Hello, fellow music fans,

I have a small favor/request for you all...

I am looking for a copy of "pulp fiction" -- the one from 1994...I'm rather
limited on funds for textbooks right now, and am wondering if someone had a copy
of that...and perhaps of Natalie Goldberg's "writing down the bones" (2005
edition) that they would allow me to borrow for this coming term, and then I
could return it at the end of the term...

I need two other books, but those are clunky texts that people may not
necessarily have kicking around...but I figured the folks on these lists might
have the other two books, and I didn't think it'd hurt to ask...

This coming term I'm taking Survey of American Literature and Creative
Writing...

It's going to be GREAT!! :-)

After this term, I'll only need nine more classes, and I should actually be able
to test out of at least two of them...I will be graduating in June of 2010...I
am SO excited!...Then, it's on to my post-bacc. teaching certification...

In NH even if you're not fully certified yet but are working on it you can often
pick up teaching jobs...If I don't get into the schools full time this year as a
Special Ed. Assistant, I should be able to get in full time next year...This is
VERY good news, indeed!

Blessings to you all,
-Ramona Anne

*who can hardly wait for school (college and elementary!!) to start back up!...*

I think it sounds good. It's a nice simple arrangment much like Mark's
recording. Phil Keaggy had it available as a free download last year
right around the date of Mark Heard's death.

Anyone hear this album by Phil Keaggy and Randy Stonehill, and is their song
"Love Is Not The Only Thing" a Mark heard cover? If so, how good is it? If you
think its good I might get it just to hear it.

Hi Jim....
i did a fairly extensive search and could not find any resources for
chords for those particular songs. when this has happened to me in the
past, i resigned myself to starting the song in the key that best fits
my vocal and then learning and playing the song by ear.
I would encourage u to join this Yahoo group--

I seem to have gotten a copy from a good batch ... No problems that I
noticed.

Three of the songs are solo versions of Infinity+3 songs. The other
eight are previously unreleased, unless I'm missing something.

Good to hear about AppMel and Part III ... although with Solid Rock
it's always IBIWISI.

Funny - I just ordered both part 1 and 2 a couple of weeks ago, and I
haven't even received them yet (the tracking link says it was shipped last
Tuesday) but I got an email today from Kristin at Solid Rock saying they
were shipping me a replacement due to some technical problems. I guess they
had a bad batch.

I also had the same problem with the disc I received from Solid Rock.
Sounds like they may have a manufacturing issue.

I got my copy, and it sounds pretty good, except the CD was
defective, with some kind of tone interrupting the music on every
song. So I emailed Solid Rock and they called me on the same day and

I don't think I've heard any of the songs before, so when I finally
get a good copy it'll be fun to hear some "new" Mark Heard.
Also, I was told Appalachian Melody will come out next year and
there's also enough for a Part 3 of Artifacts.

Thanks for the heads up, David. Very good news that the folks at
Larry Norman are releasing this!!!! Now if only they would release CD
version of Ap.Melody. I heard here once that they never re-released
it onto CD because their masters were not good enough quality to
digitize.  I wouldn't even care if they made it from a vinyl transfer;
if they could make a clean copy, and if they did it with quality
packaging and a few bonus tracks from the original sessions I think it
would be a hit, people that do not have access to it would have a
legal avenue to acquire it and Mark's legacy would be enhanced.

To me its not a big deal if The Lost Artifacts are low budget, for
they only hold interest for the most rabid fan, but Ap. Melody holds
such importance in mark's body of work that if it ever re-released I
would hope that they would make an attempt to do a professional job of
it. I don't think Larry's fan's would have been very happy if a
bedrock Trilogy album like "In Another Land" was re-released as a
bland cover CD-R.

Larry Normans solid rock records is now listing a new album of Mark
Heard recordings:

http://www.merchantmanager.com/phydeaux/MM001.ASP?pageno=72

If I recall correctly the previous release was CDR based, so don't
expect high quality packaging or extensive linear notes. (Although I
haven't actually seen the CD, so this is primarily supposition.)

purchased? Also, does anyone have the chords or tabs to "Treasure of

If ever there was a Mark Heard song that was tailor made for Glass
Harp to play, it would be Mark Heard's "Treasure Of The Broken Land."
I listen to this song every day, and every time I hear it, I can hear
them boys playing it, and envision all the possibilities....John
Sferra laying down his steady persistent licks, Daniel Pecchio's solid
rock bass foundation and, of course, Phil Keaggy improvising all over
the place. The tail end of this song has some great beatlesque hooks
in it and it closes with some great instrumentation that is right up
the Harp's alley....how do I go about starting a petition to get the
guys to do this? If I ever win the
lottery I'll PAY THEM TO DO IT!!!!!

Vinny,
Format shifting is allowed as long as you have a copy of the original.
For example, I have transferred most of my vinyl over to CD-R. My wife
said, "great, now you can finally get rid of all those albums." I had
to explain to her that if I got rid of the albums I would also have to
get rid of the CD-Rs!

