+++ WHAT'S NEW

This last week, the Bank of Japan's Deputy Governor,
Hirohide Yamaguchi, told the press that Japan is unlikely
to sink back into a double-dip recession, and that while
deflation is with us, it is less likely to be a problem
moving forward. It appeared that his comments were intended
to offer some positive spin after the previous week's BOJ
report showing that Japan's Consumer Price Index (CPI) was
still negative this last half, and is likely to stay
negative for the next two fiscal years.

Reinforcing Yamaguchi's view that the economy has turned
the corner is financial news from the very strategic U.S.
market, where the U.S. Commerce Department announced a
strong July-September quarter of growth, annualized at 3.5%
-- indicating that Obama's stimulus policies are working
and the economy is recovering. Of course, this was an
annualized figure, and some would say, including us, that
the way the U.S. figures its GDP numbers conveniently
forgets to include the cost of borrowing the money the
government is busy pumping into the economy (unlike private
consumption figures, where the cost of the goods are
subtracted from the value of them).

The OECD is also saying that the indicator of economic
activity in its 30-member organization shows that things
are recovering. The OECD numbers carry some credibility
because of their detailed inputs and previous track record
in presaging actual improvements and declines. According to
the OECD, the leading indicator for the U.S. in September
was 99.2, up from 97.8 in August; for Europe as a whole,
102.7 versus 101.3; and for Japan 98.8 versus 97.5.

Then of course there was the surprise news that
unemployment in Japan fell to 5.3% from 5.5% in August.
Most analysts expected the unemployment rate to stay the
same or even rise.

So, are things really getting better? Should we be making
plans for business and personal consumption expansion in
2010?

We'll say up front that we're bears on the economy and
believe that this current reprieve is temporary. We're not
economists, so our reasoning is necessarily simple minded
-- but hard to ignore. Unemployment and underemployment are
running at very high levels in all developed economies, and
when you have lots of people out of work you get falls in
taxes and consumer spending, and increases in mortgage and
lending defaults. In the current environment, you're also
getting huge issuances of government debt to make up for the
lack of private economic activity. All of these trends are
very concerning, and lead us to a negative view even as the
stock market soars.

1. Unemployment and underemployment

As mentioned, Japan's unemployment rate has fallen from a
high of 5.7% in July to 5.3% in September. The Bureau of
Statistics says that the all-important indicator, the
job-to-applicant ratio, rose from a record low of 0.42 (42
jobs for every 100 job seekers) in August to 0.43 in
September, indicating that firms are employing people
again. As a result, household spending also rose in
September to 1% more than the same period last year.

Now, an unemployment rate of 5.3% sounds almost positive to
anyone in the U.S. or Germany, where the unemployment rate
is now 10.2% and 7.6% respectively. However, as a Nikkei
editorial recently pointed out, because of Japan's more
stringent lay-off rules, companies rather than cutting
necks are instead slashing salaries (overtime and bonuses
in particular) -- meaning that people stay in work, but the
economy as a whole is stressed just as much as if
unemployment was higher.

The Nikkei says that average pay per worker dropped 1.6%
year-on-year in September, the 16th straight month of
decline. June marked the peak of salary contraction, when
average pay for that month dropped a huge 7% against the
same period a year before. In contrast, salaries in the
U.S. have actually gone up, by up to 4.3%, since October
of 2008. They have also risen by 1.3% in the U.K., and by
0.8% in Germany. So this is a clear indication that
instead of lay-offs, the pain being spread around in
Japan.

Further, at least some of the drop in this month's
unemployment number is probably because of the government
stimulus subsidies for companies who don't do lay-offs.
Apparently about 2m employees are now having their salaries
subsidized -- which is a lot, and points to the fact that
under employment in Japan is probably very high. Providing
the global economy really does mend itself in the next 12
months, then maybe this policy of subsidizing under
employment will be a bet well made. But, if there is a
second decline, it will be difficult for the government to
not extend the subsidies to even more firms, which could
lead to a massive increase in such payments.

2. Mortgage and other loan defaults

Unemployment and underemployment of course lead to less
consumers being able to pay their bills, let alone engage
in discretionary spending. We hear a lot about the climbing
mortgage default rate in the U.S., and how if weren't for
government subsidies to support that market, we'd be
having a "son-of-derivatives-shock" of fairly massive
proportions right now. Well apparently, the same thing on a
less exaggerated level is going on here in Japan as well.

