formed in 1958 in Raleigh, N.C., performing a version of R&B that
became popular along the coastal areas of South Carolina, North Carolina and
Virginia.

"It wasn't called beach music back in those days," said Gore in a telephone
interview. "They didn't really start calling it beach music until about 1968
"

The heyday for The Embers came in the 1980s, thanks in part to the immense
popularity of "I Love Beach Music."

After signing a contract with Budweiser, the song was used as a feel-good
jingle in commercials with the lyrics changed to "I love Budweiser." The
band embarked on a Budweiser-sponsored tour, which included stops in Hawaii,
Los Angeles and San Diego. And it was hotter than fire in the
shag-dancing-crazed town of Myrtle Beach, S.C.

The Embers featured what bass player Davis described as "five different
Vegas-style floor shows."

"I felt like we were on a roll," said Davis, who had joined in 1976, "and
then Jackie left the band."

Gore jumped ship Sept. 1, 1994, for what he said were "personality conflicts
" He had been the voice of the band for about 40 years.

"For beach music people," said Watson, "that was like losing a member of the
family."

Through the years, other members of The Embers departed for various reasons.
When a "partner" left, he was bought out and replaced by a hired musician.

When Davis quit The Embers in March of this year, drummer Bobby Tomlinson
became the sole "partner." His version of The Embers continues to tour, and
he controls the rights to how The Embers' name is used.

But that doesn't bother the former members.

"He went his way, and we're going ours," said Gore. "We're real happy with
the situation of forming Legends of Music."

Legends of Music will perform as an eight-piece group.

"We're doing some of the floor shows, medleys and tributes to the rhythm and
blues artists of the '60s," said Davis, whose nephew, Tony Davis, will be
playing drums.

The Norfolk show tonight is a dress rehearsal of sorts. The group's official
tour begins

Aug. 25 and 26 at T.J.'S in Raleigh. Other performances are scheduled in
Atlantic City with more to be announced, and Legends of Beach is working on
a new studio album.

"Some of the stuff is remakes of the songs we did as The Embers because we
want to be able to sell them," said Davis, now 61. "We own them, but we
cannot sell them as The Embers: 'I Love Beach Music' and 'Summertime's
Calling Me.' And we'll do some (new) original material."

For Gore, who is 65, the reunion as Legends of Beach will be a renewed labor
of love.

"We're going to be doing the R&B that people call beach music that people
love," he said. "We're going to be doing a lot of promotions in newspapers
in North Carolina, South Carolina and Virginia over the next year, and that
should really help get us off the ground. It takes a while to get a new band
going."