Format shifting is not allowed if you own the LP, for example, and
make CD-R copies for your friends. You copy would be legal, theirs
would not.

In terms of economic harm, the argument goes, if its out of print, I'm
not taking money out of the artists pocket if I download a copy. Not
quite. What a person is doing in that situation is affecting future
revenues. Until the copyright expires, the copyright holder has
exclusive rights to reproduction. If enough people download it
illegally this can impact decisions to go to the time and expense of
re-releasing an album.

Perhaps the easiest way to understand copyright is by analogy.
Copyright is part of intellectual property law. Copyright holders have
the same rights in property as any other property holder. So, for
example, if I own a house and don't live in it, someone simply can't
move in and say "hey, you weren't living here so I moved in." (and,
until the squatter can be removed this forecloses future revenues in
rent). Make sense?

My apologies if this isn't the place for this, especially given the
copyright discussion that's ongoing.

In converting all of my CDs to mp3s, I've found that my copy of "Mystery
Mind" has decayed in some way. It's not scratched, but nevertheless
several songs won't play. Would anyone be able to send me the mp3s of
the 4 demo songs, at least?

Thanks,
Rusty

Hi there Mike,

'The Last Performance' is indeed the title of the live album released by
'Fingerprint Records'. It was Mark's Cornerstone concert (July 4th 1992) where
he suffered a minor heart attack on stage, but carried on with the set! He told
the audience that he thought he was having a heart attack, but Mark being an
incredibly funny guy, they thought he was joking!! They stomped and cheered for
an encore until news come through that he'd just been seen being driven away in
an ambulance. Pierce Pettis  had said to Mark 'I think they wan't an encore'.
Mark replied, 'You do it!' I can't listen to this fantastic live album without
tears streaming down my face. You won't regret purchasing a copy, I can assure
you, Mike!

With kindest regards from a fellow 'Heardy', Ian Rabjohns.

So is "The Last Performance" the name of a CD? If so, I'd be
interested in knowing where to obtain it, also, as I'm not familiar
with it.

Thanks.

Is it illegal and unethical if it is "format shifting"? I have Ap.
Melody on Vinyl, would obtaining it as CD be wrong?

Does it matter if the copyrighted material is sold or given away? If
an out of print album isn't sold, is there economic harm?

I don't have a dog in the fight... just trying to expand my knowledge
a bit.

I didn't know this. My apologies for posting this here then. I assumed because
one-way was a legitimate website that it was okay and legal, because all of the
albums listed there were out of print.

My apologies if this topic has been discussed before...

As a teacher of copyright law, it isn't true that just because an

album is out of print that it is legal to make a copy. Copyright

holders retain control over intellectual property regardless of

whether or not is in print until the copyright period expires. The

only way for a copyright holder to abandon their rights is to abandon

the copyright by not enforcing it. This is what happened to the movie

"It's A Wonderful Life." (and ironically the abandonment propelled it

to new viewing heights).

I tell my students that unless you can verify that a copyright has

been abandoned, don't copy it.

The matter is further complicated in that there may be more than one

copyright holder and/or the work may be a work for "hire" (the length

of copyright varies depending upon whether an individual or a

corporation holds the copyright).

A quick search of the United States Copyright Office database shows

that Applachian Melody is still under copyright protection. The

copyright holder is listed as "Solid Rock Records" (an employer for

hire situation) which means that most likely Larry Norman's heirs now

hold the copyright on the album. Without their permission, it is not

legal (or ethical) to copy the album.

Hi there Mike,

I heard a few years ago, from a Fingerprint employee, that Fingerprint were
going to release it on CD, but it never came about I'm afraid. However, I now
hear that 'Paste' records are trying hard to get the rights to release the album
on CD. I've got Mark's 'Appalachian Melody' on vinyl only and, like you Mike,
cannot wait to hear these songs on CD! So, Mike keep hoping, and get in touch
with Paste, as they may be able to give you the latest news.

God bless you Mike,
Ian (Rabjohns)

Does anyone out there know how I could get a copy of Mark's Appalachian Melody
album? I
have an old cassette that is getting pretty bad. I spent an hour trying to find
it on the web to
no avail.

Thanks,
Mike

Hello Mike,

Go to www.one-way.org/mp3 and click on the Mark Heard hyperlink.

There you will see "Appalachian Melody" available in it's entirety in
a zip file of MP3's.

It converted from a vinyl so the sound is not CD quality, but it is
free and legal because it is an out of print album.

They have a lot of cool out of print stuff up there. Feel free to
check it out!!!!!

Is "Appalachian Melody" available anywhere ... I have searched for it
also? Will it ever be released on cd?

I also have a worn out cassette that I can no longer enjoy. I have
wanted to share some of the great songs with my children ... maybe one
day I can share them with my grandkids ...