Japanese banks hold around one quarter of their JPY445trn
loan balances as home mortgages. The national Consumer
Affairs Center of Japan says that in the last six months it
has had 1,625 mortgagees approach it since April, after
losing their jobs, up about 50% over the same period last
year. This of course is a much smaller rate than troubled
mortgages than in the U.S., but since Japanese are not
normally complainers, it is highly likely that these 1,600
people are just the tip of a much bigger iceberg. Indeed,
this is suggested by the fact that Bank of Tokyo-Mitsubishi
is getting about 500 consultations per month at present, up
about 200% over the first half of this year, and the other
major banks are experiencing similar surges.

There are other indications that things are serious in the
private mortgage market -- and remember we're not talking
subprime debt, but regular salarymen (typically men) with
regular jobs, going underwater. We were told recently by
the leading player in vacant home management that there are
about 4.5m vacant properties in Japan -- about quarter of
the much publicized 20m vacant homes in the USA. We also
heard that court confiscation of properties with unpaid
taxes is soaring. Certainly the increasing volume of
tax-seized properties being sold for cents in the dollar
(sen in the yen?) online seems to provide evidence of this.

3. Government spending bubble

Then don't get us started on the DPJ's plans to increase
Japan's public lending balance from 218% of GDP this year
to 246% by 2014. Coupled with a 20% reduction in tax
revenues this year and debt servicing costs amounting to a
full 20% of the national tax take (the government now pays
JPY26bn a day on bond interest payments), things are
looking really serious for the nation's public finances.
One wonders if the government can really keep up all the
subsidies and stimulus programs that were promised prior to
the election, and just where they think the money will come
from? Massive additional Quantitative Easing (QE) through bond
issuance is going to get harder to do as buyers get more
nervous and realize there is no real plan to reduce the
debt. Indeed, a meltdown is just a market panic (like the
one of last year) away.

So to sum up, the stock markets may be up, and after a
year's time-out, consumers globally are having to replace
some of their fixed asset base with new cars,
refrigerators, and other China-made, Japanese-branded
goodies -- leading to a temporary improvement in the
nation's trade surplus and employment figures. However, our
take is that we are living on borrowed time, and as the
government starts to run up its public debt to such a point
that buyers of government bonds (JGBs) baulk at their
creditworthiness, there is a odds-on chance that we will
see a repeat of last year's meltdown sometime in the next
12-18 months.

Thus, our advice, and certainly we're taking this
ourselves, is to repair your balance sheet as quickly as
possible, and get ready for another round of financial
upheavals.

OK, a little plug here... It could also be a good time to
start your own company, because scared managers of
potential customers tend to look for innovation and
cost-savings to fix their problems, and they are more ready
to dump cozy established relationships... So, if you

It looks like Bain Capital will be the buyer of Citibank's
telemarketing portfolio company, Bellsystem24, a company
that originally belonged to CSK. Bain is reportedly
offering around JPY100bn. Bain has until November 11th to
close the deal, having beaten out Permira Advisors and CVC
Capital working with Blackstone Group. Citi will be happy
to be getting the cash, although it is apparently less than
the JPY151bn (US$1.66bn) Bellsystem24 was originally valued
at when they bought up the rest of the company's shares

-> Takeda sues Teva

Per our news item below about foreign law firms bulking up
to help Japanese companies protect their IP, Takeda
Pharmaceutical has just announced that it is suing Israeli
generic drugs maker Teva Pharmaceutical, for infringement
of a U.S. patent on Takeda's Rozerem sleeping tablets.
Takeda says that it is protected by a patent until 2017,
but Teva reckons that the Takeda patent is invalid because
the invention is obvious. ***Ed: The market also seems to
think that Teva will prevail in this one, with its stock

-> Chinese grab stake in Biomaster

A leading biotech company providing adipose-based stem cell
therapies, Biomaster, has sold a big stake in itself to
Shenzhen-based Beike Biotechnology, China's leading stem
cell research firm. Beike seems to have made a very canny
investment, picking up the China and global partnering
rights for Biomaster's cosmetic surgery applications.
Biomaster is the only company licensed by the Health
Ministry to offer stem-cell based therapies to the public
in Japan. Its main commercialization has been a
proprietary technique called Cell-Assisted Lipotransfer
(CAL), which allows for the extraction of fat from the
legs or belly of a patient, mixes the fat with a stem cell
treatment, then injects the mix into other parts of the
body where a cosmetic or reconstructive effect is desired
-- such as breast reconstruction, breast augmentation,
facial treatments, and buttocks lift. Apparently
Biomaster's success rate is much higher than for
conventional lipotransfer methods. ***Ed: If Chinese
nouveau riche women worry about body augmentation as much
as Japanese women do, then Biomaster should do very well

-> Foreigner local voting rights happening or not?

While the DPJ's list of policy proposals prior to being
elected included granting local authority voting rights for
permanent resident foreigners, PM Yukio Hatoyama is now
backtracking by saying that effecting such legislation
would be "difficult" -- presumably because of political
back lash feared from Japan's right. ***Ed: Hmmm, this is
the same DPJ that repeatedly submitted bills to give
foreign residents the vote. Surely Japan could take a leaf
from the notebooks of other countries that allow foreign
residents to vote, even though they are not citizens. Our
view is that if it's good enough to tax foreigners, they
should have the right to choose who gets to legislate that

According to the Nikkei, 3 of Tokyo's major foreign law
firms are bulking up on staff, on the back of increased
international patent, M&A, and contractual actions being
encountered by Japanese firms. The three are Baker &
McKenzie, which now has 122 staff, up 7 from last year;
Morrison Foerster (MOFO), which has 70 lawyers; and White
& Case, which also has about 70 lawyers. MOFO is quoted as
saying that it has been handling an increasing number of
patent infringement cases, such as its recent
representation of Pioneer and Funai Electric as they filed

Last month, 7-year-old Somer Thompson did not return home from school with her brother and sister. Cops say she ran ahead of them on their walk home, and was seen on a sidewalk outside a vacant home being remodeled a few hundred yards ahead before she vanished.

The story had the nation, including the AMW newsroom in Washington, D.C., praying for the best and fearing the worst.

"We all think it will never happen to us, we all think we're immune. It always happens to someone who's not expecting it," says AMW correspondent John Turchin, who worked on the story. "Three kids just walking together, and one just ran a little ahead of them on the sidewalk and she vanished. Aliens didn't drop out of the sky and put her on a spaceship, you know?"

The police and the rest of the community were baffled. There were no witnesses that claim to have seen Somer being snatched. Two days later, police found the answer no one wanted to hear.

"Two detectives, Bruce Owens and Sgt. Joey Jett, are driving to work early in the morning, and both happened to see garbage trucks picking up trash in residential areas," John said. "They both got the same idea. If not for these two men who went to the Sheriff and suggested they follow every single truck that picks up garbage in that area, she would have never been found. She'd be under a hundred tons of garbage."

Somer's body was found in a Georgia landfill 55 miles away and was identified by the clothing on her body and a birthmark on her left leg. Along with her remains, the landfill contained a substantial amount of evidence that may be able to help police find out whoever committed the atrocious act.

"They're going through every piece of garbage, looking for letters, looking for bills, anything that kind of gives them a zeroing-in point," John said. "These two detectives did an amazing job. They think it's routine, but Somer's mother, Diena Thompson, the sheriff, myself, and everyone else thinks it's a miracle."

John met with Diena and her family one evening for the story, and it was very emotional experience. While he says these types of cases are always hard, this particular case hit John a little too close to home.

"It was gut-wrenching. Somer was a twin, and I have twin girls myself," John said. "When Diena was talking about how her son lost the sister who came into this life with him, I started thinking about the day my daughters were born and how it would feel if they lost each other. It jolted my heart."

While abduction stories happen disconcertingly often and can seemingly happen to anyone, John offers some consolation in the form of cautionary advice.

"The only thing to say to parents is to keep talking to your kids, keep telling them reality stories," John said. "Keep letting them know this kind of stuff happens in every single community, because there are sick people out there. We never seem to get rid of them."

The Amazing Chase

C.J. Davis, on break from college, was walking to the corner market in Berkeley, Calif. when he met his untimely fate.

Cops say four members of the North Side Oakland gang approached Davis and fatally shot him with their assault rifles. Behind one of the firearms, cops say, was fugitive Rafael Campbell.

"I monitor the news for the West Coast and noticed this story up in Northern California about a triple murder," says AMW producer Andrew Holland. "I made the calls to Berkeley Police Department, and they needed our help with leads."

While the first murder happened, when cops say gang members opened fire on C.J. Davis, the other two murders occurred during the subsequent high-speed chase.

Two officers were in the vicinity of the scene, one who heard the gunshots and another who saw the suspects' Cadillac fly by at a high rate of speed. The chase ended in a massive crash that killed two other innocent people.

Although three of the four alleged gang members said to be involved have been arrested, Campbell is still on the run.

"When I told AMW's Co-Executive Producer, Steve Katz, about the story, he suggested I produce the first act of the show with straight action from top to bottom, no voiceovers or sound bites. It was a great idea and a new kind of story-telling for us. In the end, I think that enhanced the drama."

One of the most enthralling scenes of the reenactment is the intense, high-speed chase. Andrew said the crew achieved this effect with a little help from some boys in blue and some Hollywood magic.

"We could not have done it without the cooperation of the Berkeley P.D," Andrew said. "They blocked the streets and supplied officers to portray themselves."

On set, recreating that fatal collision was an intense moment when safety awareness was critical.

"Paramedics were on standby, but we had a great team of stunt coordinators come up from L.A. to consult. They were top-notch professionals and made sure we go our shots and got them without anyone getting hurt," Andrew said.

"Cops are hoping our show will produce the one lead that will put Rafael Campbell behind bars," Andrew said. "There's a very good chance Campbell could still be hanging out in the Oakland area with members of his gang, so viewers should keep their eyes peeled in that neck of the woods."

+++ WHAT'S NEW

An article in the Nikkei last week covered the bullishness
of Osaka Titanium over the world market for polycrystalline
silicon (also known as polysilicon) -- the core material
that high-efficiency photovoltaic (PV) cells are made from.
Osaka Titanium, as the name implies, has been a leading
producer of the lightweight, high-strength metal that was
supposed to feature widely in the engines and fuselage of
the Boeing 787 Dreamliner aircraft. But due to production
delays, the market for titanium is glutted right now, and
Osaka Titanium has decided to turn to and expand its other
major product line, making Polysilicon.

Currently the company produces about 1,400 tonnes of
polysilicon annually, enough to account for around 3% of
world production. The company, along with many market
experts, is predicting that after a stalled PV market in
2009, down about 20% over 2008 due to the weak economy in
Europe and lower oil prices, demand for PVs will recover
from 2010. We agree with them that this is highly likely
-- especially given the likely return of high oil prices
and further declines in the U.S. dollar. Nomura Securities
says that the demand for polysilicon will be around 105,000
tons by 2012.

Osaka Titanium is sufficiently convinced of the coming
global expansion that it is spending JPY45bn (US$470m) on a
new production facility to increase the volume of silicon
that it can churn out, expecting to hit around 3,600 tons a
year within two years. This is gutsy move, given that the
company saw its first quarter net profit drop from JPY3bn
for the same period last year to just JPY340m this year.
Still, maybe they don't have any choice...

This level of bullishness is duplicated by other Japanese
companies as well, based on what seem to be sensible
predictions of massive growth in the PV sector worldwide.
But we wonder if: a) the demand-side growth predictions are
really believable, and b) even if the volumes are met,
whether there won't be an equally rapid commoditization of
the PV market, much as has happened to RAM chips. If this
happens, then companies like Osaka Titanium may get saddled
with lots of debt (JPY45bn is a lot of cash) plus
spiraling loses in the face of competition from China, as
well as from producers of non-polysilicon PVs
(photosensitive dyes, Thin-film products, etc.).

Right now the Japanese account for about 20% of the world's
production of PVs. This is a sharp drop from the commanding
60% market share they used to have five years ago. There
are plenty of reasons why Japanese manufacturers have lost
market share so quickly, but the main ones are a lack of
domestic government interest in PVs and legislation to
support their implementation at home, unlike Germany which
until this year was subsidizing installations in a massive
way, coupled with the inevitable foreign catch-up in
knowhow and capital to build factories to compete with
Japan. Then there was that inconvenient silicon shortage in
2007 and last year, as well.

For the record, in 2007 11 Japanese companies produced 23%
of global demand for PVs, or about 931MW worth of cells. We
read online that to supply 25% of the worlds entire electricity
energy needs with PV cells by 2030, we need to be producing
16m tons of polysilicon a year -- so there does appear to be
plenty of expansion opportunity left yet.

In the last few months, there seems to have been somewhat
of a resurgence of government interest in solar -- perhaps
as tax revenues have fallen and the guys at METI have
convinced the politicians that PVs are good for reducing
foreign oil reliance. Domestic subsidies and a massive ramp
up of new home installations are being planned. Therefore,
there has been such a surge of factory investment that if
all expansion plans are carried out, Japan will be
producing around 3.5GW of cells by 2010 and a massive 7GW
by 2012. Still, even this rate of growth will only keep
them in the "teens" in terms of percentage of global market
share.

Global growth of the PV market is predicted to explode and
right now solar cells are the fastest growing energy
segment. According to analysts, the PV industry grew 60% in
2007, and became a JPY1.932trn (US$20bn) business. It is
likely to expand to JPY5.5trn (US$57bn) by next year
(2010). This means that the market will be somewhere
between 7GW and 17GW in 2010. Needless to say, figures like
these have drawn in tremendous levels of private
investment. Apparently US$28.6bn, or 19% of all new global
venture capital/private equity, has been pumped into the
sector over the last 4 years (since 2004).

OK, a little memory test: what was the global demand figure
for solar cells in 2010? Maybe as high as 17GW, but more
likely around 10GW-12GW. The only problem is that the
predicted global production of PVs in 2010 is supposed to
hit 35GW...!

Therefore it is clear that there is going to be a serious
oversupply in PVs from next year -- which can only lead to
substantial price reductions. This is good news for
consumers, but worrying for producers.

Unfortunately for Osaka Titanium, once they get much
further into their factory development, they can't just
turn it off again. In its role of upstream supplier, the
company has already seen its market dynamics change
radically. Whereas in 2005-2006 just 10 companies
globally produced polysilicon in quantity, now over 100
do so in China alone. Yes, many of these have poor
quality control, but their competitive pricing is so
compelling that it is only a matter of time before they hit
the acceptable quality/price ratio and start knocking
Osaka Titanium and its Japanese colleagues out of the
market.

So, needless to say, we won't be buying any Osaka Titanium
shares this year.

The 5-day Silver Week (a second mini Golden Week) in
September may have been disruptive to regular businesses in
terms of lost productivity, but it had a palliative effect
on major hotels in Tokyo and Osaka. Apparently visitor
nights rose 5.2% over the same period last year, with 19
major hotels in Tokyo enjoying an average occupancy rate of
76.4% and in Osaka 78.3%. While room nights were up,
revenues were down, with most establishments offering at

Major construction company, Nishimatsu, has agreed in a
court sponsored mediation to pay five Chinese wartime
laborers JPY250m (US$2.74m), and to issue an apology and
build a memorial for those that died during the war and
since. The Supreme Court turned down an appeal in 2007 from
the plaintiffs for damages, on the basis that China had
already given up its right to future claims for war damage
upon its signing of the Japan-China Joint Statement in
1972, and that individuals have no right to seek such
reparations. ***Ed: Although this was a private settlement,
Japan would do well to copy the German response and face up
to its history. In doing so, it will earn a lot less
ill-will elsewhere in Asia. May we also be so bold as to
suggest that Nishimatsu's major projects in China and Hong
Kong might have had something to do with the decision to
settle? Either way, it was the right/smart thing to do.**

Leading Nomura Research economist, Richard Koo, has made a
public statement recommending that the U.S. does not step
back from its current stimulus efforts, despite an apparent
recovery in the markets. Koo says this would be a huge
mistake and will lead the U.S. to experience a recession of
the order that Japan suffered in the 1990's and early
2000's. Koo says that the U.S. government needs to stay its
course for at least three to five more years, until
consumer savings improve and can replace government
spending again. Koo says that the Japanese 1990 stock
market implosion caused a loss of JPY1,500trn (US$16trn) in

While it seems like commonsense not to mix most fish dishes
(perhaps seared tuna is an exception) with red wine, now
Japanese scientists at wine producer Mercian have found
that the iron content in red wine appears to accentuate the
fishy taste and smell of seafood and thereby makes it less
appealing. Mercian ran tests with subjects eating scallops
with various types of wines and spirits and found that
they could accentuate the fishy taste and smell by
artificially increasing the iron content of the red wine.

Reader comment: Great commentary in your Terrie's Take 534
(September 24, 2009) that I forwarded to many here in
Kansai. It made its way into the mailbox of a General Union
Rep who sent me a thanks for passing it on.

Anyway, for my 2 yen worth, when I resigned from Onkyo last
year, I noticed that my payments for and coverage from
health insurance (through the Japan Electrical Workers
Union) immediately ceased on the final day of my
employment. I am now covered by TJK (www.tjk.gr.jp/) as a
"regular salaryman". I can only assume these organizations
handle health insurance or claims on behalf of the
government, but it is unclear as to whether or not one is
required to continue to pay if the employment contract
finishes.

So, it may all be very well to make it a legal requirement
to pay into these programs, but the transparency of how it
will actually work in practice is still unclear.

==> Our response: We think you'll find that you are supposed
to start paying in to the Kokumin Kenko Hoken program as
soon as you lose your job or become unemployed...

A Texas babysitter accused of beating a toddler in her care to death.

Yaser Said
A Houston taxicab driver accused of killing his two daughters.

Beacher Hackney
A Virginia resort worker accused of gunning down two of his bosses.
